COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session at the City Hall Tuesday may 269 1970 at 7:30 P.M., with
the following members present: mayor R. C. Macon,, -Councilmen:
James P. Nix, Robert H. Cowen, Henry G. Bishop, John A. Robertson
and Sam E. Box.
Minutes of previous meeting were approved.
Mr. Leslie Smith of the School Board met with Council per-
taining to utilities at new school of Fairhope Avenue.
Motion by Councilman Cowen seconded by/ Councilman Nix that
City appropriate $1,000.00 to Recreation Board to initiate new
summer recreation program for age group to 11 years. Motion
carried.
Motion by Councilman Bishop seconded by Councilman Robertson
that bill of Hurricane Fence Co., in amount of $449.96 for fencing
Young Street Pool be approved for payment. Motion carried.
Motion by Councilman Box seconded by Councilman Cowen that
City approve repairs to dog pound as submitted. Motion carried.
Motion by Councilman Bishop seconded by Councilman Robertson
that the following Resolution be- adopted:
RESOLUTION
WHEREAS, the State of Alabama, under the Omnibus Crime
Control and Safe Streets Act of 1968 (P.L.90-351) through the
Law Enforcement Planning Agency, is offering financial aid to
combate rising crime, aid in crime prevention, investigation and
detection: and
WHEREAS, the City of Fairhope is of the opinion it would
be to advantage to make application for said aid in the amount
of $7,227.74 for auto, hand radios, salary and tape recorder.
NOW THEREFORE, be it resolved by the City Council that.
R. C. Macon, Mayor, in his official capacity be authorized to
make application to the Law Enforecemtn Planning for said grant.
Adopted this the 26th day of May, 1970.
Motion by Councilman Bishop seconded by Councilman Box that
the following Ordinance be introduced:
ORDINANCE NO. 440
BE IT ORDAINED, by the City Council of the City of Fair -
hope, Alabama, that it shall be unlawful for any person to spend
the night, or to camp overnight, on the Municipal beach without
permission from the City police of the City of Fairhope, Alabama.
Councilman Robertson moved that all rules governing the
council which might, unless suspended, prevent the passage and
adoption of the Ordinance at this meeting, be and the same are
hereby suspended for the purpose of permitting the said Ordinance
to be finally passed and adopted at this meeting. Councilman Box
seconded the motion. The question was put before the Council
and on roll call the vote was as follows: Yea: Mayor Macon,
Councilmen: Nix, Cowen, Bishop, Robertson and Box. Nay: None.
Motion adopted by unanimous vote of the Council. Councilman
Cowen moved that said Ordinance No. 440 be finally passed and
adopted as introduced. Councilman Robertson seconded the motion.

The question of final passage and adoption of said Ordinance was
put to. -`vote of the Council and on roll call the results were as
follows: Yea: mayor Macon, Councilmen: Nix, Cowen, Bishop, Box
and Robertson. Nay: None. Ordinance adopted by unanimous vote
of the Council.
Motion by Councilman Nix seconded .by Councilman Box that
the following Ordinance be introduced:
ORDINANCE NO. 441
BE IT ORDAINED by the City Council of the City of Fairhope,
Alabama, that Section 4-2 of the City Code be amended to read as
follows:
Section 4-2-"It shall be unlawf4 for any person to keep
any livestock within the corporate limits of the City with-
out having a permit therefor issued by the City, or to keep
any such animals in the City after or while such permit is
suspended."
Councilman Nix moved that all rules governing the council
which might unless uuspended, prevent the passage and adoption of
the Ordinance at this meeting, be and the same are hereby sus-
pended for the purpose ofpermitting the Ordinance to be finally
passed and aopted at this meeting. Councilman Box seconded the
motion. Upon being put to vote of the Council the results ,were
as follows: Aye: Mayor Macon, Councilmen Nix, Cowen, Bishop, Box
and Robertson. Nay: None. Motion adopted by unanimous vote.
Councilman Nix moved that Said Ordinance No. 441 be finally passed
and ado-ted as intorduced. Motion seconded by Councilman Box.
Upon being put to vote of the Council, the results were as follows:
Aye: Mayor Macon, Councilmen: Nix, Box, Bishop, Robertson andCowen.
Nay: None. Ordinance finally adopted as introduced.
Motion by Councilman Robertson seconded by Councilman Cowen
that the following Resolution be adopted:
RESOLUTION
BE IT RESOLVED by the City Council of the City of Fairhope
that the parking area at Fisherman's wharf be included in current
Street Resurfacing Program. Motion carried.
Motion by Councilman Robertson seconded by Councilman Cowen
that Street Improvement Ordinance No. 439 introduced at regular
meeting of May 119 1970 be adopted as introduced. Motion carried.
Motion by Councilman Nix seconded by Councilman Cowen that
the following Resolution be adopted. Motion Carried.
RESOLUTION
The City Council of the City of Fairhope, Fairhope, Alabama,
in regular session this 26th day of May, 1970, having considered
and found acceptable the draft of proposed contract with the South-
eastern Power Administration for the purchase of electric power
from said agency of the Government hereby authorizes and directs
Marie, Moore, City Clerk, to execute said contract with Southi!r
eastern Power Administration on behalf of the City of Fairhope
and to execute such other papers and instruments with both the
Southeastern Power Administration and the Alabama Power Company
as are necessary to effectuate service pursuant to said contract
at the earliest practicable date.
Motion by Councilman Bishop seconded by Councilman Box that
City approve for payment the bill of Bradley, Arant, Rose and White.
Motion carried.
Motion by Councilman Nix seconded by Councilman Robertson that
City Superintendent be authorized to hire four high school boys for
summer months @1.25 per hour. Motion carried.

Motion by Councilman Nix seconded by Councilman Robertson that City
purchase necessary switch gear for new substation from Joslyn Mfg.
and Supply Co. Motion carried.
Motion by Councilman Robertson seconded by Councilman Cowen
that Street Department extend sidewalk on West Side of Section
Street from Morphy Avenue to the Post Office. Motion carried.
It was duly moved and seconded that the meeting adjourn.
