COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
Tuesday, August 25, 1970 at 7:30 P.M. at the Adult and Tourist
Recreation Building with the following members present: Mayor
Macon, Councilmen: James P. Nix, Robert H. Cowen, H. G. Bishop,
John A. Robertson and Sam E. Box.
Minutes of the previous regular meeting were approved.
Councilman Robertson introduced the following Ordinance which was
read to the meeting.
IMPROVEMENT ORDINANCE N0. 448
AN ORDINANCE TO PROVIDE FOR CERTAIN IMPROVEMENTS ON
AZALEA STREET, CITY OF FAIRHOPE, ALABAMA
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA AS FOLLOWS:
SECTION 1. That the following described street in the City
of Fairhope, Alabama, shall be improved as hereinafter provided
between the respective terminal points hereinafter set forth:
(a) Azalea Street shall be improved from the North boundary
of Fairland Avenue to the south edge of existing pavement on
Dogwood Avenue, 575 Linear feet, more or less, as follows:
Both edges of a 25 foot roadway the center line of which shall be
approximately in the center of a dedicated right of way, shall
be curbed and guttered Portland Cement Concrete combined curb
and gutter six inches thick and 2.5 feet wide. The curb line of
said gutters as above described, of a suitable radius and the
surface between the gutters to be constructed shall be improved
by paving with Bituminous Plant Mix, 1j inches thick on a 6 inch
compacted sand clay foundation; Said improvements shall include
grading and all necessary drainage structures, including concrete
culverts, concrete pipe, valley gutters and drop inlets. Manholes
of brick with oast iron covers shall be constructed or reconstruct-
ed where needed.
SECTION 2. That the full details, drawings, plans, specifi-
cations and surveys of the above described work and estimates have
been prepared by Moore Engineering Company, who has been duly
designated and appointed City Engineer by the Council, have been
fully considered and studied by this Council and hereby are adopted.
Said details, drawings, plans, specifications, surveys and
estimates shall be immediately placed on file in the office of the
City Clerk of Fairhope, Alabama, where property owners who may be
affected by such improvements may see and examine them.
SECTION 3. That the improvements herein above described
shall be made in accordance with the grades heretofore establishhed
by ordinance and according to the full details, drawings, plans
specifications and surveys of said work and estimates herein adopted,
all under -the supervision of the City Engineer.
SECTION 4. That the cost of constructing said improvements
shall be assessed against the property abutting on the portions'
of the streets so improved, provided:
(a) That the cost of improving any intersection or any part
thereof shall be assessed against the lots or parcels of land
abutting on each of the streets, avenues, alleys or other high-
ways so intersecting for a half block in each direction there-
from; provided that for the purpose of computing assessments, no
block shall be considered as extending more than 1,000 feet from
any intersection so improved.
(b) That no assessment shall exceed the cost of the improve-
ments or the increased value of such property by reason of the
special benefits derived from such improvements.
SECTION 5. That the City Council shall meet on the 14th
day of September, 1970, at 7:30 o'clock P. M. at the Adult _.
Tourist Recreation Center on Morphy Avenue in the City of Fairhope,
Alabama to hear any objections, remonstrances or protests that may
be made against said improvements, the manner of making the same
or the character of materials to be used.
SECTION 6. This ordinance shall be published once a week
for two consecutive weeks in the Fairhope Courier, a newspaper
published and of general circulation in the City of Fairhope,
Alabama, the date of the first publication to be not less than
two weeks before the 14th day of September, 1970.
SECTION 7. A copy of this ordinance shall be sent by registered
mail, postage prepaid, to the persons last assessing for City
taxation the property which may be assessed for said improvements,
at their last known addresses, said notices to be so mailed by the
City Clerk not less than ten days prior to the 14th day of Sept-
ember, 1970. ,

Councilman Robertson moved that all rules governing the Council
which might, unless suspended, prevent the passage and adoption
of the Ordinance at this meeting, be and the same are hereby
suspended for the purpose of permitting the said Ordinance to
be finally passed and adopted at this meeting. Councilman Nix
seconded the motion. The question was put before the Council and
on roll call the vote was as follows: Yea: Mayor Macon, Council -
den: Nix, Cowen, Bishop, Robertson and Box. Nay: None. The Mayor
""declared the motion adopted by unanimous vote of the members..
Councilman Robertson moved that the said Ordinance be finally
passed and adopted as introduced. Councilman Nix seconded the
motion. The question of final passage and adoption of said
Ordinance was put to vote of the Council and on roll call the
results were as follows: Yea: Mayor Macon, Councilmen: Nix,
Cowen, Bishop, Robertson and Box. Nay: Noene, The Mayor declared
the Ordinance finally passed and adopted.
Motion by Councilman Bishop seconded by Councilman Box that Council
confirm transfers of $10,000.00 to General Fund and $►10,000.00 to
Electric Fund from the Gas Gross Revenue Account on August 18.
Motion carried.
Motion by Councilman Box seconded by Councilman Bishop that
Jack Kirk and Gene Fuqua attend Natural Gas Distribution Workshop
In Montgomery, September 15, 16 & 17. Motion carried.
Motion by Councilman Box seconded by Councilman Cowen that
Michael Rejczyk and Martin Nelson attend Water School in Auburn
beginning August 30, 1970. Motion carried.
Motion by Councilman Bishop seconded by Councilman Cowen that
the City Clerk and Assistant attend Municipal Clerks' Conference
at the University of Alabama November 17-19. Motion carried.
Motion by Councilman Box seconded by Councilman Robertson that
City accept contract of Fairhope Paving Company, Inc. and
authorize the Mayor to sign same. Motion carried.
Councilman Box introduced the following Ordinance:

THAT THE FOLLOWING SCHEDULE OF RATES FOR GAS AND SERVICE FURNISHED
FROM THE GAS DISTRIBUTION SYSTEM OF THE CITY OF FAIRHOPE BE AND
THE SAME IS HEREBY ADOPTED.

