HomeMy WebLinkAbout09-12-1960 Regular Meeting (2)MINUTES OF A REGULAR MEETING OF THE MAYOR AND THE CITY COUNCIL OF THE CITY OF FAIR - HOPE, ALABAMA, HELD ON SEPTEMBER 12, 1960 The Mayor and the City Council of the City of Fairhope, Alabama, met in regular session at the city hall in said city on Sept�mber 12, 1960, at the regular hour, 7:30 o'clock, P. M. Mayor E. B. Overton presided as chair- man of the meeting and \ \roll call the following were found to be present:_Mayor\-E\ B. Overton and Aldermen William R. Ruffles, Jr., Charles BeleM., 0. Berglin, Walter N. Poser and Barney L. Shull; and the following were found to be absent: �uJ Marie Moore, the City Clerk, was also present and acted as clerk of the meeting. The mayor declared that a quorum was present and the meeting was open for the transaction of busi- ness. The minutes of the preceding meeting were read and ap- proved. The mayor stated that there had been presented to the mayor and city council an application for authority to incorporate a proposed public corporation to be known as "The Utilities Board of the City of Fairhope" under the pro- visions of Act No. 175 enacted at the 1951 Regular Session of the Legislature of Alabama, as amended. The said application was presented to the meeting and discussed, after which the following resolution in writing was introduced by Alderman and read to the meeting: - 1 - RESOLUTION NO. / A RESOLUTION GRANTING AN APPLICATION FOR AUTHORITY TO INCORPORATE THE UTIL- ITIES BOARD OF THE CITY OF FA IRHOPE BE IT RESOLVED by the Mayor and City Council (herein together called "the governing body") of the City of Fairhope, Alabama (herein called "the city"), as fol- lows: Section 1. Findings. The governing body of the city hereby finds and declares that the following ap- plication in writing has been filed with the said govern- ing body: 11T0: THE MAYOR AND CITY COUNCIL OF THE CITY OF FA IRHOPE, ALABAMA : We, the undersigned natural persons who are duly qualified electors of and property own- ers in the City of Fairhope, Alabama (herein called "the city"), do hereby file with you as the governing body of the city, and do hereby make, this application in writing for authority to incorporate a public corporation under the provisions of Act No. 175 enacted at the 1951 Regular Session of the Legislature of Alabama, as amended, to operate in the city or in the un- incorporated areas in the vicinity thereof, or in both, one or more of the following types of utilities: a water works plant and distribution system, an electric distribution system, a sani- tary sewer system and a gas distribution system. We do hereby request that this application be granted and that a proper resolution be adopted by you authorizing the incorporation of such a public corporation under the name of "THE UTIL- ITIES BOARD OF THE CITY OF FAIRHOPE." BAILEY - 2 - The governing body of the city hereby further determines, finds and declares that each of the applicants whose name is signed to said application is a natural person and a duly qualified elector of and owner of property in the city; that the aforesaid application is regular in all re- spects and conforms with the requirements of the laws of Alabama under which said corporation is proposed to be or- ganized; and that it is wise, expedient and necessary that the said public corporation be formed. Section 2. Authorization for IncoERoration, The aforesaid application is hereby granted, and the persons filing said application are hereby authorized to proceed to form such corporation by executing and filing for record a certificate of incorporation providing for the incorpora- tion of such corporation under the name of "The Utilities Board of the City of Fairhope", in the manner provided by the laws of Alabama under which said corporation is pro- posed to be organized. Section 3. Publication. Adopted and approved this 12th day of September, 1960. City C e k - 3 - Alderman ,, aA J moved that unanimous consent be given for immediate consideration of and action on said resolution, which motion was seconded by Alderman , and, upon the motion being put to vote, the following ote was recorded: Yeas: Mayor Overton and Aldermen Ruffles, Belew, Berglin, Poser and Shull; Nays: None. The mayor thereupon declared that the motion for unanimous consent for immediate consideration of and action on said resolution had been carried. Alderman thereupon moved that the said resolution be finally adopted, which motion was seconded by Alderman , and, upon said motion being put to vote, the following vote was recorded: Yeas: Mayor Overton and Aldermen Ruffles, Belew, Berglin, Poser and Shull; Nays: None.
