STATE OF ALABAMA
COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session at
the City Administration Building, 387 Fairhope Avenue, on Noonday,
May 229 1972 at 7:30 P.M. with the following members present:
Councilmen: James P. Nix, John A. Robertson, Robert H. Cowen,
Henry G. Bishop and Sam E. Box. Mayor R. C. Macon absent.
In absence of Mayor Maoon, Mr: Sam Box, Mayor Protem presided at
the meeting.
Notion by Councilman Robertson seconded by Councilman Cowen that
minutes of the previous regular meeting be approved. Notion carried.
Lt. Lowe, Alabama State Trooper, requested that Council furnish
janitor service and additional chairs and tables for the old Council
room where drivers tests are given.
A Jail Inspection Report from Alabama Board of Corrections was
presented to Council and placed on file.
Notion by Councilman Robertson seconded by Councilman Bishop that
Ordinance No. 483, An Ordinance Amending Section 139 District
Boundaries of Zoning Ordinance No. 295 by rezoning from R-2 to B-1
property at 61 S. Church Street and 63 S. Church Street, introduced
at the regular meeting of May 89 1972 be adopted as introduced,,
Motion carried.
Notion by Councilman Nix seconded by Councilman Robertson that the
City ask for bids on riding lawn mower as per specifications of
City Superintendent and City Purchasing Agent. Bids to be opened
at next regular meeting of the Council on June 129 1972. Motion
carried.,

Notion by Councilman Robertson seconded by Councilman Nix that
City accept low bid for 28 - 150OW Quartz Flood Lights provided
bids meet specifications, 24 lights to be installed at Little
League Field as soon as possible and 4 lights to be installed at
tennis courts on St. James Street. Motion carried.
Notion by Councilman Cowen seconded b�y Councilman Nix that the
following Resolution be adopted: Motion carried.
RESOLUTION
WHEREAS, the CITY OF FAIRHOPE has obtained from PHILIP F.
STENZEL and his sister, JOAN S. MURPHY, a construction easement
and permanent easement to be used in the construction of its sewer
facilities now under construction, and
WHEREAS, the Grantors, in the several and separate easements,
are desirous of being protected from any erosion or slough -offs
caused by the construction of the said easements, and
WHEREAS, the CITY OF FAIRHOPE is protected under its contract
with the contractor for the protection of the same;
NOW, THEREFORE, BE IT RESOLVED that the Mayor is hereby
authorized to enter into an agreement with the Grantors, PHILIP F.
STENZEL and JOAN S. MURPHY$ for their protection from erosion and
slough -offs in accordance with the said agreement as attached
hereto.
ADOPTED this the 22ndday of May 1972.

Lotion by Councilman Cowen seconded by Councilman Nix that the
City Treasurer be authorized to draw draft in the amount of
$29 000.00 payable to Philip F., Stenzel, Joan S. Murphy and Lloyd
E. Taylor, Attorney, for construction easement and permanent ease-
ment for the construction of a sewer system. Motion carried.
Notion by Councilman Bishop seconded by Councilman Robertson that
bill of Quality Printing Company in the amount of $29168.17 be
paid subject to return of two chairs that are not needed. Notion
carried.
Councilman Nix reported on meeting with Alabama, Power Co. officials
whereby City personnel could switch lines when electricity goes
off providing certain agreements have been met.
City Superintendent reported that he had received notice from
Alabama Power Company of a 29.4% rate increase effective May 39 1972.
Money from rate increase is to be placed in Escrow until the Federal
P w e r Pb1=MGG7K6e Commission approves rate.
Notion by Councilman Nix seconded by Councilman Robertson that Mr,
St. John, Electrical Engineer, be employed on per diem basis to
make a study 6f the City's electric rate. Notion carried.
Mayor and Council proclaimed Saturday, May 279 1972 as "SHRINES
CRIPPLED CHILDREN' S HOSPITAL DAY%
It was duly moved and seconded that the meeting adjourn. Notion
carried.i
