COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session
at the City Hall, Wednesday, April 28, 1965 at 7:30 P. M. with
the following members present: Mayor Macon, Counoilmen Reynolds,
Stipes, Spader, Gaston. Councilman Stine arriving at 8:00 P. M.
Minutes of previous regular meeting were approved.
Mr. Dyson and Moore Engineers reported on Frank Manoi drainage
problem on his property on Ingleside. Motion by Counoilman
Spader seoonded by Councilman Stipes that the City reject the
request of Frank Manoi to correct pre-existing drainage problem
on his property. Motion carried.
City Attorney reported that the request of A. Co Levi to vaoate
Satsuma Street should be presented to the City in proper manner
for their oonsideration.
Motion by Counoilman Stine seoonded by Counoilman Reynolds that
the following Resolution be adopted. Motion carried.

R E S O L U T I O N
WHEREAS, there exists a discrepancy in the location of Chu
Street at its Southern extension from the intersection with Fig
(Street in the City of Fairhope, Alabama, and
WHEREAS, it is in the best interest of the City of Fairhope
that this discrepancy be resolved for street maintenance purposes,
and,
WHEREAS, according to a plat and survey by B. F. BATES undez
date of February 25, 1911, recorded in Miscellaneous Book 1 at Pa
296, the said Church Street was then designated as Second Avenue
and extended to the approximate center of Big Head Gully, and
WHEREAS, by Council action on the 8th day of December,.1913,
the City of Fairhope accepted and approved a re -plat of Magnolia
Beach, Fairhope, Alabama, as recorded in Miscellaneous Book 1, PagE
331, which, through error, failed to extend Second Avenue southern
to the center of Big Head Gully and also the center of Section 19,
Township 6 South, Range 2 East, and
WHEREAS, for many years the City of Fairhope has considered
Church Street to extend southerly to the approximate center of Big
Head Gully,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Fairhope that in order to correct errors made in the past
in platting Church Street that the following described property be
considered to be the South extension of Church Street:
Lying and being in Baldwin County, Alabama: Begin at
the Northwest corner of Block 49 of Magnolia Beach Addi-
tion to the Town of Fairhope, thence run South 370 West
673 feet to a point on the East and West half -section
line of Section 19, Township 6 South, Range 2 East;
thence run North 580 West 40 feet; thence run North
370 East 673 feet to a point on the South boundary of
Fig Street; thence run South 580 East to the point of
beginning,
BE IT FURTHER RESOLVED that the plat or map of said extensi
be incorporated in this resolution as a part thereof and that said
plat or map be recorded in the records of the Probate Judge of Ba
win County, Alabama.

Mrs. J. E. Gaston, Sr. was reappointed as member of the Library
Board for a five (5) year term beginning May 49 1965.
Motion by Councilman Stine seconded by Councilman Gaston that
the request of W, F. Hawse for renewal of Beer Permit at,the
Fairhope Casino, Downstairs aiy, be approved. Upon being put
to vote the following vote was recorded: Voting for: Mayor
Macon, Councilmen Gaston and Stine. Voting against: Councilmen
Spader, Stipes and Reynolds. Mayor Macon then cast a second
vote to break the tie and the motion was carried.
Motion by Councilman Spader seconded by Councilman Gaston that
the request of Dorothy McMillan for beer permit at the Tea Room
be rejected. Motion carried unanimously.
Motion by Councilman Gaston seconded by Councilman Stine that
the City reject bid on Cushman scooter for Police Department.
Motion carried.
Motion by Councilman Gaston seconded by Councilman Stipes that
Ordinance # 3361,"vAmending Zoning Ordinance # 295, be adopted as
introduced at the meeting of April 12, 1965, Motion carried
unanimously.
Motion by Councilman Stipes seconded by Councilman Stine that the
following Ordinance be introduced: Motion carried unanimously.
ORDINANCE # 337
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE
that Part IV - Housing, Southern Standard Building Code, 1960-1961
Edition, be adopted. (Copy on file at City Hall)
Motion by Councilman Stine seconded by Councilman Spader that City
provide two front doors as requested and light bulbs and fire
extinguishers as needed at the Public Library. Motion carried.
Mayor Macon appointed Mr. Clarke Taylor to the Organic School
Board of Managers to fill the unexpired term of Mrs. Marjorie
Bridges which expires November 9, 1967, Motion carried.
Mr. Niemeyer reported that the erosion at the Municipal Airport
is being taken care of.
Motion by Councilman Stipes seconded by Councilman Gaston that
the City appropriate $io6.00 to the Eastern Shore Junior Chamber
of Commerce to underwrite expenses of sponsoring Dogwood Queen
for the Alabama Junior Miss Contest. Motion carried.
Council discussed retirement program for City employees, connection
fees on utilities and electric contract with Riviera with no
action taken at this time.
Motion by Councilman Stipes seconded by Councilman Reynolds that
the Committee appointed to look into the possibility of a site
and construction of a Recreation Building that would meet the
needs of the City now be given a vote of approval of the City
Council to hire an Architect to proceed with construction of
Recreation Building at site on the bluff overlooking the Bay with
fee of the Architect to be presented to the Council for their
approval at the next regular meeting. Upon being put to vote
the following vote was recorded: Voting for: Councilmen: Stipes,
Reynolds, Stine and Spader. Voting against: Councilman Gaston.
Motion carried.
Motion by Councilman Spader seconded by C ilman Stine that the
meeting adjourn. Motion carried.
