OUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular
ession at the City Hall, (Monday April la, 1970 at 7:3U P.M.,
ith the following members present: mayor R. C. (Macon, Councilmen
ames P. Nix, Robert H. Cowen, H. G. Bishop, John A. Robertson
nd Sam E. Box.
Motion by Councilman Robertson saconded by Councilman
ox that minutes of previous regular meeting be corrected to
read as follows:

ORDINANCE OF THE CITY OF FAIRHOPE
BE IT ORDAINED BY THE CITY COUNCIL OF' THE CITY OF FAIRHOPE,
THAT, WHEREAS, the following described leasehold and im-
)rovements thereon are not needed for public or municipal purposes,
:o wit:
The South 6 feet of Lot 1, except the West lU
feet thereof; all of Lot 2, except the West lU
feet thereof; all of lot 11, except the South
7 feet of the East Y9 feet thereof; and the
South 6 feet of the West 18 feet of Lot 12; all
in Block 5 of Division 4 of the Lands of the
Fairhope Single Tax Corporation, according to
plat thereof of the Fairhope Single Tax Cor-
poration, dated August 4, 1911, filed for record
ly1S, and recorded in (Miscellaneous Book 1, at
Pages 31U-;321, Probate Records, Baldwin County,
Alabama.
which is the property adjoining the North of the present City Hall;
and,
That the CITY OF FAIRHOPE be authorized to enter into a
contract with the FAIRHOPE BUILDING CORPORATION, as shown by copy
thereof, attached hereto, and the (Mayor and Clerk be authorized to
execute said contract and conveyance for and on behalf of the CITY
OF FAIRHOPE, and to do any and all things and execute such docu-
nents as may be necessary or required to accomplish the transfer
3f said properties and the purchase of the First National Bank of
7airhope Building in accordance with the terms of the said agree-
nent.

AN ORDINANCE AMENDING SECTION 13, DISTRICT BOUNDARIES
I OF ZONING ORD1 NA,NCE NO.295 .
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE
that Section 1:3, be amended by rezoning the following described
1property From R-2 to B-1: SITUATED IN BALDWIN COUNTY, ALABAMA TO-W".
Begin at a stake Three Hundred and Thirty -Two feet
North of the Southeast corner of Fractional Section
Seventeen, Township Six South; Range Two East, thence
North Three Hundred and Twenty Three Feet to a stake;
thence West Four Hundred and Forty feet to a stake; 0 mod,
thence South Three Hundred and Twenty Six feet to a a
stake; thence East Four Hundred and Forty feet to the
place of beginning, containing three and ;51/.LUOth Acres,
located on Greeno Blvd., North of Nichols Avenue.

Councilman Nix moved that all rules governing the Council
which might, unless suspended, prevent the passage and adoption or'
this Ordinance at this meeting, be and the same are hereby suspen-
ded for the purpose of premitting said Ordinance to be finally
passed and adopted at this meeting. Councilman Box xeconded the
motion. The question was put before the Council and on roll call
the vote was as follows: Yea: Mayor Macon, Councilmen: Nix, Cowen,
Bixhop, Robertson and Box. Nays: None. motion adopted by unani-
mous vote of members present. Councilman Robertson moved that saic

man Box seconded the motion. The Mayor put the question of final
passage and adoption of said Ordinance to vote of the Council and
on roll call the results were as follows: Yeas: Mayor Macon,
Councilmen Nix, Cowen, Bishop, Robertson and Box. Nays: None. Or-

This being date set for public hearing on rezoning from R-1
:o M-1, Alabama Power Company property on Southeast Corner of Youn
itreet and Twin Beach Road the following protests were heard:
Eugene Cower: Already have one sub -station and
another would deteriorate property in area.
Gene Smith: Lighting bad with one transformer,
additional transformers would make it worse be-
sides being unsightly.
Prince Powe: Objects to another sub -station in
the area, too close to playground, deteriorate
property as well as being unsightly.
after hearing protests on rezoning, action was postponeo.
(Motion by Councilman Robertson seconded by Councilman Box

the Town of Fairhope, Alabama, per a re -Sub-
division map thereof' filed for record Oct. 5,
1949 and recorded in Flap Book 3, page 112,
Probate Records, Baldwin County, Alabama;
subject to a 10 foot wide N-S drainage ease-
ment running the length of said Lot, Section .
17, Township 6 South, Range 2 East, Baldwin
County, Alabama::.,
Councilman Robertson moved that all rules governing the

Motion by Councilman Cowen seconded by Councilman Nix that
City Clerk be authorized to advertise for public hearing on may
11, 19l0 at '/::5U P.M., at City Hall on rezoning lots 15,14,15, and
16, of the Oswalt Addition to the City of Fairhope from R-2 to B-2
Motion carried.
Motion by Councilman Robertson seconded by Councilman Bisho
that Claude Arnold, Engineer, be authorized to advertise for bids
on paving Church Street. Bids to be opened on may 11, 1970 at 7:3
P.M., at City Hall. motion carried.
The following letter was read to the meeting and made a par
of the minutes:
To the Honorable mayor
And City Council of the
City of Fairhope, Alabama
Gentlemen:
For the safety and help in our community, it will
be deeply appreciated if you would consider these
matters.
(1) We would like to have street lights on Young
Street, from the service station to the playground,
because, one cannot see the children coming from
all directions until you are right up on them. This
is inda ngering the lives of the children aind the peo-
ple in bis area.
(2) We would like to have the streets within this
jurisdiction repaired and have corners and sidewalks
repaired also, because in this community, it is un-
safe for the people to travel to and from work.
(3) The people in this community would like to have
the junk and trash, which include such heavy articles
as, old stoves, refrigerators, cars, and just litter
period, removed from this vicinity, because, these
things make it unsanitary and dangerous for the people
of this area.
Your prompt action and help is urgently requested and
will be deeply appreciated, in these matters.

As property in aforementioned letter is outside City LimitE
:ouncil referred letter to Baldwin County Commission.

Motion by Councilman Cowen seconded by Councilman Robertso
that request of Mrs. Irene Waldo to rezone lots 16,17,18,19, Block
2, Central Park 'Subdivision from R-2 to R-3 be denied as recommend
by the Planning and Zoning Commission. Motion carried.
Motion by Councilman Bishop seconded by Councilman Cowen
that $10,000.00 be transferred from Gas Gross Revenue Account to
General Fund. Motion carried.
Motion by Councilman Bishop seconded by Councilman Nix that
bills be approved for payment. Motion carried.
Motion by Councilman Robertson seconded by Councilman Nix
that City Superintendent be authorized to purchase decals for all
City vehicles. Motion carried.
It was duly moved and seconded that the meeting adjourn.