For large.ihdustrial users the rate shall be such as may be
negotiated between the City and the User.

CONSUMER'S DEPOSITS
-� Each consumer shall keep on deposit with the City $5.00 as
security for the payment of bills rendered to such consumer;
provided, that any consumer who uses in excess of 509000 Cu—
Ft-of gas from the system each month shall not be required to .maintain
such deposit but may be required to maintain a deposit sufficient
to cover the average bills of such consumer.

CONSUMER DEPOSITS OUTSIDE THE CITY LIMITS OF THE
C ITY OF FAIRHOPE
Each consumer shall keep on deposit with the City $10.00 as
security for payment.
That all ordinances and parts of ordinances in conflict
herewith be and the same are hereby repealed.

Council Ax introduced the following Ordinance.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE that
the monthly electric rates for Domestic Consumers of electricity purchased
from the City of Fairhope is as follows:
$1.'oo for the first 20 KWH or less; plus V
3� per KWH for the next 40 KWH; plus
2� per KWH for the next 240 KKH; plus
1.24 per KWH for all over 300 KWH.
MINIMUM BILL
The minimum bill shall be one ($1.) Dollar.
APPLICABILITY
This service is applicable to single residences, mobile homes, where
individually metered and individual family apartments.
And the all -electric family dwelling is as follows:
NET ANNUAL RATE
$150.00 per service year, including the use of 10,000 KWH; plus 1.2�
per KWH for all over 10,000 KWH;
AVERAGE MONTHLY BILLING
Consumer's total annual use will be estimated for the initial year and
a uniform bill will be rendered monthly for twelve months in the amount of
one -twelfth the estimated annual bill. Billing for each twelve months
thereafter will be based on the actual energy used during the previous year
adjusted, if necessary, to produce an approximate zero balance at the end of
such year.
PAYMENT
Bills for service rendered hereunder are payable within ten (10) days
paid
from due date and if not/within such period become delinquent and subject to
charges as set forth in the Company's Rules and Regulations.
CONTRACT PERIOD
Service under this rate at any single premises shall be for not less than
one year except upon discontinuance of service at that premises at Consumer's
request.

SAFETY LIGHTING RATE
A safety light will be serviced at the rate of $3.00 per month
providing no separate pole has to be erected, or $3.50 per month if a
separate pole has to be erected.

COMMERCIAL CONSUMERS AND INDUSTRIAL CONSUMERS
Present rates will remain in effect. The above rates are those
charged by the City of Fairhope and any additional charges levied by the
State or Federal authorities such as sales taxes, will be passed on to
the Consumer in addition to the above rate schedules.

FAMILY DWELLING -URBAN RESIDENTIAL SERVICE
AVAILABILITY '
Available in all areas served from the interconnected system of the Company except for service
rendered from rural lines.
APPLICABILITY
Applicable for service to single residences and individual family apartments. Service shall not be
resold or shared with others except that when two or more family dwelling units are served through
a single meter, all provisions of the race and minimum shall be applied -as though each dwelling unit
had been separately metered and the actual metered consumption were divided equally between each
unit.
CHARACTER OF SERVICE
Single phase service at approximately 120 or 120/240 volts.
MONTHLY RATE
$1.25 for the first 20 KWH or less; plus
3.00 per KWH for the next 40 KWH; plus
2.O0 per KWH for the next 240 KWH; plus
1.20 per KWH for all over 300 KWH; subject
to Minimum Bill Provision
MINIMUM BILL
The monthly minimum bill shall be not less than an amount equal to an average rate of 1.40 per KWH
for the total KWH used and in no event less than $1.25•
PAYMENT
Bills for service rendered hereunder are payable within ten (10) days from due date and if not paid
within such period become delinquent and subject to charges as set forth in the Company's Rules
and Regulations.
GENERAL
Service under this rate is subject to possible FUEL or TAX adjustment as set forth in Rate FT and
to rules and regulations approved or prescribed by the Alabama Public Service Commission, includ-
ing any Special Rules and Regulations governing the application of this rate.
Effective for bills due September It 1968, and thereafter, in part subject to possible refund 'under

ALABAMA POWER COMPANY

ALL -ELECTRIC FAMILY DWELLING SERVICE
AVAILABILITY
Available in all areas served from the interconnected system of the Company.
APPLICABILITY
Applicable, at the option of the Consumer on an annual basis, for service to a single family.resi-
dence-or dwelling unit in which electricity is the source of energy required for refrigeration, cooking,
water heating and space heating and cooling where all of such energy is supplied through a single
meter. Service shall not be resold or shared with others.
Incidental power service supplied hereunder shall be limited to that required for the normal operation
of a home and does not include energy used to operate farm equipment or other non-residential
equipment of any kind.
NET ANNUAL RATE
�150.00 per service year, including the use of 10,000 KWH; plus
1.20 per KWH for all over 10,000 KWH.

Motion by Councilman Robertson seconded by Councilman Nix
that Moore Engineering Company be authorized to advertise for
bids for Street Improvements as soon as plans are completed.
Motion carried.
Motion by Councilman Box seconded by Councilman Cowen that Moore
Engineering Company be authorized to prepare proposali%%nd
specifications and advertise for bids for up to three test wells.
Motion carried.
It was duly moved and seconded that the meeting adjourn. Motion
carried.
