The City Council of the City of Fairhope met in regular session at the
City Hall, Monday, July 25, 1960 with the follwoing members present:
Mayor E. B. Overton, Lity Manager C. B. Niemeyer, _Councilmen: C. F. Belew,
M. 0. Berglin, W. 0. Poser and B. L. Shull. Councilman W. R. Ruffles
being absent.
Motion by Councilman Shull seconded by Councilman Belew, that the minutes
of the previous regular meeting be. approved as read.
Motion bo t ounc i I man Berglin seconded by Councilman Shull that the
application for building permit of R. C. Macon be approved as submitted.
Motion carried.
Councilman Shull introduced the following Ordinance which was seconded by
C ouncilman Poser.
ORDINANCE # 268
AN ORDINANCE AMENDING ORDINANCE NO. 221 PROVIDING GENERAL LICENSE
TAXES IN THE CITY OF FAIRHOPE, ALABAMA AND IN IT'S POLICE JURISDICTION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FA IRHOPE, ALABAMA,
AS FOLLOWS:
SECTION 1. To add to Ordinance No. 221, and designating it as Schedule
198 to read as follows
SCHEDULE 198. TRADING STAMPS::
Oa) That all person, firms or corporation engaged in the business of
furnishing trading stamps, checks, or tickets to merchants in the City of
Fairhope, Alabama, to be distributed among their customers soall pay for an
annual, license tax to the City of Fairhope, Alabama in the amount of $150.00.
(b) That all persons, firms, or corporation engaged in the business of
furnishing trading stamps, checks, or tickets to the merchants in the police
jurisdiction of the City of Fairhope, Alabama, but not within the city limits
of the City of Fairhope, Alabama, to be distributed among their customers
shall pay an annual license to the City of Fairhope, Alabama, in the amount
of $ 75.00.
C ouncilman Shull moved that the rules be suspended and unanimous consent
be given for im:ediate consideration of and action on said ordinance, which
motion was: seconded by C ouncilman Poser and upon the motion being put to vote
the following vote was recorded;: voting "yes", C ouncilmen: Belew, Berglin,
Poser and Shu l I . Vot i ng "nay"*; None,.
The Mayor thereupon d ecIated that the motion for unanimous consent for
immediate consideration of and action on said ordinance had been unanimously
carried. Councilman Berglin thereupon moved that said ordinance be finally
adopted, which motion was seconded by Councilman Poser and upon said motion
being put to a vote the following vote was recorded: Voting "yes!', C ounc i l—
men: Be I ew, Berglin, Poser and Shull, Voting "no", None.
The Mayor then announced that the motion for adoption of said ordinance had
been unanimously carried and signed the same in approval thereof.

Councilman Shull introduced the following ordinance which was read to the
meeting andheld for further consideration and adoption at
the next regular
meeting of the City Council.

