The City Council of the City of Fairhope met
at the City Administration Building, Monday,
7:30 P.M. with the following members present:
Councilmen: James P.- Nix, John A.= Robertson,
Sam E.. Box, Councilman Robert H. Cowen being

Minutes of the previous meeting were approved.;
This being date set for public hearing on rezoning Vick and Stearns
property on South Church Street, no protests being heard, Council-
man Robertson introduced the following Ordinances
ORDINANCE N0, V-41i
AN ORDINANCE AMENDING ZONING OADII NCE NO. 2959
SECTION 139 DISTRICT BOUNDARIES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA that the following described property be rezoned from
R-2 to B-1 as recommended by the Planning and Zoning Commission:
The South 31.7 feet of Lot 11 and the North 34.3
feet of Lot 129 Block 139 Division 10 leasehold
of Lloyd Vick, located at 61 S.° Church Street.
The South 31.7 feet of Lot 12, all of Lot 139 Block 13,
Division 1, leasehold of W. C.i Stearns located at 63 S.
Church Street.
The request of mrg 0. Malcolm to waive Ordinance No. 295 as to
minimum lot size and street frontgge on Lot 4 in Malcolm property
Subdivision on Gayfer Court was referred back to the Adjustment
Board.
Motion by Councilman Boa seconded by Councilman Robertson that
the City advertise for public hearing on rezoning from R-2 to
B-19 2.80 Acres, 180 feet West of Section 6treet and bounded on
the West by Boone Lane and South by Kirkman Lane., Motion carried.'
Estimate on repairing roof at Health Clinic was submitted and
referred to the Insurance Company.'
Motion by Councilman Boa seconded by Councilman Robertson that
City's Share of Alabama League lots in amount of $366:00 be -
approved for payment,. Motion carried."
Motion by Councilman Nix seconded by Councilman Robertson that
the City request bids on up to 28 Mercury Vapor lights for Little
League Field and Tennis Court. Motion carried,*
Motion by Councilman Nix seconded by Councilman Robertson that
the City appropriate $500.00 to the Volunteer Fire Department
for their July 4th Fireworks display. Motion carried.
Motion by Councilman Bishop seconded by Councilman Nix that the
Mayor be authorized to proceed with investigation of proposal for
trash cans in the City. Motion carried.
Motion by Councilman Bishop seconded by Councilman Robertson
that the bills be approved for payment. Motion carried.,
Motion by Councilman Bishop seconded by Councilman Robertson
that $359000:00 be transferred from the Gas Fund to the General
Fund*' Motion carried.,
Motion by Councilman Nix seconded by Councilman Bishop that the
City appropriate funds to send Bill Lewis to Electric School in
Tuscaloosa, Ala.- on June 6 thru June 9: Notion carried.
Mayor Macon appointed the following committee to study need for
bicycle paths thru City Parks and elsewhere where feasible=

Mr. Barney Shull Recreation Board
Dr.' Pierce Frederick Planning and Zoning Commission
Mr. Clarence McCoy Adjustment Board
Mr., Mack Yohn Police Department
Mrs.' Martha Hill

Motion by Councilman Nix seconded by Councilman Robertson that
the following Resolution be adopted:
RESOLUTION
WHEREAS,, BILLY RAY DISMUKES and wife, NORMA S. DISMUKES
and DOROTHY Be SCHEUERMANN,- have filed with the Mayor and City
Council of the City of Fairhope, Fairhope,. Alabama,- a Deolara-
tion of Vacation to vacate so much of that certain twenty -foot
(20) alley running between Kumquat Avenue and Pomelo Avenue in
Fairhope, Alabama, and
WHEREAS,- the City of Fairhope is desirous of accepting and
assenting to said vacation by the City Council,
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and City
Council of the City of Fairhope do by these presents assent to
such Declaration of Vacation, be and the same is hereby vacated
in accordance with Title 569 Section 32 of the 1940 Code of
Alabama as recompiled in 19582

Councilman Boa introduced the following Resolution for adoption,
seconded by Councilman Nix.,
RESOLUTION
WHEHEAS� the CITY OF FAIRHOPE to in the process of construct-
ing and ex6a9nding its water and sewer facilities, and
WHEREAS, a Revenue Bond Issue is necessary for the construct-
ion development and expanding the sewer and water works facilities
in the City of Fairhope,• and,
WHEREAS, it is necessary and expedient for the City of Fair -
hope to borrow temporary construction funds until the said revenue
bonds are issued and sold, and,
WHEREAS, an Ordinance has been duly adopted at a Special
Meeting held on the 2nd day of May, 19729- authorizing the Mayor
to borrow up to FIVE HUNDRED THOUSAND (0500000:00) DOLLARS for
temporary financing on the said water and sewer project from the
FIRST NATIONAL BANK OF FAIRHOPE in Fairhope, Alabama, and
WHEREAS,' it is necessary to set up a Special Aocioubt for the
disbursement of these funds under the water and sewer project,,
NOW, THEREFORE, BE IT RESOLVED that the City Clerk be, and
she is hereby authorized to open a Special Bank Account at the
FIRST NATIONAL BANK OF FAIRHOPE9 Fairhope, Alabama, and deposit
in it all funds borrowed from the FIRST NATIONAL BANK OF FAIRHOPE,
Fairhope, Alabama for temporary construction money under Ordinance
No' I adopted on the 2nd day of May, 1972.

Upon being put to vote the following vote was recorded: Voting
Fort Councilmen Nix, Bog and Robertson. Voting Against: None.;
Counoilman Cowen being absent." Councilman Bishop abstained from
voting.' Notion oarried.
Notion by Councilman Box seoonded by Councilman Nix that the
City purchase five Plectrons for Volunteer Fire Department as
per their speoifioations: Notion carried.,
Notion by Councilman Boxx seconded by Councilman Nix that the
City extend gas line approximately 119000 feet for Y Weeks,
Mullet Point.'. Motion carried.,
It was duly moved and seconded that the meeting adjourn. Notion
carried:
