HomeMy WebLinkAbout05-11-1970 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular ses- sion at the City Hall, Monday, may 119 1970 at 7:30 P.M., with the following members present: Mayor R. C. Macon, Councilmen: James P. Nix, Robert H. Cowen, H. G. B-ishop, John._A.: Roberts -on and Sam E. Box. Minutes of the previous regular meeting were approved. M. C. Williams Contracting Co. mobile $9,399.00 Counts Contracting Corp. Theodore $14,913.00 Alabama Asphalt Paving Co., mobile $13,643.78 Motion by Councilman Robertson seconded by Councilman Cowen that City accept low bid of $99399.00 submitted by M. C. Williams Contracting Company, mobile, to pave Church Street and morphy Ave. and to authorize' mayor Macon to sign contract with M. C. Williams Contracting Co. Motion carried. This being date set for opening bids on Air Conditioning and heating Adult and Tourist Recreation Building on Morphu Ave., the ;following bids were received and read to the Council: Dowsey Heating and Air Cond. Payne 7,190.00 Lucassen Plumbing Co. Day and Night 7,411.00 Marshall Refrigeration Co. Bryant 5,965.00 Romac & Co. Trane 6,435.34 Motion by Councilman Nix seconded by Councilman Robertson that all bids be evaluated and report to the Council on Wednesday May 13, 1970 at 5:00 P.M., at the City Hall. Motion carried. This being date set for public hearing on rezoning Lots 13, 149, 15 and 16 of Oswalt Addition, there being no protests, Councilman Box moved that the following Ordinance be introduced: ORDINANCE NO. 438 AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES OF ZONING ORDINANCE NO. 295. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FA IRHOPE that, Section 13 be amended by rezoning the following described property from R-2 to B-2: i Lots 13, 14, 15 and 16 of the Oswalt Addition to the Town of Fairhope as per plat thereof recorded in Map Book 1, at page 42 of the records in the Office of the Judge of Probate, Baldwin County, Alabama. Councilman Box mored that all rules governing the Council which might, unless suspended, prevent the passage and adoption of this Ordinance at this meeting be and the same are hereby sus- pended for the purpose of permitting the said Ordinance to be final ly passed and adopted at this meeting. Councilman Nix seconded the motion. The question was put before the Council and on roll call the vote was j,as follows: Yea: Mayor Macon, Councilmen: Nix, Cowen, 3ishop, Robertson and Box. Nay: None. Motion adopted by unanimous vote of members present. Councilman Box moved that said Ordinance No. 438 be finally passed and adopted as introduced: Motion seconde 5y Councilman Nix. The question of final passage was put to vote of Council and on roll call the results were as follows: Yea: rlayor Macon, Councilmen: Nix, Cowen, Bishop, Robertson and Box. Nay Vone. Mayor Macon declared the Ordinance finally passed and adopted. 3. Motion by Councilman Nix seconded by Councilman Box that Ordinance No. 437, An Ordinance Amending Zoning Ordinance No. 295, introduce at the regular meeting of April 28, 1970 be adopted as introduced. Upon being put to vote the following vote was recorded: Aye: Councilman Nix, Cowen, Bishop and Box. Nay: Councilman Robertson. Motion carried. Motion by Councilman Box seconded by Councilman Nix that in addition to contract on Pier concession with W. milham an ad- ditional $68.00 per -month rental on Yardarm Restaurant be paid to the City. Upon being put to vote the following vote was re- corded: Aye: Councilmen: Nix, Cowen, Bishop and Box. Nay: Council- man Robertson. motion carried. ' motion by Councilman Box seconded by Councilman Nix that City install approximately 900 feet 6" line and two fire hydrants on Bon Secour and Grand Avenue. motion carried. Motion by Councilman Box seconded by Councilman Cowen that Superintendent be authorized to purchase 35 gal., Oderine from Certified Laboratories, Inc., at a cost of $7.90 per gallon. Motion carried. Motion by Councilman Robertson seconded by Councilman Bishop that the following Resolution be adopted: RESOLUTION BE IT RESOLVED by the Cit Council of the City of Fairhope that Street No. 6 (Frontage Road and that portion of Street No. 69 (Morphy Avenue) from Church Street to Section Street be deleted from the current Street Resurfacing Program and the following Streets or Areas added: The Circular driveway and parking area in front of Thomas Hospital and approximately 280 linear feet of Ingleside Avenue from Morphy Avenue south to the rear entrance of Thomas Hospital. motion carried. Councilman Robertson introduced the following Ordinance No. 439: STREET IMPROVEMENT ORDINANCE W AN ORDINANCE TO PROVIDE FOR CERTAIN IMPROV EMENTS ON SIMON STREET, PATLYNN DRIVE, WOODLANE COURT, EVERGREEN STREET, NORTFiq INGLESIDE AVENUE, FORSTER AVENUE, OSWALT STREET, CO=OURT, KUM- QUAT STREET, LAUREL STREET, MAPLE AVENUE, LIVE OLK._S_TREET,., MARCA LANE, MYRTLE AVENUE, HOLLY DRIVE, OLIVE DRIVE. BE IlF ORDAINED by the City Council of the City of Fairhope, Alabama as follows: SECTION 1 - That the following described streets'in the City of Fairhope, Alabama shall be improved as hereinafter pro- vided between the respective terminal points hereinafter set forth (a) SIMON STREET: From the Nor th edge of existing pave- ment on Edwards Avenue to the South boundary of Central Boulevard, 585 -linear feet, more or less. (b) PATLYNN DRIVE: From the North end of existing pave- ment which is the South boundary of Gates Fairmont Subdivision No. 1 to the North boundary of Gates Fairmont Subdivision No. 1, 329 Linear feet, more or less. (c) WOODLANE COURT: From the West edge of proposed pave- ment on Patlynn Drive in Gates FXirmonth( Subdivision No. 1 to the end of the cul-de-dac, 230 Linear feet, more or less. I a. (d) EVERGREEN STREET: From