BA LDWI N COUNTY
The City Council of the City of Fairhope met in regular
session at the Adult and Tourist Recreation Building on Monday,
October 12, 1970 at 7:30 P.M., with the following members present:
Mayor Macon, Councilmen: H. G. Bishop, Robert H. Cowen, John A.
Robertson and Sam E. Box. Councilman Nix being absent.
Motion by Councilman Bishop seconded by Councilman Box that l;1>,
Rev. St. Pierre be appointed to the Fairhope Public Library Board
to fill the unexpired term of Mrs. Claude O'Gwynn which expires May
4, 1972. Motion carried.
Motion by Councilman Bishop seconded by Councilman Box that '
the following Resolution be adopted. Motion carried.
/ RESOLUTION
BE IT RESOLVED By the City Council of .the City of Fairhope
that the properly designated representatives of the Luther4#,no
Church in Fairhope be permited to prepare and pave off street park-
ing on the West side of South Section Street from the corner of
Section Street and Gaston Avenue in� manner similar to that pre-
viously done by the First Baptist Church in Fairhope, subject to
the execution of a proper deed to the City of Fairhope by the Luther4N
imme Church, and, subject to the contemplated work being approved by
the City Councilman in charge of streets and the City Superintendent. /
Motion carried.
Motion by Councilman Robertson seconded by Councilman Box that
Council adopt budget as presented, for fiscal year ending September
30, 1971. Motion carried. _..
Motion by Councilman Bishop seconded by Councilman Box that
uncollectible miscellaneous accounts be charged off during annual
audit. Motion carried. ,
Councilman Box introduced the following Ordinance No.
An Ordinance Amending Section 13, District Boundaries of Zon-
ing Ordinance No. 2.95.
BE IT ORDAINED by the City Council of the City of Fairhope
that the following described property be rezoned from R-1 to R-3
as recommended by the Planning and Zoning Commission.
From the NE Corner of Fractional Section 5,
of the Dinsmoor Survey of Township 6 South;
Range 2 East, Baldwin County., Ala., run
thence west 30 chains for a point of begin-
ning; thence South 20 chains; thence East 6 2/3
chains; ',thence North 20 chains;tta7the 'Tawn-
ch 'p ,Lfine: 1,hthence West 6 2/3 chains to the
POINT OF BEGINNING, containing approximately
thirteen and one third acres.
Cohncilman Box introduced the following Ordinance:
ORDINANCE NO V 54
An Ordinance Amending Section 139, District Boundaries of
Zoning Ordinance No. 295.
BE IT ORDAINED by the City Council of the City of Fairhope
that the following described property be rezoned from R-2 to B-1.

From -the Northwest corner of Government
Subdivision No. 2, Sec. 20, Township 6
South, Range 2 East, Baldwin County Ala.,
run South 696 feet to a point; thence West
33 feet to a point on the West side of
Young Street; thence continue West 95 feet
to a POINT OF BEGINNING; thence South 107
feet to a point on the North side of middle
Street; thence West along the North side
of middle Street 85 feet; thence North
107 feet; thence East 85 feet to the POINT
OF BEGINNING.
Motion by Councilman Box seconded by Councilman Cowen that the
request of Mrs. Sadie Dunham to rezone property on Greeno Road
be rejected as recommended by Planning and Zoning Commission.
Motion carried.
Mayor Macon introduced the following Resolution which
was seconded by Councilman Robertson:
RESOLUTION
WHEREAS, the inland waterways of the State of Alabama in
general and Baldwin County in particular, are very important to
this area aesthetically as well as bringing financial return to
many of the citizens of this area, and
WHEREAS, it is felt that Slight loss would be suffered
by the State of Alabama for failing and refusing to issue oil and
gas drilling permits in the streams and bays of this State, and
that much damage could result through polluted and dangerous waters
which could easily result from drilling or production of oil or
gas from the waterways,
NOWp THEREFORE, BE IT RESOLVED by the Mayor and Council
of the City of Fairhope, Alabama, as follows:
That this body go on record as opposing exploration or
drilling for oil, gas or minerals in the bays or streams of the
State of Alabama.
BE IT FURTHER RESOLVED that the Clerk be directed to
send copies of this Resolution to appropriate officials in order
that the desires of this municipality may be known.
Mayor
Motion by Councilman Robertson seconded by Councilman Cowen
that the City Employees be given a 6% blanket raise based on
existing salaries as presented to Council. Motion carried.
Motion by Councilman Cowen, seconded by Councilman
Robertson that Police Department be given a 6% blanket raise
with an additional $25.00 month, pending receipt of same from
(Safe -,,Streets
Act of de oral Government. Motion carried.
�- Motion by Councilman Bishop seconded by Councilman
Cowen that bills be approved for payment. Motion carried.
Councilman Box nominated Councilman Bishop as Mayor
Protem for fiscal year ending September 30, 1971. There being
no other nominations, Councilman Bishop was unanimously elected
by vote of Council.

Councilman Box recommended that Michael Rejczyk and martin
Nelson be congratulated on certificates received for their completed
training course in advanced water treatment.
Motion by Councilman Bishop seconded by Councilman
Cowei'that the following Resolution be adopted:
BE IT RESOLVED by the City Council of the City of Fairhope,
Alabama, that the City will pay 50% of the State Administrative
expenses incurred in regard to the construction, development,
maintenance and operation of Project No. 01-00072, Fairhope Munici-
pal Park.
It was duly moved and seconded that the meeting adjourn.
