The: C i ty Counc i I of the C i t y of r a t rhope., A I a•bama, met i n regu I ar sess i on
at the City Hall,. Monday, November 26, 1;962 at 7:30 P.M. with the follow-
ing, members present: Mayor Schneider, Councilmen; Boone,. Gaston, Nelson,
Poser and Schermer.
The minutes of the previous regular meeting were read and approved'as read.
The request of Mr. Evans for beer and liquor permits ikt the Fier Club was
brought up for discussion. Letters and petitions protesting same were
presented. A group of residents of the City met with the Council protesting
the issuance of license. Motion by Councilman Nelson seconded by Councilman
Gaston that the application of Mr. Evans for beer and liquor I.icensa for
the Pier Club at the Fairhope Casino be rejected on the basis that it is
in the center of public recreation area in Fairhope and there are no parking
facilities available. Upon being put to vote the following vote was record-
ed: For: Councilmen:. Gaston, Nelson, Poser and Schermer. Against: None.
Councilman Boone not voting. Motion carried.
Motion by Councilman Poser seconded by Councilman Boone that the City Attor-
ney be and is hereby directed to investigate the `-ity automobile•ad-valorem
tax escapes in accordance: with State law. Motion carried.

Re: Memorandum of Acreemen t
Fairhope-Daphne Gas System
Gentlemen:
As directed by Mayor Joe Schneider, this firm is in the process of obtain-
ing detail information pertaining to the Memorandum of Agreement between the
City of Fairhope and the City of Daphne, dated January 23, 1950, and concern-
ing the future purchase of the gas system by the City of Daphne. We are
making a- study of the pertinent facts contained in this agreement and are
having conferences with various parties.
Vla expect to have our recommendations formulated with/Kthe near future for
presentation to the City Council.

and is hereby authorized to hire the, necessary engineering help required
in order to accumulate data necessary to sale of Daphne Gas System to the

Resolution be introduced'.
BE IT RESOLVED BY THE C ITY CCUNC IL OF THE C ITY OF r-iA;IRHOPE, ALABPV,,
that their attorneys determine the: price that the Town of Daphne pay for that
part of the gas system which they desire to -purchase under- their agreement
of 23rd January, 1950, to answer Resolution of the Town of Daphne, dated
22nd October, 1962, which has been sent this City, Motion carried.

Lacey, Attornoys, be hired in accordance with their letter to the City

Motion by Councilman Nelson seconded by C ouncilman Boone that 162.00 be
authorized for advertising. ^,Action carried
Request of resident s. of Point Clear area for natural gas was referred to the
City Superintendent with authority to make this extension if feasible.
Motion by Councilman Boone seconded by Councilman Poser that parking, meters
I# reinstalled on the Fairhope beach on stands already on the beach rather -
than pay settlement fee of 18,000.00 offered by Dual Parking Meter Company
to settle all claim of the i'?14,9-90.65 contract obligation of the previous
administration,. C ouncilmUn Schermer then moved that the .motion be tabled until
various civic organizations, such as the Chamber of Commerce and Recreation
Board, are consulted with regard to their opinion and that the Business
Administrator be instructed to write various organizations for their opinion.
Motion seconded by Councilman Nle son. Upon being put to vote the following
vote was recorded-: For: Councilmen: Schermer and Nelson. Against: Councilmen:
Gaston, Boone and Poser. Motion defeased. The Mayor then called for a vote
on Councilman' Boonets motion with the following result: For: Council-nen:

,Viotion by Councilman Poser seconded by Councilman Gaston that the City accept
offer of the: Fairhope: Single Tax Corporation in their letter da-Ied 19 October,
1962 pertaining to improvements on Bancroft Street. viotion carried.
Motion by Councilman Nelson seconded by Councilman Gaston that sewer line
be extended in Pecan Street and Horton Lane area -as deemed feasible and author—
ized by the Mayor. Motion carried.
A lei -ter from the Chamber of Commerce inviting the Mayor and Councilmen to
ride=in the Christmas parade was read.
Letter from the Secretary of Board of Censors dated 19 November, 1962, per—
taining to survey of Eastern Shore Bay waters was read to the meeting.
It was duly moved and seconded that the meeting adjourn. Motion carried.
