COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular ses-
sion at the City Hall, Monday, Larch 99 1970 at 7:30 P.M., with
the following members present: Mayor R. C. Macon, Councilmen:
James P. Nix, Henry G. Bishop, John A. Robertson and Sam E. Box.
Councilman Robert H. Cowen being absent.
Minutes of the previous regular meeting were approved.
Mrs. Florence Thames met with Council pertaining to drainage
Ion Satsuma and Pier Street.
Motion by Councilman Bishop seconded by Councilman Box that
Ordinance No. 430, An Ordinance To Regulate The Use Of The Fair -
hope Municipal Fishing Wharf And Related Matters Thereto, introduce
at the regular meeting of February 24, 1970 be adopted as intro-
duced. Motion carried.
Motion by Councilman Box seconded by Councilman Robertson
that Ordinance No. 431, An Ordinance Amending Section 139 District
Boundaries of Zoning Ordinance No. 295, introduced at the regular
meeting of February 249 1970 be adopted as introduced. Motion
carried.
Motion by Councilman Box seconded by Councilman Robertson
that the City accept contract as presented, with Moore Engineering
(Company for Sewer construction. Upon being put to vote the fol-
lowing vote was recorded: Voting for: Councilman: Box, Bishop,

Nix and Robertson. Voting against: at this time, Mayor Macon
Land Councilman Cowen being absent. Motion carried.
Motion`by Councilman Box seconded by Councilman Nix that
City repass Resolution adopted March 199 1968 as follows:
WHEREAS, The City of Fairhope, Alabama herein called -the
"Applicant", after thorough consideration of the various aspects
of the problem and study of available data, has hereby determined
that the construction of certain works required for the treatment
of sewage is desirable and in the public interest and to that end

it is necessary that action preliminary to the construction of
sewage treatment works be taken immediately; and
WHEREAS, under Section 466e, Title 33, of the United States
Code , the United States of America has authorized the making of
grants to aid in financing the cost of construction of necessary
treatment works to prevent the discharge of untreated or inadequa-
tely treated sewage or other waste into any waters;
NO THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FAT'RHOPE, ALABAMA the governing body of said Applicant,
as follows:
1. That R. C. Macon, mayor be hereby authorized to file in
behalf of the Applicant an application (in the form required by the
United States and in conformity with 33 U.S.C. 466e) for a grant
to be made by the United States to the applicant to aid in de-
fraying the cost of construction of the sewage treatment works;
2. That R. C. Macon, mayor is hereby designated as the
authorized representative of the Applicant for the purpose of
furnishing to the United States such information, data, and docu-
ments pertaining to the application for a grant as may be required
and otherwise to act as the authorized representative of the Ap-
plicant in connection with this application;
3. That certified copies of this resolution be included
as part of the application to be submitted to the United States
for a grant.

The following bids were submitted on pick-up trucks

Motion by Councilman Bishop seconded by Councilman Nix that)
the City accept low bid of Gaston Motor Co., in amount of $19893.01
subject to satisfaction of City Superintendent as to specificati
Motion carried.
Three bids on police car were presented, opened and no
action taken.
Motion by Councilman Bishop seconded by Councilman Nix that
the City ask for bids on three Police cars with trade in on three
old police cars, bids to be opened at 5s00 P.M., Tuesday, March
10, 1970 at the City Hall. Upon being put to vote the following
vote was recorded: Voting for: Councilmen: Nix, Bishop and Box.
Voting against: Councilman Robertson, Councilman Cowen being absenf.
Motion carried.
Motion by Councilman Bishop seconded by Councilman Robertso
that Dr. R. H. Johnson be reappointed to the Recreation Board for
la period of five years, ending March, 1975. Motion carried unani-
mously. 1
Motion by Councilman Bishop seconded by Councilman Bog that
Councilman James P. Nix be appointed to the Airport Board for a
two year term ending February 14, 1972. Motion carried.
Motion by Councilman Robertson seconded by Councilman Nix
that City advertise for public hearing in conjunction with the
regular council-+imeeting of April 13, 1970 at 700 P.M., at the
City Hall for rezoning the following described property from R-2
to B-1:
Begin at stake Three Hundred and Thirty-
two feet North of the Southeast corner of
Fractional Section Seventeen, Township 6
S; R 2 E., thence North Three Hundred and
Twenty Three feet to a stake, thence West
Four Hundred and Forty feet to a stake;
thence South Three Hundred and Twenty Six
feet to a stake; thence East Four Hundred
and Forty feet to the place of beginning.
Contains 3 and 31/100th Acres, located on
Greeno Blvd., North of Nichols Avenue.
Motion carried.

