HomeMy WebLinkAbout06-26-1972 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Administration Building, Monday, June 26, 1972 at 7:30 P.M., with the following members present: Mayor R. C. Macon, Councilmen: James P. Nix, John A. Robertson, Henry G. Bishop and Sam E. Box. Councilman Robert H. Cowen being absent. Minutes of previous regular meeting were approved. Mr. Milham requested additional electricity at the Pier mainly the Marina. Motion by Councilman Nix seconded by Council- man Box that City rework electric lines to Marina. Motion carried. Mrs. Martha Hill requested Council to take definite ac- CFels n on bicycle trails starting with Section Street from Oak to fer and Church Street from Fig to Fels. After general discus- n, Councilman Box moved, seconded by Councilman Nix that the y will make every effort to start on sidewalk and bicycle paths Section Street from Oak to Gayfer and Church Street from Fig to as soon as work on Fairhope Avenue and Morphy Avenue is com,f ted and funds are available. Motion carried. The following bids were received on gas pipe as per speci- fication: L. B. Foster Co., Birmingham 3,0001 - 3/411 20.75/CWT 2,0001 - 1" T27.50/CWT 8,7231 - 211 $55.00/CWT Terms 2% 10 days, American Manufacture. Consolidated Pipe and Supply Co., Birmingham 3,000' - 3/4" 20.75/CFT 2,0001 - 111 27.50/CFT 9,313' - 2!' 55.00/CFT Motion by Councilman Box seconded by Councilman Robertson that City Superintendent be authorized to accept bid to best ad- vantage of the City. Motion carried. The following bids were received on water pipe as per specifications: Moore -Handley, Inc., Mobile 1 load 6" Class 21 pipe @ $2.13 per Ft. McWane Cast Iron Pipe Co., Birmingham 1 load 6" Class 21 pipe @ $2.16 Motion by Councilman Box seconded by Councilman Robertson that City accept low bid of Moore -Handley Hardware at $2.13 per foot for Class 21 pipe. Motion carried. The following bids were received on reroofing building on Morphy Avenue known as Old Baptist Church Building: M. D. Dawkins, Contr. Summerdale Contract Price $1,658.52 Sears, Roebuck & Co., Mobile Contract Price $1,768.94 Strickland Enterprises, Inc., Fairhope Contract Price $1,652.00 Quality Roofing, Bay Minette Contract Price $1,568.50 Motion by Councilman Box seconded by Councilman Nix that City accept low bid of Quality Roofing Company in the amount of $1,568.50 for reroofing Old Baptist Church Building. Motion car- ried. Mr. Michael Breedlove was appointed as acting Mayor to perform the duties of the Mayor during Municipal election since Mayor Macon is a candidate for re-election. Council discussed and agreed to make another study of light pole located in front of Material Sales Company on Fair= hope Avenue. Councilman Bishop introduced the following Ordinance which was read to the meeting. ORDINANCE NO.�ft AN ORDINANCE TO ESTBLISH AN OFFENSE FOR ANY PERSON ENTER- ING UPON THE MUNICIPAL TENNIS COURTS OF THE CITY OF FAIRHOPE, WEAR- ING HARD -SOLED SHOES OR ANY OTHER SHOES THAN REGULARLY APPROVED TENNIS SHOES, OR ENTERING UPON THEMUNICIIPAL TENNIS COURTS ON SKATES, BICYCLES, OR ANY OTHER MEANS OF WHEEL TRANSPORTATION, ESTABLISHING A FINE FROM ONE ($1.00) DOLLAR TO TWENTY-FIVE ($25.00) DOLLARS FOR THE VIOLATION THEREOF, AND MAKING THE PARENTS OF ANY MINOR LIABLE FOR THE OFFENSE COMMITTED. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA that: SECTION 1. It shall be unlawful for any person to enter upon the surfaces of the Municipal Tennis Courts of the City of Fairhope, Alabama, wearing hard -soled shoes, or any other shoes other than regularly approved tennis shoes, which tennis shoes shall be approved by the person in charge of the Fairhope Munici- pal Tennis Courts. SECTION 11. It shall be unlawful for any person to enter upon the surfaces of the Municipal Tennis Courts of the City of Fairhope, Alabama, barefooted, or on a bicycle, or on roller skates, or any other whell transportation, or wearing any shoes not approved by the person in charge of the Fairhope Municipal Tennis Courts. SECTION 111. Any person violating this Ordinance, shall be fined, on conviction, of a fine of not less than ONE ($1.00) DOLLAR, or more than TWENTY-FIVE ($25.00) DOLLARS by the Court trying the offense. SECTION IV. BE IT FURTHER ORDAINED by the City Council of the City of Fairhope, Alabama, that parents of minor children violating the Sections of this Ordinance, shall be liable for the fines and Court Costs imposed by the Court hereunder. This Ordinance shall take effect upon its due adoption and publication as required by Law. ADOPTED .this the 26th day of June, 1972. S/R. C. Macon Mayor ATTEST: S/ Marie Moore City Clerk Councilman Bishop moved that all rules and regulations which, unless suspended, would prevent the immediate considera- tion and adoption of said Ordinance be suspended and that unani- mous consent to the immediate consideration and adoption of said Ordinance be given. The motion was seconded by Councilman Robert- son and on roll call the results were: Voting Aye, Mayor Macon, Councilmen Nix, Robertson, Bishop and Box. Voting Nay: None. The Mayor declared the motion carried, Councilman Bishop moved that said Ordinance be placed upon its final passage and adoption. Motion seconded by Councilman Robertson and upon roll call the following results were recorded: Voting Aye: Mayor Macon, Councilmen Nix, Robertson, Bishop and Box. Voting Nay: None. The Mayor then declared the motion carried and said Ordinance passed and adopted as introduced. Motion by Councilman Bishop seconded by Councilman Box that Moore Engineering Company be authorized to proceed on -Project PFL-ALA-196, AndqWS-ALA-149, Water Facilities, in accordance with Contract #3970, dated 3/9/71 between Moore Engineering Company and the City of Fairhope, motion carried. Motion by CouncilmanNix seconded by Councilman Box that the following Resolution be adopted: RESOLUTION The following Resolution was introduced by Councilman Nix and Seconded by Councilman Box, read in full, considered and adop- ted: RESOLUTION AUTHORIZING, ADOPTING, APPROVING, ACCEPTING AND RATIFYING THE EXECUTION OF A GRANT AGREEMENT FOR PROJECT NO. 7-01- 0029-01 BETWEEN THE UNITED STATES OF AMERICA AND THE CITY OF FAIRHOPE, A MUNICIPAL CORPORATION. BE IT RESOLVED, by the City Council of the City of Fairhope, Alabama. SECTION 1: That said City Council of the City of Fairhope, Fairhope, Alabama, hereby authorizes andzadopts, approves, accepts and ratifies the execution of Grant Agreement between the FEDERAL AVIATION ADMINISTRATION on behalf of the United States of America and the CITY OF FAIRHOPE, a Municipal Corporation, Fairhope, Ala- bama. SECTION 11: That the execution of said Grant Agreement in quadriplicate, on behalf of the said City of Fairhope, a Muni- cipal Corporation, by R. C. Macon, its Mayor, and the Impression of the official seal of the City of Fairhope, a Municipal Corpora- tion, and the attestation of said execution by Marie Moore, its City Clerk is hereby authorized, adopted, approved, accepted and ratified. SECTION 111: That the Mayor is hereby authorized to execute payment request under this Grant Agreement on behalf of said CITY OF FAIRHOPE, a Municipal Corporation. SECTION IV: That the Grant Agreement and all addendums thereto referred to hereinabove, shall be attached hereto and made a part of this Resolution as though it were fully copied herein. Motion by Councilman Nix seconded by Councilman Box that (rGevneral City of Fairhope acting by and through its Airport Board bor- up to $42,834.00 and that the loan be repaid from revenue de- d from operation of the Airport, but the loan be backed by the Obligation of the City. Upon being put to vote the follow - vote was recorded: Voting Aye: Mayor Macon, Councilmen Nix, rtson and Box. Councilman Bishop abstained from voting. Motioied. Motion by Councilman 3ishop seconded by Councilman Robert- son that Mayor Macon be authorized to execute an adendum to Grant Agreement pertaining to lights at Municipal Airport. Motion car- ried. Motion by Councilman Robertson seconded by Councilman Box that City ask for bids on Air Conditioner for Public Library. Motion carried. Council authorized placing voting machine in City Adminis- tration Building, 387 Fairhope Avenue, beginning July 7, 1972 for 30 days. It was duly moved and seconded that the meeting adjourn.
