COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
at the City Hall Monday, February 13, 1967 with the following me
bers present: mayor Macon, Councilmen: Spader, Stipes, Reynolds
and Stine. Councilman Gaston being absent.
The minutes of the previous regular meeting were corrected to rea
as follows:
The request of Mrs. Ulm. Hinz for reimbursement for
damages on gas line was read and discussed. Motion
by Councilman Reynolds seconded by Councilman Stine
that the City Attorney be instructed to write a let-
ter to Mrs. Hinz stating that the City is not liable
based on report of Jack Kirk' City Su erintendent
and the Ci v Enoineer. Motion carried.
Mr. Shull, Chairman of the Recreation Board, requested the City t
request tax exemption on Stimpson Field and that the Colony pass
the saving on to the Recreation Board in reduction of Colony rent
on this property. Motion by Councilman Reynolds seconded by Count
man Spader that the City etition the Fairhope Sin le Tax Cor-
poration as requested by the Recrea ion Board. Mo ion carried.
Motion by Councilman Stipes seconded by Councilman Reynolds that
the minutes be approved as corrected. Motion carried.
Mr. Hinz met with the Council pertaining to claim of Mrs. Ulm.
Hinz for reimbursement for damages on gas line. Held for further
study.
Representatives of Loyal American Life Ins., Co., requested per-
mission to solicit City employees for life insurance on Pay Roll
deduction plan. Permission granted.
Motion by Councilman Reynolds seconded by Councilman Stine that
Ordinance #373, vacation of alley, introduced at the regular
meeting of January 23, 1967 be adopted as introduced. Motion
carried unanimously.
Motion by Councilman Stipes seconded by Councilman Spader that
the application of Ulm. McKinley for retail beer permit at Small
Paradise be denied upon the recommendation of Chief of Police.
Motion carried.
Motion by Councilman Stine seconded by Councilman Reynolds that
the Mayor be authorized to sign right-of-way deed as presented an
accept right-of-way deed from Chester Billie and Gaynelle Billie
in order to clear up street right-of-way. Motion carried.
Motion by Councilman Stipes seconded by Councilman Spader that
the City Superintendent be be authorized to purchase load of gas
pipe at a cost of approximately $3,000.00. Motion carried.
Motion by Councilman Stine seconded by Councilman Reynolds that
the following Ordinance be introduced.

An Ordinance Amending Section 13 of Zoning Ordinance #295.

Be It Orddned by the City Council of The City of Fairhope, Alabama'
that Section 139 District Boundaries of Zoning Ordinance #295 be
amended as recommended by the Planning and Zoning Commission by re-
zoning the following described property from R-2 to M-1: .
Front Lot: The East 140 feet of the
West 511.64 feet of the South 150 feet
of land East of Brown Street and North
of Fairhope Avenue, Div. 49 of the land
of Fairhope Single Tax Corporation.
Back Lot: East 210.88 feet of the West
510.88 feet of the North 150 feet of
land East of Brown Street between
Stimpson Street, if extended, and Fair -
hope Ave., Div. 4 of the land of Fair -
hope Single.Tax Corporation.
Land located at 563-565 Fairhope Ave.,
adjoining the West line of the Foster
McCoy home location.
Motion by Councilman Stine seconded by Councilman Reynolds that
City deny request of Material Sales Co., to take part in removing
dirt from their premises as presented. Motion carried.
Motion by Councilman Stine seconded by Councilman Stipes that the
following Resolution be adopted. Motion carried.
RESOLUTION
,WHEREAS, the United States Corps of Engineers by and thru Bender
Welding and Machine Company contracted to clear or dredge the chap.
in Mobile Bay into Fly Creed, and,
WHEREAS, upon completionr0f9dredging operation, Bender Welding and
Machine Company, their -Agents, servants or employees left debris
or obsolete equipment in the harbor of the Fairhope Yacht Club
that has damaged bulkheads therein, and,
WHEREAS, notice has been duly given to Bender Welding and Machine
Company and no action has been taken by it,
NOW THEREFORE, BE IT RESOLVED that the Mayor and City Council
authorize, empower and direct the Fairhope Harbor Board to take
whatever action is necessary to see that this situation be brought
to the attention of the U. S. Corps of Engineers and other parties
concerned.
Motion by Councilman Stine seconded by Councilman Stipes that the
City Attorney be authorized and directed to proceed with condem-
nation proceedings on the Fairhope Casino building and on the Fair
hope Single Tax Corporation_ land on which the Casion stands.
Motion carried.
Motion by Councilman Stipes seconded by Councilman Spader that then
City appropriate $450.00 to send three firemen to Fire School
at the University.of Alabama from April 16 to 21. _Motion carried.
Motion by Councilman Reynolds seconded by Councilman Stipes that
the meeting adjourn. Motion carri d. _,
