COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
,session at the City Administration Building, Monday, July 10,
1972 at 7:30 P.M., with the following members present: Mayor
R. C. Macon, Councilmen: James P. Nix, John A. Robertson, Robert
H. Cowen, Henry G. Bishop and Sam E. Box.
Minutes of previous regular and special meetings were
approved.
A.request from Recreation Center Committee to hold a
political rally at Memorial Park at the Municipal Pier was dis-
cussed. Motion by Councilman Box seconded by Councilman Cowen
that permission be granted to hold rally South of the Municipal
Pier on July 18, 1972. Motion carried.
Motion by Councilman Robertson seconded by Councilman
ev Bishop that City request a complete report from Fiscal Agent at
the next regular meeting of the Council. Motion carried.
Motion by Councilman Bishop seconded by Councilman Box
that Mayor be authorized to negotiate for ninety daycrenewal of
Water and Sewer Note and pay interest in amount of $1,150.00.
Motion carried.
Motion by Councilman Nix that the following Ordinance
be introduced:
ORDINANCE N0. q 96
AN ORDINANCE AMENDING ZONING ORDINANCE NO. 295, SECTION 13.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, that Section 13 of Zoning Ordinance No. 295, be amended by!.]
rezoning from R-2 to B-2, the following described property located
on the S/W corner of Young and Middle Streets:
From the N/E Corner of the NJW,4 of Section
20, Township 6 South; Range 2 East, run South
935 feet bo S/W corner of Intersection of
Young and Middle Streets for the POB; thence
run South 140 feet; West 120 feet, East along
South side of Middle Street 80 feet to Point
of Beginning 0.318 Acres in Carrie Young Tract
in S/E 4 of N/E 4 of N/W 4 of Section 20, Town-
ship 6 South; Range a East, Baldwin County, Ala.
Motion by Councilman Robertson that the following Ordinance
be introduced, motion seconded by Councilman Box:
ORDINANCE NO OS_
AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES OF
ZONING ORDINACE NO. 296.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, that Section 13, District Boundaries, of Zoning Ordinance
No. 295 be amended by rezoning to M-1 the following described pro-
perty: 3.01 acres located on Highway 98 at Parker Road, North
East quardrant, Outside City Limits, Rezone with the stipulation that
all tanks be underground and that plant be laid out and landscaped
as required by the Planning and Zoning Commission.
Motion by Councilman Cowen that all rules governing the
Council which might, unless suspended,prevent the passage and adop-
tion of the Ordinance at this meeting, be and the same are hereby
suspended for the purpose of permitting the said Ordinance to be
finally passed and adopted at this meeting. Motion seconded by
Councilman Nix.
Upon being put to vote the results were as follows:
Voting Aye: Mayor Macon, Councilmen: Nix, Robertson, Cowen, Bishop
and Box. Nays: None. Motion carried unanimousl Councilman Cowen
then moved for Final adoption of Ordinance No. q j� as introduced.
Motion seconded by Councilman Nix. The question with the following
results: Aye: Mayor Macon, Councilmen: Nix, Robertson, Cowen, Bishop
and Box. Nay: None. Motion carried unanimously and Ordinance adop-
ted as introduced.
Councilman Nix introduced the following Ordinance:

AN ORDINANCE TO REPEAL SECTION 6 OF ORDINANCE NO. 478
ADOPTED THE 1ST DAY OF JANUARY, 1972.
BE IT ORDAINED by the City Council of the City of Fairhope:3
Alabama that Section 6 of Ordinance No. 478 amending Section 10-9
of the Code of Ordinances of the City of Fairhope, Alabama be, and
the same is hereby repealed.
Section 10-9 of Code of Ordinance of the City of Fairhope
shall read as follows:
Any person desiring to use the City Garbage Dump for the
purpose of dumping or disposing of refuse shall have the right to
do so at no charge or fee, subject to the person hauling his garbage
or refuse, shall unload the same in only the designated areas in
the City Garbage Dump.
All other sections of Ordinance No. 478 shall be and remain
the same.
This Ordinance shall take effect upon it's due passage and
advertisement as required by law.

Motion by Councilman Bishop seconded by Councilman Robert-
son that $30,000.00 be transferred from Gas Department to General
Fund. Motion carried.
Motion by Councilman Bishop seconded by Councilman Gowen
that bills be approved for payment. Motion carried.
Motion by Councilman Bishop seconded by Councilman Cowen
that City ask for bids on three police cars, trade in old cars,
as per specificationsfpf Chief of Police. Motion carried.
Motion by Councilman Cowen seconded by Councilman Nix that
City purchase Fairhope tags for Band Club at a cost of $357.00.
Motion carried.
Motion by Councilman Box seconded by Councilman Nix that
City Attorney, John Duck, be authorized to work with Moore Engineering
Company on getting land for test wells. Motion carried.

