Motion by Councilman Boone seconded by Councilman Poser that the City request the.Fairhope Single Tax. Colony to consider petition presented. by Mr..WTggins at their next regular meeting and that the City has other requests in other areas where colony property is involved where improve- ments are in order. Motion carried. IJ13 Letter of request to erect ornamental, brick entrance marker to Deepwood Subdivision, was referred to the General Superintendent. Motion by Councilman Boone; seconded by Councilman Nelson that the bill. of E. G. R ickarby for $ 1.5.0.0.00 as Attorney for 1961 Bond Issue be approved for payment out of funds from the bond issue. Motion carried. Motion by Councilman Nelson seconded by Councilman Gaston that -the -City pay expenses of Patrolman Gilheart to attend Alabama Police Academy for six weeks,. Motion carried. Councilman Boone introduced the: following ordinance which was read to the mavt in q.- ORDINANCE NO. 286 AN ORDINANCE SUPPLEMENTING ORDINANCE #285 OF THE CITY OF FA IRHOPE, ALABAMA ADOPTED ON DEC EMBER 11, 196 BE IT ORDAINED by the Mayor and City Council (herein called "the governing body") of the City of Fairhope (herein called "the city") i:n the State of Alabama,. as fol.Iow.s: SECTION 1, Findings. The governing body of the. city has ascertained and found anddoes hereby determine and recite as follows: (a) On December. 11., 1961, the governing body adopted Ordinance No. 285,of the city author— izing and providing for the issuance of-$1,000,000 principal amount of Water, Gas. and Sewer Revenue Bonds, Series. 19615, to be dated December I, 1961(here.in called "'the series 1961 bonds") of the city for the purpose of'r ref and i ng; the c i ty• s outstand i nq F i rs.t Mortgage Gas R ::venue Bonds dated February 1, 195.0, numbered 159 to 494, inclusive, aggregating $ 336,.00.0 Vn, pr i nc i pi:l. mount ( herein called. "the 1950, gas bonds") , paying the costs of constructing capital improvements to the city"s water works and sanitary sewer system and.its natural gas distribution system and paying, costs i,nc idental to such construction and to the issuance of the Series 1961 bonds; and (b) it is necessary and desirable that the Series 1961 bonds be allocated among the purposes for which they are authorized to be issued by specifying the numbers of the Series 1961 bonds that are issued for the aforesaid respective purposes. SECTION 2, Further Provvi s i ons Respecting Use of Proceeds from the Series 1961 Bonds. The principal proceeds ( exc I,usi ve of premium) fromi the Series 1961, bonds numbered I to 336, inclusive, aggregating $336,000 irn principal amount shaall be applied for payment of the principal of the: 1950 gas bonds. The principal: proceeds (exclusive of premium) Room those of the Series 1961 bonds. numbered 337 to 347, inclusive, aggregat— ing, $1 1,000 in prtnc i pal amount, and $455.00 of the pri nctpal proceeds - from that one of the Series 1961 bonds numbered 348' shall be applied'for payment of the redemption premium -of $11,45>5;constituting part of the redemption price for those of the 1950 gas bonds which have stated maturities after February 1, 19.62',, and which the city has called for redemption on that date. The remaining princi7pal proceeds (other than prerw um) from the Series 1.961: bond numbered 348 and the principal proceeds (exclusive of premium) from those of the Series 1961 bonds numbered 349 to 1,000 shall be applied for payment of the cost of making 'the said capital improve— ments and of paying incidental expenses iin connection therewith and with the issuance of the Series 1_961 bonds. C ounc i I pertaining to Group Alerting System for Police, and Firemen. Tabled for xk further study. Motion by Councilman Nelson seconded by Councilman Boone that the City employ Claude Ar;nol.d, Engineer, for one day, cost not to exceed $50.00, to work with committee appointed by the Planning Board to check preliminary Lot and Block Map. Refuse Col lection body and on: truck, recommended by Company, bids to be opened January 22, 1962. Motion carried. Series Trust Indenture. A request for Street tight on Gaston Avenue: between George and Equity wasrejected. Correspondence from Mr. Julius King relative to the advantages of building a: two year, Junior College in the Fairhope area was read to the: Council and was considered by the Council that it would be a highly desirable att- rac ti on for our area. Motion by Councilman Boone seconded by Councilman Poser that the follow- ing bibls be approved for payment: Motion carried. M. The meeting was called to order by Joe Schneider, the Mayor, and upon roll call the following were found to be present: Mayor Joe Schneider and the following members of the city council: Lester I. Boone, James E. Gaston, Jr., William J. Nelson, Walter 0. Poser and Alton E. Schermer. The following were found to be ab sent : The mayor presided and Marie Moore, the city clerk, who was also present, acted as clerk of the meeting. The mayor stated that a quorum was present and declared the meeting open for the transaction of business. Councilman Anrn introduced the following ordinance which was read to the meeting: ORDINANCE NO. 2 9 � AN ORDINANCE SUPPLEMENTING ORDINANCE NO. 285 OF THE CITY OF FAIRHOPE, ALABAMA ADOPTED ON DECEMBER 11, 19i1 BE IT ORDAINED by the Mayor and City Council (herein called "the governing body") of the City of Fairhope (herein called "the city") in the State of Alabama, as follows: i3✓ Section 1. Findings. The governing body of the city has ascertained and and does hereby de- termine and recite as follows: (a) On December 11, 1961, the governing body adopted Ordinance No. 285 of the city authorizing and providing for the issuance -of $1,000,000 principal amount of Water, Gas and Sewer Revenue Bonds, Series 1961, to be dated December 