the East edge of pavement on North Ingleside Avenue east and north to the end of the cul-de-sac -in the third -addition to Deep Tree Forest Subdivision, 800 linear feet, more or less. '(e) NOR TO INGLESIDE AVENUE: From the North end of exis- tin pavement on North Inglesid4f venue to the North boundary of the thir addition to Deep Tree Forest Subdivision, 125 linear feet, more or less. (f) FORSTER AVENUE: From the east edge of pavement on Section Street, (U. S. Route 98) to the west boundary of Bon Secoul Avenue, 835 linear feet, more or less. (g) OSWALT STREET: From the North boundary of Nichols Street to the south boundary of Fels Avenue, 925 linear feet, more or less. (h) COLE COURT: From the east edge of the proposed pave- ment on Oswalt Street to the east end of Cole Court, 225 linear feet, more or less. (i) KUMQUA+ STREET: From the north edge of existing pave. ment on Pecan Street to the South edge of existing pavement on Pie: Street, 380 linear feet, more or less. (j) LAUREL STREET: From the Southeast edge of existing pavement on mobile Avenue to the southeast boundary of Satsuma (Avenue, 490 linear feet, more or less. (k) MAPLE AVENUE: From the North edge of existing pave- ment on Gayfer Street to the South edge of proposed pavement on Live Oak Street, 630 linear feet, more or less. (1) LIVE OAK STREET: From the east edge of proposed pavement on maple Avenue to the west edge of existing pavement on Greeno Roa d, 320 linear feet, more or less. (m) MARCA LANE: Fromttte west edge of existing pavement of Blue Island Avenue to the end of the cul-de-sac, 475 Linear feet, more or less. (n) MYRTLE AVENUE: From the north edge of existing pave- ment on Myrtle Avenue in Park Terrace Subdivision, Unit 1, to the north boundary of Park Terrace Subdivision, Unit 4 750--linear- feet more or less. (o) HOLLEY DRIVE: From the South edge of proposed pavement Olive Drive in Park Terrace Subdivision, Unit 4 to the west edge of existing pavement on North Ingleside Avenue, 1,200 Linear feet, more or less. (p) OLIVE(;DRIVE: From the east edge of proposed pave- ment on Myrtle Avenue in Park Terrace Subdivision, Unit 4 to the west edge of existing pavement on North Ingleai'de Avenue, 1,000 linear feet, more or less. Improvements to the hereinabove described streets shall be as follows: Both edges of a 25 feet roadway, the centerline of which shall be approximately in the center of the dedicated right of way shall be curbed and guttered with Portland Cement Concrete combine( curb and gutter 6 inches thick and 2.5 feet wide; the curb lines o1 said gutters shall be connected with the curb lines of all inter- secting streets, with Portland Cement concrete combined curb and gutter as above described, of suitable radius and the surface betw( the gutters to be constructed shall be improved by paving with Bituminous Plant Mix 1i inches thick on a 6 inch compacted sand clay foundation; said improvement shall include grading and all necessary drainage structures, including concrete culverts, con- crete pipe, valley gutters and drop inlets; manholes of brick with cast iron covers shall be constructed or reconstructed where needs( ten 4 SECTION 2 - That the full details, drawings, plans, speci• fications and surveys of the above described work and estimates 4 which have been prepared by Moore Engineering Company, who has beer duly designated and appointed City Engineer by this Council, have been fully considered and studied by this Council and hereby are adopted. Said details, drawings, plans, specifications, surveys and estimates shall be immediately placed on file in the Office of the City of Fairhope, Alabama where property owners who may be affected by such improvements may see and examine them. SECTION 3 - That the improvements hereinabove described shall be made in•accordance with the grades heretofore established by Ordinance and according to the full details, drawings, plans, specifications and surveys of said work and estimates herein adop- ted, all under the supervision of the City Engineer. SECTION 4 - That the cost of constructing said improve- ments shall be assessed against the property abutting on the por- tions of the streets so improved, provided: (a) That the cost of street improvements, including curbing and guttering on street and avenue corners shall be asessed against the lots or parcels of land abutting on or nearest to said improvements, and the cost of street improvements, including curbin and guttering at the intersection of any alley with a street, avenu or other highway shall be assessed in fair proportion against the respective lots or parcels of land abutting or cornering on the all at such intersection. (b) That no assessment shall exceed the cost of the im- rovements or the increased value of such property by reason of the pecial benefits derived from such improvements. SECTION 5 - That the City Council shall meet on the Bth ay of June, 1970 at 7:30 P.M., at the City Hall in the City of airhope, Alabama, to hear any objections, remonstrances or protest; hat may be made against said improvements, the manner of making he same or the character of materials to be used. SECTION 6 - ;This Ordinance shall be published once a week or two (2) consecutive weeks in the Fairhope Courier, a newspaper ublished and of general cwrculation in the City of Fairhope, AlabJim he date of the first publication to be not less than two (2) weeks afore the 8th day of June, 1970. SECTION 7 - A copy of this Ordinance shall be sent by Zegistered Mail, Postage prepaid, to the persons last assessing 'or City taxation the property which may be assessed for said im- 3rovements, at their last known addresses, said notices to be so nailed by the City Clerk not less than ten (10) days prior to the 8- Jay of June, 1970.
