COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session -at
the City Hall Monday, January 259 1965 at 7:30 P. M. with the
following members present: Mayor Macon, Councilmen Spader, Reynolds,
Stipes, Gaston and Stine.
The minutes of the previous meeting were approved.

R. H. Cowen of local Radio Station requested that the Council have

0 per month. Motion by Councilman Stine seconded by Councilman
E-P00alroer that the above request be taken under advisement. Motion
carried.

WHEREAS, Ben Barnhill, acting under and pursuant to authority
duly granted by the overning bod of the City of Fairhope Alabama

members, and under the provisions of said Act No. 6 8 it is the duty
of the governing body of said city to elect the membership of the
said board of directors and to divide said directors into three
groups of equal size, it being provided in said act that the first
term of office of one group of directors shall be two years, that
the first term of another group of directors shall be four years,
and that the first term of the third group of directas shall be six
years, as shall be designated at the time of their election, after
which the term of office of each director shall be six years; and
WHEREAS, Gavin Hunter, Donold Olds, Thomas Yancey, Gordon
McLemore, John Robertson, John Ferguson and Thomas Brown, are duly
ka
qualified electors and pro$erty owners and taxpayers of said city;
none of them is an officer -or employee of said city, and in the opinion
of said City Council each of them is competent and qualified to act
as a member of the board of directors of said corporation;
NOW, THEREFORE, BE IT RESOLVED by the City Council as follows:
(1) The recitals contained in the foregoing preambles are
hereby found to be true.
(2) The following are hereby elected as members of the Board
of Directors of said corporation, the terms of office of said members
to be as follows beginning in each instance on the 25th day of January,
1965; Gavin Hunter, John Ferguson, Thomas Brown are hreby elected as
such members for a period of two years from said date; Thomas Yancey
and Donald Olds are hereby elected as such members for a period of
four years from said date; and Gordon NeLemore and John Robertson
are hereby elected as members for a period of six years from said
date.

Motion by Councilman Reynolds that the following Ordinance be
introduced, motion seconded by Councilman Stipes and upon being put
to vote the following vote was recorded. For: Councilmen:
Reynolds, Stipes, Spader and Gaston. Against: None. Councilman
Stine abstained from voting.
ORDINANCE NO. 3.3
AN ORDINANCE AMENDING ORDINANCE NO. 1419 SECTION 2.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE,
ALABAMA, THAT ORDINANCE N0. 141 OF THE CITY OF FAIRHOPE, ALABAMA,
BE AMENDED AS FOLLOWS:
SECTION 2. No person, firm, corporation or association
shall engage in business as a wholesaler, distributor, and/or jobber
or retailer of malt or brewed beverages of an alcoholic content not
in excess of 4% by weight and 5% by volume in the corporate limits
of the City of Fairhope or within the police jurisdiction thereof,
withoutfirst having obtained from the City of Fairhope a permit to
do such business. Such permit shall be issued by the City Clerk
after having been approved by the City Council of the City of Fair -
hope. The City Council of the City of Fairhope shall prescribe the
form of application for such permit and shall prescribe the form of
such permit. Every person applying for and obtaining a permit shall
pay to the City Clerk for the benefit of the City the sum of $10.00
for a permit to engage in either of such businesses within the cor-
porate limits of the City of Fairhope and to engage in either of
such businesses without the corporate limits but within the police
Jurisdiction thereof. The fee for such permit shall accompany the
application for the issuance of such permit. The permit shall be
renewed on the First day of January of each year. No reduction or
Proration of the fee for the permit shall be allowed on account of
not commencing business on the First day of January, nor shall any
rebate be allowed upon revocation, suspension, or surrender of such
permit before the expiration thereof.

Motion by Councilman Stipes seconded by Councilman Reynolds that the
request of Pik -A -Pak for retail packaged beer.permit be tabled,
Upon being put to vote the following vote was recorded: For:
Councilmen Reynolds Stipes, Spader and Gaston. Against: Councilman
Stine. Motion carried.
Motion by Councilman Stine that the City accept pro osal of Bill Crane
p
and hire his firm as Fiscal Agent for the City for the balance of
term, motion seconded by Councilman Stipes. Mayor Macon ruled
Councilman Stine'out of order, Councilman Stine then requested that
hiring of Fiscal Agent be put on the agenda for the next regular
meeting of the Council.

action on Council AgeM items be taken first. Councilmen can present

t e action on any matters not on the agenda providing the Council
�unanimously elects to do so. All items to be put on agenda for an
Council meeting must be submitted to the Executive Assistant no later
than 10:00 A, M. on Thursday preceding Council meeting on Monday.

Motion by Councilman Stipes seconded by Councilman Stine that City
accept letter of resignation of Walter Poser, Ernest Bailey and E. P,
Wakefield from the Recreation Board, Motion carried,
The committee appointed by the Mayor to look into the possibility of
building a Civic Center to meet the needs of the City of Fairhope met
with the Single Tax Corporation Council to ask their approval and
opinion on building a Civic Center at the Red Cross site. The
committee explained what the building would consist of and an outlined
description of how big and where it would be situated. They also
explained that a survey had been taken of the parking area and over
200 cars could be parked in this area. After a lengthy discussion
the Single Tax Corporation Council said they were against erecting any
building on any property the Corporation had leased to the City.
( They felt that if they approved erecting a building on the park and
�lr beach property that eventually there would not be any park orbeach
area. Under these circumstances they were against a Civic Center on
beach or park lands but informed the committee that they would bring
it up before the Single Tax membership for their approval or disappro-
val.
Motion by Councilman Reynolds seconded by Councilman Spader that
Superintendent Dyson be authorized to purchase pipe for drainage at
Valley and Nichols Street. Motion carried.
Motion by Councilman Stipes seconded by Councilman Gaston that the
meetin.gg adjourn in unadjourned session to me _on Wednesday, January

provided, under an ordinance entitled "IMPROVEMENT ORDINANCE
NO. 305-; AN ORDINANCE TO PROVIDE FOR CERTAIN IMPROVEMENTS ON
ROSA 7MNUE, PERDIDO AVENUE, SEMINOLE AVENUE, TENSAW AVENUE,

authorized to make collections of assessments for improvements

(2) Perdido Avenue from Mobile Avenue to Section Street.

(5) Patlyn Drive and cul-de-sac from the north edge of Gayfer
Street.
(6) Patlyn Drive and Valley Drive from Gayfer Street to
Fairwood Boulevard.
(7) Ingleside Avenue from the North end of the present
pavement northerly for a distance of nine hundred feet.
(8) Tulip Terrace from Gayfer Street northerly to a point
in the center of a forty-five foot radius cul-de-sac.
(9) Satsuma Street from Laurel Street to Fig Street.
(10)Kirkman Lane from Church Street to Section Street.
(11)Francilla Circle from Kirkman Lane southwesterly to
a point in the center of a thirty seven and five tenths foot
radius cul-de-sac.
(12)Ivy Circle from Kirkman Lane southwesterly to a point
In the center of a thirty seven and five tenths foot radius
cul-de-sac.
(13)Boone Lane from Ann Street to Kirkman Lane.
(14)Park Drive and South Patlynn Drive from the northeast
edge of the pavement on Fairwood Boulevard running easterly
and southerly to the northeast edge of the pavement on Fairwood
Boulevard.

The Requirements as set forth in the City's Standard
Specifications (M I=61) have been fulfilled and final in-
spection on all streets involved in the 1963-64 Street
Improvement Program has been made and accepted by the
Engineer.
We therefore recommend that the City accept the
project for final payment.