Councilman Cowen introduced the following Ordinace which
was read in full to theCouncil. Motion seconded by Councilman Nix.
ORDINANCE NO. 422
AN ORDINANCE TO AMEND ORDINANCE NO. 295 OF ZONING AND MOBILE
PARK ORDINANCE OF THE CITY OF FAIRHOPE, ALABAMA AS PASSED BY JANUARY
14, 1963, TO ALLOW THE BUILDING OF SINGLE FAMILY HOMES IN THE R-1
RESIDENTIAL DISTRICT ON SUB -STANDARD SIZE LOTS SUBJECT TO APPROVAL
OF THE PLANNING COMMISSION; TO ALLOW THE BUILDING OF SINGLE FAMILY
DWELLINGS ON SUB -STANDARD SIZE LOTS NOW EXISTING IN THE R-2 RESIDEN-
TIAL DISTRICT SUBJECT TO APPROVAL OF THE PLANNING COMMISSION; TO AL-
LOW THE ERECTING OF MULTIPLE FAMILY DWELLINGS ON SUB -STANDARD SIZE
LOTS IN THE R-3 RESIDENTIAL DISTRICT SUBJECT TO APPROVAL OF THE
PLANNING COMMISSION; TO CREATE AN R-5 DISTRICT FOR THE SOLE USE OF

BE IT ORDAINED by the City Council of the City of Fairhope,
Alabama to amend Ordinance No. 295 "Zoning and Mobile Park Ordinance"
passed on January 14, 1963, to read as follows:
ARTICLE 1 - Section 67.05 "Location" of Mobile Home Park
Ordinance No. 295, is hereby repealed.
Section 67.05 - Location. There is hereby created an R-5
district, and mobile home parks may be located in districts only
zoned as R-5. Where any boundary of a park directly abutts property
which is improved with a permanant reaidential building located with-
in twenty-five (25) feet of such boundary, or directly abutts un-
improved property which may under existing laws and regulations be
used for permanant residential construction, a fence, wall or hedge
shall be provided along such boundary.
All other provisions in Ordinance No. 295 relating to mobile
homes shall remain as originally stated in Ordinance No. 295•
Ordinance No. 295 is further amended to read as follows:
ARTICLE II - All 1Ot sizes referred to R-1 in the compre-
hensive zoning plan Ordinance No. 295 shall remain as is except as
follows:
(a) Where a sub -standard lot size is located in an R-1
district, and was located within an R-1 district at the time of the
original Ordinance No. 295 was adopted, there is hereby allowed an
owner to build thereon subject to the approval of the Planning Com-
mission after due advertisement as long as the dwelling erected
thereon shall be for single family dwellings only, and is in general
keeping with the other family dwellings located in the immediate
surrounding area.
(b) All references to R-2 single family dwellings as to lot
size and area, shall remain as staged in the original Ordinance No.
295 except that if a sub -standard lot existed at the time of the
original passage of Ordinance No. 295 in R-2 district, the owner thBre-
of shall have thei:,right to erect a single family dwelling thereon,
subject to the approval of the Planning Commission and due adver-
tisement as long as the dwelling to be erected thereon is in general
keeping with the other dwellings located in the immediate surrounding
area.
(c) All references to R-3 multiple family dwellings as to
lot size and area, shall remain as stated in the original Ordinance
No. 295, except that if a sub -standard lot existed at the time of
the original passage of Ordinance No. 295 in an R-3 district, the
owner thereof shall have the right to erect a multiple family dwel-
ling thereon, subject to the approval of the Planning Commission and
due advertisement as long as the multiple family dwelling to be erec-
ted thereon is in general keeping with the other dwellings located
wihhin the immediate area.
All other sections of Zoning Ordinance No. 295 with Amend-
ments, are hereby reaffirmed and ratified.
This Ordinance shall become law upon it's adoption and due
advertisement as required by Law.

Councilman Cowen moved that all rules governing the,,Council
which might, unless suspended, prevent the passage and adoption of
the Ordinance at this meeting. Motion seconded by Councilman Box.
Upon being put to vote, the following vote was recorded:
Aye: Mayor Macon, Councilmen: Nix, Cowen, Bishop and Box. Nay:
Councilman Robertson. Motion defeated. Ordinance held for ac-
tion at next regular meeting.
Motion by Councilman Box seconded by Councilman Nix that
City increase dues to South Alabama Regional Planning by $350.00.
Motion carried.
Motion by Councilman Bishop seconded by Councilman Nix
that upon recommendation of Bobby Long, Utilities Department; the
City hire an additional meter reader. Motion carried.
There being no further business, upon motion duly secon-
ded and carried unanimously, meeting adjourned.
