HomeMy WebLinkAbout10-23-1967 Regular MeetingSTATE OF ALABAMA COUNTY OF BALDWI N The City Council of the City of Fairhope met in regular session at the City Hall, Monday, October 23, 1967 at 7s30 p.m., with the following members presents mayor Macon, Councilmens Spader, Rey- nolds, Stipes, Gaston and Stine. Minutes of the previous regular meeting were approved. City Superintendent was authorized to advertise for bids on Loader. bids to be opened at the next regiar meeting of the City Council of November 13, 1967. Motion by Councilman Stipes seconded by Councilman Stine that the City Attorney be authorized to prepare necessary deeds for 4 lane Highway. Motion carried. Motion by Councilman Stipes seconded by Councilman Reynolds that plans for repairing alley behind Fairhope Laundry to Bancroft Street be presented to the Fairhope Single Tax Corporation for their approval. Motion carried.' Mayor Macon, Councilman Spader and City Engineer Moore were appoi ted to check on extending water line on Highway 98 and report at next meding of Council. This being date set for opening bids on load of gas pipe, the fol- lowing bids were receiveds B & B Industrial May Supply Co. L.-B. Foster Co. Consolidated Pipe Supply Co. and Supply All bids carry a 2% discount, ten days: $5,586.20 5,047.50 4,672.00 4,707,50 Motion by Councilman Reynolds seconded by Councilman Stine that City accept low bid of L.B. Foster Co., if pipe meets City's -xn- specifications.' Motion carried. RESOLUTION WHEREAS, Cities and towns in Alabama have since 1901 been re- stricted tin their borrowing power by an obsolete and unrealistic constitutional debt limit adopted in another era; and WHEREAS, the debt limit was further restricted this year by court ruling reducing assessments of utility property by one-fourt i, and legislative action reducing the maximum assessment of all pro- perty from 60 per cent to 30 per cent; and WHEREAS, municipal borrowing power is presently based on fra- ctional property assessments that are not representative of the ab'1 of cities and towns to repay their obligations; and WHEREAS,, ever-increasing demands for municipal services have resulted in backlogs of public improvement projects because cities a towns were unable to secure proper financing; and WHEREAS, a solution to the long-standing problem is provided in Proposed Amendment No. 3 appreeing on the constitutional referen- dum ballot of December 5; and WHEREAS,.Proposed Amendment No: 3 will incfease municipal bor- rowing power, lower bond interest rates and provide citizens with an added check on local government; NOW THEREFORE, be it resolved by the City Council of the City of Fairhope, Alabama, that the voters of Fairhope are urged to ra- tify Amendment No. 3 on December 5 to provide cities and towns of Alabama with a realistic and economical menas of furnishing the services asked by their citizens. Motion by Councilman Reynolds, seconded by Councilman Spader that the mayor be authorized to sign Lease Agreement with Alabama Air - Craft, Inc., as recommended by the Airport Board. motion carried. Motion by Councilman Stipes seconded by Councilman Reynolds that t bill of Moore Engineering Co., for services in connection with fou Lane Highway Design of Section Street and Fairhope Avenue in the amount of $10,250.00 be -approved for payment. The Second Party aqrees that there shall he no discrip;- irat-ion as to the use of the dockin7 facilities and that the Second Party exempts the City from arty and all liability from any negligence actions that may arise through the use of the said facilities and agrees to see that order is maintained on the premises at all times. This Agreement shall hecome effective upon the passing of the appropriate Resolution by the City Council of Fairhope and the execution of this Anreemont by the ',,'ayor and attested by the City Clerk and shall run contiriuously from the date of it's exe- cution until notification by either Party at least thirty (30) days in writing to the other of it's termination.