Motion by Councilman Robertson seconded by Councilman
Nix that City advertise for public hearing in conjunction with the
regular council meeting of April 13, 1970 at 7:30 A.M., at the
City Hall for rezoning the following described property from R-2
to B-1:
Lots 7 and 8, Block 1, Hoyle Worcester
Addition to Fairhope, map Book 1, p.l.
Motion carried.
Motion by Councilman Nix seconded by Councilman Box that
City advertise for public hearing in conjunction with the regular
council meeting of April 139 1970 at 7:30 1P.m-, at the City Hall
for rezon,ng the following described property from R-1 to M-1.
A parcel of land located in the north-
west quarter of northeast quarter (NWf
of NE*) of Section 29, TS 6 S;R 2 East,
Baldwin County, Alabama, described as
follows: Commence at the northwest cor-
ner of the northwest quarter of North-
east quarter of Section 299 TS 6 South;
Rnage 2 East and run south along said
quarter quarter section line a distrance
of 30 feet to the south boundary line
of Twin Beach Avenue for the point of
beginning, from such point of beginning
run easterly along the south boundary
line of Twin Beach Avenue a distiance
of 250 feet; then turn an angle to the
right of 90 degrees and run southerly
a distance of 400 feet; then turn an
angle to the right of 90 degrees and
run westerly a distance of 250 feet;
then turn an angle to the right of 90
degrees and run northerly along the
west line of said quarter quarter sec-
tion line a distance of 400 feet to
the point of beginning.
Motion carried.
Motion by Councilman Box seconded by Councilman Nix
that mayor Macon be authorized to sign lease agreement with E. A.
Wallace at Fishing Dock as presented to Council. Motion carried.
Motion by Councilman Box seconded by Councilman Robertsor
that Mayor Macon be instructed to purchase Bank building for City
Hall as per agreement with Fairhope Building Corporation. Upon
being put to vote the following was recorded: Voting for: Mayor
Macon, Councilmen Robertson and Box. Voting Against: Councilman
Nix. Councilman Bishop abstained from voting, councilman Bowen
absent. Motion carried.

Motion by Councilman Bishop seconded by Councilman Box that
bills'be approved for payment as presented. motion carried.
Motion by Councilman Box seconded by Councilman Robertson
that on Sewer Project, Contract 3970 be specifically designated
to be the contract under which Moore Engineering Company is to
receive monthly payment under his contract dated March 9, 1970.
Payments to be§in on April 19 1970, pationi�earried.
Motion by Councilman Box seconded by Councilman Nix that
Moore Engineering Eompany be instructed to proceed with the design
of a mechanical treatment plant in the location of the existing
plant. Motion carried.
Motion by Councilman Bishop seconded by Councilman Box that
City Clerk be authorized to transfer $10,000.00 from Gas Gross
Revenue Account to the General Fund. Motion carried.
Mayor Macon read the following letter to the Council and on
motion by Councilman Robertson seconded by Councilman Bishop and
carried, Was made a part of the minutes of this meeting.

Gentlemen:
This letter is in deep appreciation of your
wonderful police department.
My husband and I moved down here in August to
look after my father, J. C. Abbott, and have never
before needed a policeman in any capacity.
First, on December 21, my son had an accident.
I do not even know the young policeman's name, but
he was the most courteous, helpful and kind man, and
I would like to thank him again and again for the
courtesies extended to us.
Then on February 10, my father had a stroke
caused from an arteriosclerotic heart. Your police
department was called and within breathless minutes
your emergency car was down there, and I actually
give the two young men credit for helping save my
father's life. I do thoroughly appreciate their
quickness of action, and kindness. Too, I know
their names. They were Mr. Yohn and Mr.3w�
Please convey to the above three men our deepest
gratitude, and know that all the people in this lovely
city should be equally grateful and proud.

Motion by Councilman Nix seconded by Councilman Box that
meeting adjourn in unadjourned session to meet on Tuesday, march
109 1970 at the City Hall at 5:00 P.m., motion carried.
