The City Council of the City of Fairhope met in regular session at the
C i ty Hal I , Monday, March 22, 1962 at- 7:30 P-M- with the fo I I owing members
present: Mayor Schne 1 der, C ounc i I men: Boone, Gaston,, Ne I son, Poser and
Schermer.
motion by Councilman Schermer seconded by Counc.i I man Gaston that the minutes
of Feb. 26, 1962 and March 9, 1962 be approved as read. Motion carried.
This, being date set for the opening of bids on Street Improvements, the
following bids were received qnd read to the Council:

Mot i on by Counc i Iman Boone seconded by Counc i Iman Gaston that the Mayor,
George Dyson and Moore Engrs. study bids and recommend to the Council which
is successful bidder. Motion carried.
Motion by Councilman Nelson seconded by Councilman Boone that the following;
Resolution be: adopted.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE that the
Mayor and City Clerk be instructed to execute the contract with Fairhope.
C lay Products Company, a copy of which is now f i led with the City Clerk.
C ounc i l man Schermer offered an alternate motion that no action be taken
on contract until. a more thorough study is. made. Motion died for lack.of
second. Mayor Schneider then called for a vote on the Resolution offered
by Councilman Nelson with the following resu I t:: For: Councilmen Boone,
Gaston, Nelson and Poser. Against: Councilman Schermer. Motion carried.
A request for dance hall I I icense, at the Fa i rh ope Casino was referred to the:
Pol iceCommiasioners and Chief of Po ice for recommendat ion.
Letter from Dixie Laboratories on testing street surfacing was referred to
a committee for study and report to Council.

Motion by Councilman Nelson seconded by Councilman Boone that the City
Attorney read they C i ty Code and refer any problems to the Department
heads. Motion carried.
Motion by Councilman Schermer seconded by Councilman Poser that the City
change to staggered billing with three billing periods per month. Motion
carried.
Motion by Counci 1.,nan Boone seconded by Counc i Iman Gast on that the City
reject the request of the Chamberof CommerceAviation Committee to f i le a
request for a Federal Aviation Agency Grant pr.iior to March 1.6, 1962. Upon
being put to vote the following vote was recorded: For:. Councilrre.n: Boone,.
Gaston,, Poser and Schermer. Aga:i nst: Counc i I man N e I son. Mot i on carr ied.
Motion by C ounc-iI'nan Gaston seconded by Councilman Nelson that the next
regular meeting of the City C ounciI be held on March 19, 1962 instead of
March 26, 1962 due to the A 1 abama League Convent i orr. Motion carried.
Motion. by Councilman Poser seconded by Councilman Nelson that the following,
bills be approved for payment: Motion carried.

Your letter was read to the Planning Commission and after a
discussion their recommendations are.
One. That the Bedsole application for a building permit be
appealed by the applicant to the Board of adjustment and
Appears of the City of Fairhope;
Two. It is recommended by the Plannigg Commission that in the
future that any violators of the Zou.ing Ordinance be stopped
at once by a written cWd.er of the Building Inspector and if
necessary that the Building Inspector proceed with injunction,
mandamus or other appropriate action or proceedings to resolve
the violation. This is all provided for in the Zoning Ordinance,
Article 4, Section 41 through Section 46.
