HomeMy WebLinkAbout06-28-1965 Regular Meeting_W111'V4M)W: 1j"sue' 111 COUNTY OF BALDWIN The City Council of the City of Fairhope met in regular session at the City Hall, Monday, June 28, 1965 at 7:30 P. M. with the following members present: Mayor Maoon, Councilmen: Spader, Reynolds, Stipes and Gaston. Councilman Stine arrived at 8:20 P. M. The minutes of the previous regular meeting were approved. Motion by Councilman Gaston seconded by Councilman Reynolds that George Dyson be authorized to repair Pecan Street wharf at an approximate cost of 6150.00. Motion carried unanimously. Motion by Councilman Reynolds seconded by Councilman Gaston that City place ad in Gulf States. Motion carried unanimously. Motion by Councilman Stipes seconded by Councilman Spader that Dr. H. C. Mullins and C. B. NJmeyer be reappointed to the Airport Board for a two year term. Motion carried unanimously. The Mayor appointed Mr. Ben Barnhill to the Planning and Zoning Commission for a period of six (6) years. Motion by Councilman Stipes seconded by Councilman Stine that Ordinance ## 338 be amended and introduced as follows: ORDINANCE # 338 �\ AN ORDINANCE AMENDING ZONING ORDINANCE ## 295 3 Aek BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIOPE, ALABAMA that Section 13, District Boundaries of Zoning Ordinance # 295 be amended as recommended by the Planning and Zoning Commission by rezoning the following described property from R-2 to B-1 provided however that no construction will begin until approval has been obtained from the Planning Board ast°the type and location of the structure. Lots 14-15-16 of Block 4 of Airey Heights according to replat thereof in Map Book 19 Page 3889 Probate Court, Baldwin County, Ala- bama, Councilman Reynolds moved that all rules governing the Council which might, unless suspended, prevent tyh passage and adoption of the Ordinance at this meeting, be and the same are hereby suspended for the purpose of permitting the said Ordinance to be finally passed and adopted at this meeting. Councilman Gaston seconded the motion. Upon being put to vote the following vote was recorded: Yea: Councilmen Spader, Reynolds, Stipes, Stine and Gaston. Nay: None, The Mayor declared the motion adopted by unanimous vote. Councilman Reynolds moved that said Ordinance # 338 be finally passed and adopted as introduced. Councilman Gaston seconded this motion. The Mayor then put the question of final passage and adoption of the said Ordinance to vote of the Council with the following results: Yea: Councilmen Spader, Reynolds, Stipes, Stine and Gaston. Nay: None. The Mayor declared the Ordinance finally passed and adopted. Councilman Gaston introduced the following Ordinance which was seconded by Councilman Stine and read to the Council: ORDINANCE NO. 339 It shall be unlawful for any person to jump or dive from the Fairhope Municipal Pier located at the foot or Western terminus of Fairhope Avenue at any time whatsoever. Any person found to be in violation of this Ordinance shall be punished by a fine of not more than ONE HUNDRED DOLLARS ($100.00) or by imprisonment or hard labor for not more than six (6) months, or by both such fine and imprison- 54, -2- ment, at the discretion of the Court. Upon being put to vote the following vote was recorded: Yea: Councilmen Spader, Reynolds, Stipes, Stine and Gaston. Nay: None. The Mayor then declared the Ordinance finally passed and adopted by unanimous vote of the Council. Motion by Councilman Spader seconded by Councilman Reynolds that the following Resolution be adopted: Motion carried unanimously. RESOLUTION BE IT RESOLVED by the City Council of the City of Fairhope, Alabama, that it shall enter into an agreement with the West Baldwin County Water Autho3]ty to furnish it water at the rate of twenty-five cents (-25) per thousand gallons based on.present needs and costs of the City of Fairhope to meet the needs of said West -Baldwin County Water Authority and the construction of separate rural water, system adjacent to the City of Fairhope city limits. BE IT FURTHER RESOLVED that the City of Fairhope negotiate with the West Baldwin County Water Authority such matters as main- tenance, sliding water scales, bookkeeping, meter reading, future acquisition by the City of Fairhope of assets of West Baldwin County Water Authority, etc., and the City Attorney is authorized to prepare such rough drafts as may be necessary to submit to the City Council of the City of Fairhope for its consideration. DONE this 12' day of � 24,� , 1965- Mayor Attest: ity Clerk Motion by Councilman Stipes seconded by Councilman Stine that the City of Fairhope purchase the Fairhope Casino from Dr. George Mitchell in the amount of $239000.00 with the provisions that Dr. Mitchell can provide the City with a clear bill of sale to the Fairhope Casino and personal property located therein and that the Fairbpe Single Tax Corporation provide the City of Fairhope with a clear deed to that parcel of land on which the Fairhope Casino is located. It is further stipulated that the possession will be turned over to the City upon delivery of the Bill of Sale from the Leasehold owner and upon the delivery of Warranty Deed from the Fairhope Single,Tax Corporation in order that the.City may commence destruction and removal of the structure presently located on the site for the overall improvement of the beach area: Motion carried unanimously.