1, 1961 (herein called "the Series 1961 bonds") of the city for the purposes of refunding the city's outstanding First Mortgage Gas Revenue Bonds dated February 1, 1950, numbered 159 to 494, inclusive, aggregating $336,000 in principal amount (herein called "the 1950 gas bonds"), paying the costs of constructing capital improvements to the city's water works and sanitary sewer system and its natural gas distribution system, and paying costs incidental to such construction and to the issuance of the Series 1961 bonds; and (b) it is necessary and de- sirable that the Series 1961 bonds be allocated among the purposes for which they are authorized to be issued by specifying the numbers of the Series 1961 bonds that are isssued for the aforesaid respective purposes. Section 2. Further Provisions Respecting Use of Proceeds from the Series 1951 Bon s. The principal proceeds exc us ve or premium) rom the Series 1961 bonds numbered 1 to 336, inclusive, aggregating $336,000 in prin- cipal amount shall be applied for payment of the principal of the 1950 gas bonds. The principal proceeds (exclusive of premium) from those of the Series 1961 bonds numbered 337 to 347, inclusive, aggregating $11,000 in principal amount and $455.00 of the principal proceeds from that one of the Series 1961 bonds numbered 348 shall be applied for payment of the redemption premium of $11,455 constituting part of the redemption price for those of the 1950 gas bonds which have stated maturities after February 1, 1962, and which the city has called for redemption on that date. The remaining principal proceeds (other than premium) from the Series 1961 bond numbered 348 and the principal proceeds (exclusive of premium) from those of the Series 1961 bonds numbered 349 to 1,000 shall be applied for payment of the cost of making the said capital improvements and of paying incidental expenses in connection therewith and with the issuance of the Series 1961 bonds. M., pursuant to adjournment of the adjourned regular meeting held on December 15, 1961s which had been in turn adjourned from the regular meeting held on December 11, 1961. The meeting was called to order by Joe Schneider, the mayor, and upon roll call the following were found to be present: Mayor Joe Schneider and the following ambers of the city council: Lester I. The following resolution was introduced in writing by Councilman ^_ and read to the .�. meeting: BE IT RESOLVED by the Mayor and City Council of the City of Fairhope that the mayor of the city is hereby authorized and directed`: to sign in the name and in behalf of the city a letter in substantially the form hereinafter set forth t . .Dd,�pr-.>Iklttb asae. s A Fairhope, Alabama December , 1961 Town of Daphne Daphne, Alabama Gentlemen: Reference is made to the agreement between the City of Fairhope (herein called "Fairhope") and the Town of Daphne (herein called "Daphne) dated January 23, 1950, pertaining to construction by Fairhope of a natural gas transmission pipeline and distribution system (herein called "the gas system")certain options of Daphne with respect thereto, and other matters (the said agreement being herein called "the 1950 agreement"). On February 13, 1950, Fairhope issued its First Mortgage Gas Revenue Bonds dated February 1, 1950, of which $336,000 (herein called "the outstanding 1950 bonds") now remain outstanding. The outstanding 1950 bonds are in the denomination of $1,000 each and mature as follows: Maturity Date Aggregate Principal Amount Maturing February 1, 1962 $ 22,000 February . 1, 1963 24, 000 February 11 1961[ 24,000 February 1, 1965 26,000 February 1, 1966 26,000 February 1, 1967 28,000 February 11 1968 28,000 February 1, 1969 30,000 February 10 1970 30,000 February 1, 1971 32,000 February February 1, 10 1972 1973 32,000 34,000 Those of the outstanding 1950 bonds having stated maturities in 1962 to 1967, inclusive, bear interest at the rate of 3-1/2% per annum and those having stated maturities in 1968 and thereafter bear interest at the rate of 3-3/4% per annum, all such interest being payable semiannually on February 1 and August 1. Fairhope now proposes to issue its Water, Gas. and Sewer Revenue Bonds, Series 19611 to be dated December 11 1961, aggregating $1,.400,000 in principal amount for the purpose of refunding the outstanding 1950 bonds and making capital improvements to the gas system and to its water and sewer system. For the purposes of malting any computations or determinations under the 1950 agreement that are based upon the amount of principal and interest then outstand- in§ with respect to "the bonds issued for the construction of -the gas system (as that phrase is used in the 1950 agreement), the amount of such outstanding principal and -2- 1�'�r interest shall be computed as if the outstanding 1950 bonds had not been refunded and as if all principal and interest with respect to the outstanding 1950 bonds had been paid on the respective maturity dates of such principal and interest. For the purposes of making any computations or determinations under Paragraph (or Section) SJ:KTH of the 1950 agreement, with respect to any month, (a) the respec- tive amounts required to be paid by Fairhope into the "Gas System Bond and Interest Redemption Fund" and the "Gas System Operation and Maintenance Fund" referred to in said Paragraph (or Section)SIXTH shall be deemed to be the a- mounts that would have been required to be paid into the said funds respectively, during that month, if the out- standing 1950 bonds had not been refunded and if all prin- cipal and interest thereon had been paid at the respective maturities of such principal and interest, and (b) the amount required to be paid by Fairhope into the "Gas System Contingent Fund"referred to in said Paragraph (or Section) SIXTH shall be deemed to be nil.
