Each member of the Council having proper not ice: of the special meeting the Mayor called the meeting to order and on roll call the following were found to be present: Councilmen: Boone.,, Gaston, Poser and Schermer.. Councilman Nelson being absent. Mr. Donald Mills, Engineer, was, also present at the meeting. The Mayor stated that a quorum vies present and declared the meeting open for the purpose of opening bids for the connecting water line to the new elevated tank. A,J ORDINANCE TO PROVIDE FOR CERTAIN STREET IMPROVEMENTS ON STREETS AS FOLLOWS: NICHOLS STREET from the east edge of the existing pavement on Section Street easterly to the edge of the existing pavement on School Street. SATSU.°W STREz:T from a point twenty (20) feet north of the center of the dedicated right-of-way of Fig Street, northerly to the south edge of the existing pavement on Pier Street. Also includes laying a twenty-four (24) inch storm sewer pipe line along Pecan Street, from Satsurn.-) Street ,v esterly to a junction with the present storm sewer system; and to patch and resurface Pecan Street as deemed necessary by the City in the above described area. ORANGE STREET from a point on the east edge of the proposed construction limits of Satsuma Street, easterly to a point ten (10) feet east of the center of the dedicated right-of-ivay of Pornelo Street. Also including curb & gutter and necessary paving on the north side of the existing paved street from a point on the west edge of the proposed construction limits of Satsuma Street, oesterly to a point at right angles to the %west property line of Ottila R. Huggins. tbARSIM DRIVE: from the south edge of the exi : ting pavement on Jan Drive to a point ten (10) feet north +vest of the center of the dedicated right-of-way of Valley Drive. DOGWOOD STREET from the east edge of the existing ;pavement on Section Street, easterly to a point ten (10) feet east of the center of the dedicated right-of-way of Valley Street. NOW THEREFORE, BE IT ORDAI14ED BY THE COUNCIL OF THE CITY OF FAIRHOPE, ALABAM , AS FOLLOWS: SECTION I. That the roadways hereinafter described in Subsections of this section designated A to F respectively, both inclusive, shall be graded, drained, paved and concrete curb and gutter constructed along each edge of the pavement; that the pavement shall be a one and one-half (1!) inch compacted Plant Mix Bituminous Wearing Course composed of mineral aggregate and asphalt cement on a six (6) inch sand clay base; that the curb and gutter shall be constructed or Portland cement concrete along each edge of the Pavement on said roadways as hereinafter described in Subsections A to F, both inclusive, between the terminal points of said curbs -1- in said subsections. The roadway widths hereinafter described shall be the width between gutter lines. SUBSECTIONS A. The roadway on Nichols Street, tiventy (20) feet in width, ten (10) feet on each side of the center line thereof, extending from the east edge of the existing pavement on Section Street easterly to the edge of the existing pavement on School Street. B. The roadway on Satsuma Strect, twenty (20) feet in width, ten (10) feet on each side of the center line thereof, extending from a point t;^,'enty (20) feet north of the center of the dedicated right-of-way of Fig Street, northerly to the south edge of the existing pavement onPier Street. Also includes the necessary patching and resurfacing of Pecan Street between Satsuma Street and Mobile Avenue. C. The roadway on Orange Street, t,:<<enty (20) fees in S,jidth, ten (10) feet on each side of the center line thereof, extending from a point on the east edge of the proposed construction li-iits of Satsuma Street, easterly to a point ten (10) feet east of the center of the dedicated right-of-way of Pomelo Street. Also including the necessary paving on the north side of the existing paved street from a point on the west edge of the proposed construc- tion limits of Satsuma Street, .vesterly to a point at right angles to the west property line of Ottila R. Huggins. D. The roadway on Marsim Drive, twenty (20) feet in kiidth, ten (10) feet on each side of the center 'line thereof, extending from the south edge of the existing pavement on Jan Drive to a point ten (10) feet north rn,est of the enter of the dedicated right-of-way of Valley Drive. E. The roadway on Dogwood Street, twenty (20) feet in width, ten (10) feet on each side of the center line thereof, extending from the east edge of the existing pavement on Section Street, easterly to a point ten (10) feet east of the center of the dedicated right- of-way of Valley Street. -2- SECTION II. That said improvements shall be made in accordance with the grades for said portions of said streets heretofore established as shown by profiles thereof on file at the City Nall, and according to full details, drawings, plans, specifications and surveys of said 1nork and estimates t,hich have been prepared by the City Engineer, exhibited to this Council, and noi1., on .file f-st the City Nall, where property owners who may be affected by said improvements -nay see and examine same to tn+hich reference is hereby made and which are hereby adopted. SECTION III. That cost of constructing said improvements shall be assessed against the property abutting on the portions of the streets so improved, provided: (a) That the cost of improving any in�ersection or any part thereof, shall be assessed against the lots or parcels of land abutting on each of the streets so improved. (b) That no assessment shall exceed the cost of such improve- ments or the increased value of such property by reason of special benefits derived from such improvements. SECTION IV. As shown by detailed estimates of the cost of said improvements on file at the City Nall, the estimated costs of said improvements described in the several subsections of this Ordinance are respectively as follows; 1-A, $8,440.32 1-B, $12,060.23 ; 1-C, $8.007.81; 1-D, $7,_262,10; 1-E, $15,�461.46; that the total aggregate estimated cost of all improvements described in this Ordinance is $58,231,92. SECTION V. That the Council of the City of Fairhope will meet the day of of the City Nall of Fairhope at , 1962, in the Council Chamber to hear any objections, remonstrances, or protests that may be made against said improvements, the manner of making the same or the character of the materials to be used.
