COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Hall, Monday, June 8, 1970 with the following
members present: Mayor R. C. Macon, Councilmen: James P. Nix,
Robert H. Cowen, H. G. Bishop, John A. Robertson and Sam E. Box.
Minutes of previous regular meeting were approved.
This being date set for protest meeting on proposed paving
the following protests were heard:
Oswalt Street from Nichols to White Avenue
Mr. Tom Van Iderstine
Mr. Otto Randall
Mr. B. L. Singletary
Protests considered and granted.
Protests on Kumquat Street:
Mrs. R. Hoffman
Written protest from C. Symbroski
Protests considered and disallowed.
Motion by councilman Cowen that the following ordinance

IMPROVEMENT ORDINANCE NO,
AN ORDINANCE MODIFYING, AMENDING AND CONFIRMING, AS
SO MODIFIED AND AMENDED, IMPROVEMENT ORDINANCE NO.
4399 INTRODUCED AT THE REGULAR MEETING OF MAY 119
1970 AND ADOPTED AT THE REGULAR MEETING OF MAY 2694
1970.
j� BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
V ALABAMA, as follows:
SECTION 1. That upon evidence presented to and considered by
it, the City Council does hereby make a finding and determination
of the following facts:
(a) At a regular meeting of the City Council of the City of
Fairhope, held on the 26th day of May, 1970, Improvement Ordinance
No. 439 was adopted and notice of the adoption of said Ordinance
was given by publication of said Ordinance in the Fairhope Courier,
a newspaper published in and of general circulation in the City
of Fairhope, in the issues of May 28th and June 4th, which Ordinance
stated that the City Council of the City of Fairhope would meet on
the 8th day of June, 1970 at 7:30 P.M. at the City Hall in the City
of Fairhope to hear any objections, remonstrances or protests that
might be made to said improvements or the character of the material
or materials to be used, and the M.ftnner of making the same.
(b) A copy of said Improvement Ordinance No. 439 was sent by
registered mail, postage prepaid, to each of the persons last
assessing for taxation the property proposed to be assessed for
said Improvements -at their last known addresses; said notice having
been mailed on the 28th day of May, 1970, more than ten days prior
to the 8th day of June, 1970.
(c) The protests and objections of persons owning property on
Oswalt Street from the North boundary of Nichols Street to the South
�l Boundary of White Avenue, 320 feet, more or less, namely, Otto
Randell, Tom VanIderstine and B. L. Singletary, were heard, consider-
ed, sustained and granted, and Improvement Ordinance No. 439 amended
and modified by the elimination of the Improvement on Oswalt Street
from the North boundary of Nichols Street to South boundary of White
Avenue, 320 feet more or less.
(d) The protests of Mrs.R. Hoffman and written protest of
C. Szymborski to the improvement of Kumquat Street have been heard,
considered and disallowed.
(e) No other protest, objections or remonstrances against said
improvements or the character of materials to be used and the manner
of making said improvements have been filed in writing with the
City Clerk or in her office, or have been made at this meeting.
SECTION 2. That the improvements of Oswalt Street from the north
boundary of Nichols Street to the South Boundary of White Avenue,
320 feet more or less, as described in Section (g) of Improvement
Ordinance No. 439 is hereby removed, eliminated and deleted from
Section (g) of Improvement Ordinance No. 439 and said Improvement
Ordinance No. 439 is hereby modified and amended by the removal,
elimination and deletion of that portion of Section (g) of said
Ordinance.
SECTION 3, That Section 1 of Improvement Ordinance No. 439
is amended to read as follows:

SECTION 1. That the following described streets in the City
of Fairhope, Alabama shall be improved as hereinafter provided
between the respective terminal points hereinafter set "forth:
(a) SIMON STREET: From the North edge of existing pave-
ment on Edwards Avenue to the South boundary of Central Boulevard,
585 linear feet, more or less.
(b) PATLYNN DRIVE: From the North end of existing pave-
ment which is the South boundary of Gates Fairmont Subdivision
No. 1 to the North boundary of Gates Fairmont Subdivision No. 1,
320 Linear feet, more or less.
(c) WOODLAND COURT: From the West edge of proposed pave-
ment on Patlynn Drive in Gates Fairmont Subdivision No. 1 to the
end of the cul-de-sac, 230 Linear feet, more or less.
(d) EVERGREEN STREET: From the East edge of pavement, on
North Ingleside Avenue east and nortb to the end of the cul-de-sac
in the third addition to Deep Tree Forest Subdivision, 800 linear
feet, more or less.
(e) NORTH INGLESIDE AVENUE: From the North end of existing
pavement on North Ingleside Avenue to the North boundary of the
third addition to Deep Tree Forest Subdivision, 125 linear feet,
more or less.
(f) FORSTER AVENUE: From the east edge of pavement on Sec-
tion Street, (U.S. Route 98) to the west boundary of Bon Secour
Avenue, 835 linear feet, more or less.
(g) OSWALT STREET: From the North boundary of White Avenue
to the South boundary of Fels Avenue, 600 feet, more or less.
(h) COLE COURT: From the east edge of the proposed pavement
on Oswalt Street to the east end of Cole Court, 225 tinier feet
more or less.
(i) KUMQUAT STREET: From the north edge of existing pave-
ment on Pecan Street to the South edge of existing pavement on
Pier Street, 380 linear feet, more or less.
(j) LAUREL STREET: From the Southeast edge of existing
pavement on Mobile Avenue to the Southeast boundary of Satsuma
Avenue, 490 Linear feet, more or less.
(k) MAPLE AVENUE: From the North edge of existing pavement
on Gayfer Street to the South edge of proposed pavement on Live Oak
Street 630 linear feet, more or less.
(1) LIVE OAK STREET: From the east edge of proposed pavement
on Maple Avenue to the west edge of existing pavement on Greeno Road,
320 linear feet, more or less.
(Im) MARCA LANE: From the west edge of existing pavement on
Blue Island Avenue to the end of the cul-de-sac, 475 linear feet,
more or less.
(n) MYRTLE AVENUE: From the north edge of existing pavement
on Myrtle Avenue in Park Terrace Subdivision, Unit 1, to the north
boundary of Park Terrace Subdivision, Unit 4, 750 linear feet, more
or less.
(a) HOLLEY DRIVE: From the South edge of proposed pavement
Olive Drive in Park Terrace Subdivision, Unit 4 to the west edge of
existing pavement on North Ingleside Avenue, 1,200 linear feet, more
or less.
(p) OLIVE DRIVE: From the east edge of proposed pavement on
Myrtle Avenue in Park Terrace Subdivision, Unit 4 to the west edge
of existing pavement on North Ingleside Avenue, 1,000 linear feet
more or less.

