The City Council' of the C. i ty of Fa i rhope met i n regu I arr less ion at the C i ty
Hall, Monday, August' 13,, 1962 with the following members present: Mayor
Schneider, Councilmen: Boone, Gaston, Nelson, Poser and Schermer.
The arinutes of the previous meetings of July 23 and. July 27, 1962.were
read and upon motion by Councilman Boone seconded by Councilman Nelson were,
approved as read.
A group of citizens. protesting the action of the Council in, deeding
property to the E I:kt s Club inn exchange: f=or property to straighten the h i gh--
way mea with the council. Mr. Stone, Attorney for the group, thought his
action woul,d be to file. suit against the City to set aside the transfer to the_
E I k' s Club. Mr. John Beasl.ey, representing the E l ki's Club, stated that the
purpose of the transfer was to straighten the curve in the road,that the engineering
had,already beencompleted and that the transfer would-be of mutual benefit
- - -- to the City and the E I k1 s Club.
Councilman Poser suggested that it might be worth considering leasing the balance
of the- area in question to various civic organizations who are interested in
making the.,area a. better place for the people of Fai rhope to enjoy the beach.
Councilman Schermer suggested that the City hold a referendum and asked
if the•El,ks would accept the results of the referendum rather than taking it
to court. Mr. Beasley repl.ie4 that he could not speak for the El.k"s Club:; in
this.but i't was his opinion that they would not as they felt that the action
of the- C it y Counc i I was I egad .
Counci Iman Poser then suggested that the City accept .the petition of the
group andthat it be taken under advisement.
A letter from State Military Department stating that a representative. -of
that office had been assigned to make a study of rental rates at the. Armory
was read to the meeting.
Letter from Mr. Arthur Beck.,. Water Improvement Commission, with recommen—
dations to insure proper performance of the sewage treatment plant and to
protect the quality of the water in -the Beach area.was read and discussed.
Councilman Boone moved that the following Resolution be adopted which was
seconded by Councilman Poser and carried.
BE IT RESOLVED THAT THE BUSUNESS Administrator be authorized to advertise.
for bids to accomplish that recommendations of the Water Umprovement Commission
to extend the outfall line to where it will discharge into five feet of water
at low tide.
BE IT FURTHER RESOLVED that Mr. George Dyson, City Super i ntende.nt, be
authorized, to obtain necessary information to accomplish ,recommendations to
provide Kennison flow nozzle measuring device.
BE IT FURTHER RESOLVED that the Business. Administrator advise the Water
Improvement Commission that recommendations 1,2,3 & 6 have been accomplished;
he it further instructed to request from the Water Improvement Rmmmailxxx
C omm-.ission all bacteria reports that they took during their check of the Sewer
Plant and Mobile Bay water which was .reported verbally to a special meeting
of the City Council..
It is further resolveathat the: Business Administrator make areangement
with the: county Health Department immediately to instigate recommendatiorr,8
which state that a regular sampling, of Mobile Bay waters on the Beach Area
be started. The Business Administrator shall get the degree of contamination
from the Health Department in the form of a standardwritten weekly report. -
Be. it Further Resolved that the City Attorney prepare the necessary Ord—
inance to accompi.ish recommendation #5 by prohibiting cooling water from ailt
conditioning units to be discharjed into the: sanitary sewer.
Be It Further Resol.ved that Mr. Byrne. be instructed to make a- report
at every regular Council meeting on the progress_ of these: recommendations
until all have been accomplishedsince the contamination of i:Aobile Bay is
a threat against the health and welfare of Fairhope.
Mr. Hawie requested a, permit for E I.kT s. C lub of Mob.i le in cooperation
with the Fairhope Elk's Club to hold a:Fair on the beach on Labor Day week—
end., al I proceeds 1XVx for the, benefit of the., Elks Foundation. The Council
agreed to issue permit under thesupervision of the !vlayor and Chief of Police.

Motion by Councilman Boone seconded by Councilman Schermer that uponthe
acceptance of Bateman agreement by the: City Attorney and the Planning,
Board's recommenda.t i on of retaining Bateman and -Associates for one year at
a fee of $890,0.0,, the Mayor be authorized to sign agreement as presented.
Motion carried,
Adlalorem:tax on newly annexed area was discussed. The City Attorney,
General. Superintendent and Business Administrator were appointed to make
survey according to annexation Ordinance.
C ounciIman Poser reported that the committeeon eIectris contract would
have a report for the next meeting of the Council. -
A letter from Moore:Engineering Company stating thay had been verbally
notified that the successful low bidder on Bancroft Street, Mr. H. 0. Weaver,
Viould like to withdraw his bid and he can legally do so. The Business
Administrator was instructed to write the Fairhope Single Tax Corporation.
requesting that they meet with the Council to discuss Bancroft Street improve—
mants. The Business Administrator was further instructed to mail registered
letter to Barber Dairy requesting that they notify the City as, to their
future plans.

of paving and that the City complete paving approximately. 300 feet on Ingle: --
side Extension in.this paving project.. This motion to supersede any previous
motion of like.mature. Motion carried./ \A \
The�Council agreed to proceed withI for City Garage as recommended
by the City Planning Com.;iission,
C ounciIman Boone presented plans and report of Harbor committee which
were taken under advisement.
A I,etter from Thomas Hospital requesting that the, portion of Ingleside
Avenue next to the Hospital be included in the next paving venture. Motion
by CounciIman Gaston seconded by CounciIman Boone that the le(tter be t aken
under advisement and that the City make every effort to work out a solution-,
for paving ingleside. Motion carried.
Councilman Schermer stated that he would have a report on gas rates out—
side City lkkix Limits for next meeting of the Council. -
Councilman Nelson reported on work done by committee appointed to study down—
town parking problem.
Motion by Counciliihan Boone seconded. by Councilman Gaston that the:
City employ Moore Engineering, Company to:
1. Consult with the City Planning Commission to d etermine proper
planning for the expected improvements to Fairhope Avenue east of Section -
Street.
2. Then to do the necessary engineering on said improvementsfor a
d i stance: of 1,00 feet east and. 1.00 feet west of the Ruffles building
ocated at 560 Fa i rhope Avenue.
Motion carried.
Motion by Councilman Gaston seconded by Councilman Poser that the
following biIts be approved for payment. Motion carried..
