COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the Adult and Tourist Recreation Building on
Morphy Avenue, Monday, December 14, 1970 at 7:30 P.M.
The minutes of the previous regular meeting were corrected
to include the following motion:
"Motion by Councilman Bishop seconded by Councilman
Cowen that the Council approve appointment of Mr.
Claude Andrews as Harbor Master. Motion carried."
Minutes approved as corrected.
This being date set for opening bids on Street Improvement
the following bids were presented;

Motion by Councilman Robertson seconded by Councilman Bishop
that the Cityy' accept low bid of M. C. Williams in the amount
of $1479289.43 provided it meets all specifications. Potion
carried.
Motion by Councilman Box seconded by Councilman Cowen that the

xtend 6" water main North on Ingleside one block to
e Drive and continue with 2" line to house being built
Ingleside. Motion carried._
Motion by Councilman Robertson seconded by Courc ilman Bishop
that the application of M. Dial to rezone property in Volanta
from R-2 to R-3 be rejected. Upon being put to vote the
following vote was recorded: Aye: Councilmen: Cowen, Bishop
and Robertson. Nay: Mayor Macon, Councilmen Box and Nix. Mayor
Macon cast a second Nay vote to break the tie and the motion
was defeated.
Motion by Councilman Box seconded by Councilman Nix that the
City accept proposal of the Planning and Zoning Board to
rezone from R-2 to R-39 Dial property in Volanta. Council-
man Robertson moved that the motion be tabled, seconded by
Councilman Bishop. Upon being put to vote the following vote
was recorded: Aye: Councilmen Robertson, Bishop and Cowen.
Nay; Mayor Macon, Councilmen: Nix and Box. Mayor Macon cast
a second Nay vote to break the -tie and the motion Was defeated.
Mayor Macon then called for a vote on the motion of Councilman
Box to accept proposal of the Planning and Zoning to rezone
from R-2 to R-3, Dial property in Volanta with the following
results; Voting Aye; Mayor Macon, Councilmen; Nix and Box.
Voting Nay; Councilmen: Robertson, Cowen and Bishop. Mayor
Macon then cast a second Aye vote to break the tie and the
motion was carried.

A letter of resignation from Mr. E.� G. Rickarby due to
his recent illness was presented to the Council. Motion
by Councilman Cowen seconded by Councilman Nix that the
City accept with regret, Mr. Rickarby's resignation and
that a letter be written thanking Rr. Rickarby for his
services to the City. Motion carried.
Nayov Macon, with the approval of the City Council, appointed
Mr., John Duck as City Attorney.-
Motion by Councilman Robertson seconded by Councilman Cowen
that Mr. J. Russell Kilgore be appointed to the Airport
Board for a two year term ending 11-9-72. Motion carried.
Motion by Councilman Robertson seconded by Councilman Nix
that Dar. Amon Gates be reappointed to the Planning and Zoning
Commission for a six year term ending 11-9-76. Notion carried.

that $25,817.37 from the Gas
on the Pier Note and balance
carried.

Gross Revenue Account be paid
renewed for 90 days. Motion
Motion by Councilman Bishop seconded by Councilman Robertson
that the City Clerk be authorized to cash 025,000.00 Street
Improvement Savings Certificate and deposit in 1970 Street
Improvement checking account. !'lotion carried.
Motion by Councilman Bishop seconded b Councilman Nix that
Moore Engineering Company's bill of 5yof low bid on Street
Improvement be paid from 1970 Street Improvement Account. Motioncarried.

Motion by Councilman Nix seconded by Councilman Cowen that
the City accept low bid of !,,bore Handley, Inca provided bid
meets specifications. Motion carried.

Motion by Councilman Nix seconded by Councilman Cowen that
the City accept bid of Baldwin Pole and Piling Co. provided
bids meets specifications. Motion carried.
Motion by Councilman Nix seconded by Councilman Box-J that
City accept check from First Christian Church in full
payment. Upon being put to vote the following vote was
recorded: Aye: Councilman Nix, Cowen, Robertson and Box.
Nay: None. Councilman Bishop abstained from voting because
of a prejudicial interest. Notion carried.
Motion by Councilman Bishop seconded by Councilman Nix that
the City Clerk be authorized to transfer $59000.00 from the
Electric Fund to the Water and Sewer Fund. Motion carried.,
Mir. Claude Arnold, Fairhope Title and Survey, requested that
they be released from any further responsibilities or liabili-
ties under their contract dated May 20, 1969.
Motion by Councilman Bishop seconded by Councilman Box that
the bills be approved for payment. Motion carried.
It was duly moved and seconded that the meeting adjourn.