BE IT ()WA I NED BY THE C I TY C OUNC I L OF THE C I TY OF FA I RHOPE, ALABAMA , AS
FOLLOWS. -
SECTION 1. As used in this ordinance the term Civil Defense shall include
measures for the mobilization, organization and direction of the civilian
population and necessary support agencies to prevent, or minimize, the effects
of fire, flood,. eafthquake and epidemic, as well as the effects of a nuclear
war, or any subversive activities against the populace., communities,
industrial plants, facilities and other installations.
SECTION 2, POWERS AND DUTIES. It shall be the dity of the Fairhope Civil
Defense: organization, and it is hereby empowered:
a. To develop a Municipal Civil Defense Operational Survival Plan.
This plan shall provide for the effective mobilization of all
resources of the municipality, both private and public.
b. To prepare and recommend for consideration by the Council ordinances
necessary to implement the Civil Defense Operational Survival Plan.
c. To consider and recommend to the Council for approval,, all Mutual
Aid Plans and Agreements.
d. Other (as may be determined locally)
SECT IION 3. CIVIL DEFENSE DIRECTOR. There is hereby created the Office of the
Fa i rhope C i v i l Defense Director, Such officer shall be normi nested by
the Mayor, and approved by the Council. The Civil. Defense Director
is hereby chargedt
a. To represent the Mayor an all matters pertaining to Civil Defense.
b. Dur.ing periods of emergency to direct the services of all Municipal
C iv i lDefense Forces.
c. To obtain and utilize cooperation of Fairhope officials Fin the
preparation and i;mplemenfation of all Civil Defense Operational
Survival Plans.
d. During periods of emergency to obtain vital supplies and equip-
ment needed for the protection of life and property of people.
SECTION 4, CIVIL DEFENSE ORGANIZATION.
General. Officers and employees of the municipality of Fairhope, with volunteer
forces enrolled, to aid them during an emergency, and all groups, organizations
and persons who make the agreements on operation of law, be charged with duties
necessary for the protection of life and property in the City of Fairhope
Miring an emergency.
SECTION 5. VOLUNTEERS
All persons, other than officers and employees of the municipality, volunteering
in service pursuant to compliance with this ordinance, shall serve with, or
without compensation. While engaged in such service they shall have the same
immunities as persons and employees of the municipality performing simnlar
duties.
SECTION 6. This ordinance: is hereby declared to be an emergency measure,
necessary for the immediate preservation of public business, health and safety,
and it shall take effect immediately. A complete and adequate Civil Defense
Operational Survival Plan will be formulated at once. This plan will be based
upon plans formulated by and. in the Alabama Operational Survival Plan.
SECTION 7. Where provisions of this ordinance are in conflict with existing
local laws, the provisions of this ordinance will govern, and such provision
of existing laws,. with which provisions of this ordinance are in conflict, are
hereby rescinded.
Motion by C ounciIman Belevw seconded by Councilman Poser that Mr. Kirk
be authorized to obtain prices on sub -station fans for transformers. If
price is under $4,000.00 the City Manager and Mr. Kirk are authorized to
purchase same. Motion carried.
Mr. F. G. Smith requested the City to check the draiinage problem on Pecan
Street. The City Engineer was authorized to study the problem and report
at the next meeting of the Council.
A letter from U. S. Land Development Corporation pertaining to the
acquisition by the City of the utility facilities on Pineda Island was read
and discussed. City Manager Niemeyer, Councilman Belew, George Dyson and
Attorney Duck were authorized to negotiate with U. S. Land Development Corp.
Motion by Councilman Shull seconded by Councilman Belew that the following
Resolution be adopted: Motion carried.
BE IT RESOLVED BY THE C ITY COUNC I L OF THE C ITY OF FA IRHOPE, ALABAMA,
AS FOLLOWS:
I. That the City hereby elects to eedeem from Surplus: Revenues on hand
Bonds Nos. 529/553 inclusive maturing February I., 1975 and Bonds Nos.
5!9/526 inclusive maturing February 1, 1974, at par plus accrued interest
pl.us a premium of one year* s interest,
2. That the trustee be and is hereby instructed to pay such bonds when
presented, with funds out of the Surplus Fund of the Natural Gas. System.
3. That Watkins, Morrow and Company be authorized to negotiate with the
Bondholders in an attempt to save the cost of publishing a notice of redemption
but that if such notice: must be published, that said Watkins„ Morrow and
Company, be and is hereby authorized to publish an appropriate notice of
redemption in accordance with the terms, of the authorizing ordinance.
It was duly moved and seconded that the meeting adjourn. Motion ea.rried.

Gentlemen:
The U. S. Land Development Corporation, presently
developing Pineda Island as a residential area near the
City of Fairhope, would appreciate negotiating with the
City of Fairhope for the acquisition by the City of the
utility facilities on Pineda Island. These facilities
are being developed as a water works system owned by the
Alabama Mineral Development Corporation, with the Pineda
Island Sewage Disposal Plant.