Improvements to the hereinabove described streets shall be
as follows:
Both edges of a 25 feet roadway, the centerline of which shall
be approximately in the center of the dedicated right of way shall
be curbed and guttered with Portland Cement Concrete combined curb
a*nd.-gutter 6 inches thick and 2.5 feet wide; the curb lines of said
gutters shall be connected with the curb lines of all intersecting
streets, with Portland Cement Concrete combined curb and gutter as
above described, of suitable radius and the surface between the
gutters to be constructed shall be improved by paving with Bituminus
Plant mix 1 1/2 inches thick on a 6 inch compacted sand clay founda-
tion; said improvement shall include grading and all necessary drain-
age structures, including concrete culverts, concrete pipe, valley
gutters and drop inlets; manholes of brick with cast iron covers shall
be constructed or reconstructed where needed.
SECTION 4. As hereinabove modified and amended, Improvement
Ordinance No. 4391 entitled "AN ORDINANCE TO PROVIDE FOR CERTAIN
IMPROVEMENTS ON-SIMON STREET, PAYLYNN DRIVE, WOODLAND COURT, EVER-
GREEN STREET, NORTH INGLESIDE AVENUE, FORSTER AVENUE, OSWALT STREET
COLE COURT, KUMQUAT STREET, LAUREL STREET, MAPLE AVENUE, LIVE OAK
STREET, MARCA LANE, MYRTLE AVENUE, HOLLY DRIVE" is hereby in all
things ratified and confirmed.

Motion by Councilman Box that the following Ordinance be
introduced:
ORDINANCE NO. 443
AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES OF
ZONING ORDINANCE NO. 295.
BE IT ORDAINED by the City Council of the City of Fairhope
that the following described property be rezoned from R-1 and R-2
to R-3 as recommended by the Planning and Zoning Commission.
Begin at the Northeast corner of block
5; division 1 of the Land of the Lessor
in the City of Fairhope, Alabama, as per
it's plat thereof filed for record Sep- b� T
tember 13, 1911; run north 109 feet more
or less for a POINT OF BEGINNING; then '
north 240 feet more or less, thence west
229 feet; thence south 70 feet; thence
west 10 feet more or less; thence south
70 feet; thence east 70 feet more or less;
thence south 100 feet more or less and then
east 168J feet to the POINT OF BEGINNING.
Said land being located on the west side
of Church Street as established by right-
of-way deeds to the City of Fairhope,
Frac' 1 section 18, Township 6 South; range
2. East, Baldwin County, Alabama............
Motion by Councilman Bishop, seconded by Councilman Box
that Mrs. J. E. Gaston, Sr., be reappointed to the Library Board
for a five year term ending May, 1975 motion unanimously carried.
Motion by Councilman Biship seconded by Councilman Robertson
that City Clerk be instructed to pay interest on balance of loan
at First National Bank of Fairhope as billed. Motion carried.
Motion by Councilman Bishop seconded by Councilman Robertson
that City Clerk be authorized to transfer $25,000;.`00 to General
Fund from Gas Gross Revenue Account. Motion carried.
Motion by Councilman Box seconded by Councilman Cowen that
City install 6" fire line on Gayfer Court as presented to Council.
Motion carried.
Motion by Councilman Bishop seconded by Councilman Cowen
that Street Department install sidewalk on N,rth side of Fels
Avenue from Section Street West two blocks. Motion carried.
Motion by Councilman Bishop seconded by Councilman Box
that Council accept Harbor Board's recommendation and appoint
Mr. George McKee to the Harbor Board. motion carried.
The following letter was read and made a part of the
minutes of this meeting:

Dear Isadore:
In behalf of the City of Fairhope, its Harbor Board
and myself, personally, I wish to express our ap-
preciation to you for lending your barge for con-
struction of the City's fishing docks.
Without your generous loan of your equipment the
work could never have been accomplished as cheaply
as it was.
It was a civic gesture on your part that should be
appreciated by all concerned. You have played a
considerable part in construction of a revenue pro-
ducing project for the City that means much to those
who make a livlihood from fishing.
Many thanks again for all you have done.

Motion by Councilman Robertson that the following Ordinance
be introduced:
GRADE ORDINANCE NO. 444
AN ORDINANCE FIXING AND ESTABLISHING THE GRADE OF A CERTAIN
,PORTION OF AZALEA STREET.
BE IT ORDAINED by the City Council as follows:
Section 1. That the grade of Azalea Street from the
North boundary ofFairla nd Avenue to South boundary of Dogwood 560'
be, and the some are hereby fixed and established as shown on the
plans on file and open for inspection in the office of the City
Clerk.
Section 2. That this ordinance shall be published in the
Fairhope Courier, a newspaper published and of general circulation
in the City of Fairhope, Alabama.
