COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
session on Tuesday, April 28, 1970 at 7:30 P.M., at the City Hall
with the following members present: mayor R. C. Macon, Council-
men James P. Nix, Robert H. Cowen, H. G. Bishop, John A. Robertson
and Sam E. Box.
Minutes of the previous regular meeting were approved.
Motion by Councilman Nix seconded by Councilman Bishop
that Jack Kirk, Henry Creamer, Councilman Box, Councilman Cowen
and H. Ruge draw up specifications for front end loader as soon
as possible and ask for bids. Bids to be opened Friday, May 1,
1970 at 5:30 P.M., at the City Hall. Motion carried: -
Representatives of Alabama Power Company met with Council
pertaining to rezoning their property From R-1 to M-1. Council-
man Nix moved'that the following ordinance be introduced provided
beautification improvements are made including ornamental planting
and redwood slats in the cyclone fence as recommended by the
Planning and Zoning Commission. Motion seconded by Councilman
Bishop.
ORDINAINCE NO. 437
AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES OF
ZONING ORDINANCE NO. 295.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE
that ,
SECTION 13 be amended by rezoning the following described
property from R-1 to M-1:
A parcel of land located in the northwest
quarter of the northeast quarter (NWj of
NEa) of Section 29, Township 6 South, Range
2 East Baldwin County, Alabama, described
as follows: Commence at the NW corner of the
NWf of NEf of Section 29, Township 6 South
Range 2 East and run south along said quarter
quarter section line a distance of 30 feet,
to the south boundary line of Twin Beach
Avenue for the POINT OF BEGINNING, from such
point of beginning run easterly ilong the
south boundary line of Twin Beach Avenue
a distance of 250 feet; then turn an angle
to the right of 90 degrees and run southerly
a distance of 400 feet; then turn an angle
to the right of 90 degrees and run westerly
a distance of 250 feet; then turn an angle
it 2 .

Councilman Nix moved that all rules governing the council which
might, unless suspended, prevent the passage and adoption of this
Ordinance at this meeting, be and the same are hereby suspended
for the purpose of permitting the said Ordinance to be finally
passed and adopted at this meeting. Councilman Box seconded
the motion. The question was put before the council and on roll
call the vote was as follows: Yea: mayor Macon, Councilman Nix,
Cowen, Bishop and Box. Nay: Councilman Robertson. Motion
defeated to waive; rules and pass ordinance at this meeting of thi
Council.
Eastern Shore Jaycees made the following requests in
regards to the 4th of July Celebration:
1. Permission to use Beach area.
2. City again sponser fireworks.
3. That Jaycees have exclusive concession rights in the
area with the exception of regular businesses in the
area.
Motion by Councilman Bishop seconded by Councilman Cowen
that the City accept proposal of the Jaycees. Motion carried.
Action withheld on transfer of business license at the
Florida Recreation Center oO North Section Street.
Motion by Councilman Box seconded by Councilman Nix that
City ask for bids on central unit for air conditioning and heating
Recreation Building on Morphy Avenue. Bids to be opened at regular
meeting of the City Council on May 11, 1970 at 7:30 P.M., Motion
carried.
Motion by Councilman Box seconded by Councilman Nix that
Mr. Wallace Milham be authorized to enclose a portion of Pier
under roof line on East side of present building at no cost to the
City. Motion carried.
Motion by Councilman Box seconded by Councilman Robertson
that Ordinance No. 434 Authorizing Mayor and Clerk to sign contract
with Fairhope Building Corporation and introducedt-.at the regular
meeting of April 13, be adopted as introduced. Upon being put
to vote the following vote was recorded: Aye: mayor Macon, Council
man Cowen, Robertson and Box. Nay: Councilman Nix, Councilman
l Bishop abstained from voting. Motion carried.
Motion by Councilman Cowen seconded by Councilman Bishop
that when and if needed, the City use base from Inddistrial Site.
Motion carried.
Motion by Councilman Nix seconded by Councilman Cowen that
(since the City is using the Armory for Civic events and emergen-
cies that City furnish electricity only at Armory. Motion carried
Upon motion, seconded and carried, meeting adjourned.

THIS INDENTURE, made and entered into on this the
day of March, 1970, by and between BALDWIN COUNTY BOARD OF EDUCA
a Public Corporation, hereinafter referred to as the party of the
first part, and CITY OF FAIRHOPE, ALABAMA, a Municipal Corporatio
hereinafter referred to as the party of the second part,
W I T N E S S E T H:
The party of the first part, forand in consideration o
the sum of One Dollar ($1.00) and other good and valuable consid-
eration to it this day paid by the party of the second part, re-
ceipt whereof is hereby acknowledged, has and by these presents
does hereby GRANT, BARGAIN, SELL AND CONVEY unto the said party
of the second part, the following described real property situates
in Baldwin County, Alabama, to -wit:
Commencing at the Southeast corner of Section 18, Town-
ship 6 South, Range 2 Fast, run North 1159.5 feet to a
point; thence run West 363 feet for a point of beginning;
thence run North 136.5 feet to a point on the South side
of Morphy Avenue; thence run West along the South side
of Morphy Avenue 66 feet to a point; thence run South
136.5 feet to a point; thence run East 66 feet to the
point of beginning, being Lot 6 of the D. S. Brown
Addition to the Town of Fairhope, according to an un-
recorded map or plat thereof; and also the heaters and
fan in the building on the above described land;
Commencing at the Southeast corner of Section 18, Town-
ship 6 South, Range 2 East, and run North 1296 feet to
a point; thence run West 429 feet to a point on the South
side of Morphy Avenue for a point of beginning; thence
run South 136.5 feet to a point; thence run West 132 feet
to a point on the East side of Church Street; thence run
North along the East side of Church Street 136.5 feet
to a point; thence run East along the South side of
Morphy Avenue 132 feet to the point of beginning, beinngg
Lots 7 and 8 of the D. S. Brown Addition to the Town of
Fairhope, according to an unrecorded plat thereof, also
all furniture in said building;
TO HAVE AND TO HOLD unto the said party of the second
part, its successors and assigns, forever.
The execution and delivery of this conveyance was
authorized by a resolution adopted by the Baldwin County Board of
Education at its meeting held on February 25, 1970.
IN WITNESS WHEREOF, the party of the first part has
caused its corporate seal to be hereto affixed and this instrument
to be executed by E. Davidson, as its Chairman, and attested by
W. C. McGowan, as its Secretary and as Baldwin County Superintendent
of Education, on this the day and year first above written.
