The City Counc i t of the City of F a i rhope me-t in regular session at the
City Hall,, Monday, January 25, 1960 with the following members present:
Mayor E. B. Overton, City Manager C. B. Niemeyer, Councilmen: C. F. Belew,
M. 0. Berglin, W. 0. Poser and B. C. Shull.. Councilman Ruffles being absent.
Motion by Councilman Berglin seconded by Council-ian Shull that the minutes
of the previous meeting be approved as read. Motion carried.
Mr. V alentim protested the rate of interest on paving assessment under Ord.
#e54.
Mr. Leo Meuller of Steele and Associates, presented proposal for cathodic
protection and installation services. Held for next regular meeting of the
C ounc i l .
Motion by Councilman Belew+ seconded by Councilman Berglin that the regular
meeting of the Council on February 22 be postponed to February 29 due to the
Alabama League of Municipalities convention to be held in Montgo-nery on
February 22, 1960. Motion carried.
A letter from Mr. Byrd Moore was read, discussed and made a part of the
minutes of this meet i ng.
Motion by Councilman Poser seconded by Councilman Belew that Earl Howes,
F. P. Buchanon, Raymond Mapleton and Jack Kessler be authorized to sign
warrants or arrests while on duty at the police station. Motion carried.
It was duly moved and seconded that the meet-ing adjourn. Motion carried..

Dear Sir:
Reference is made to our bill in the amount of
$1744.67 for engineering services in connection with
surveys and plans for proposed improvements of sections
of Magnolia Avenue, Bancroft, Johnson and Bellangee
Streets, and it is requested that payment be made at an
early date.
Since the Council has questioned the authority for
this work in the apparent absence of such a motion on
the minute book of the City, the following information
is furnished for your consideration.

1. Excerpt from the Minutes of April 269 1954:
"Mr. Byrd Moore, Engineer, Met with the Council and pre-
sented preliminary plans and specifications for widening
of Bancroft Street to 80'. This was discussed by the
Council and Mr. C. A. Gaston, Secretary of the Fairhope
Single Tax Corporation, It was agreed that the Colony
would deed to the City the additional 14 feet on Bancroft
Street after the Council has met with the property owners
involved concerning the improvements on said property".
2. Copy of letter dated June 30, 1959, signed by
the then Mayor and three Councilmen stating that this
work was authorized and should be paid for.
3. Copy of letter dated Sept. 25, 1956 to Mayor
Overton and Council reminding that this work was done and
should be paid for. This letter may have been mislaid
during the change of administration.

4. Copy of bill dated May 10, 1954 showing that
the payment for engineering services authorized by the
Council on May 10, 1954 was for services in connection
with the Magnolia Beach Area.

5. Copy of bill presented to the City Council under
the date of December 14, 1959.
6. The present Council will remember that during a
meeting or meetings prior to the advertising of Work
under Ordinance No. 254 the status of this work was dis-
cussed and we were instructed to include this work in the
letting of Feb. 23, 1959 as Proposal "B" at the same time
Work under Ordinance No. 254 was to be let. Proposals
for this work were mailed to prospective bidders at the
same time that proposals for Work under Ordinance No. 254
were mailed. The writer was informed by Mr. Niemeyer on
February 16,•1959 that this propasal should be withdrawn
from the letting due to the fact that the Colony objected.

In order to help clear up a matter that should have boon taken care
of Quite sow.time back, we the undersigned, state the following to be facts
to the best of our knowledge:
In March of 1954, an agreement cam reached by the City Government at
that time to have Byrd Moore Engineers to wake the necessary- survey and plans
for the widening, paving, storm sewers,plua curb and stators, on Bancroft St:
including Magnolia. Johnson and Belangee Sts. from Bancroft to Section.
If this agreement was not put in the forty of a notion, voted on and
Glade a part of the minutes of that meeting, it should have been, and we, the
undersigned are deeply sorry for the inconvenience and delay in payment. to tlxs
Engineers, for in all fairness to both the City ct-d Mr. Moore he iR entitled to
his fee for this service.

Dear Sir:
Quite some time ago the City Council ordered
me to make surveys and prepare plans on one block
of Magnolia between Section and Bancroft and on
Bancroft between Magnolia and Morphy. They also
ordered surveys and plans for alley improvements in
the block adjacent to what was the Fuel Oil Supply
Co. The surveys were made and plans started. However,
due to right-of-way difficulties the work was ordered
suspended.
I would like to suggest that my participation
in the work be terminated, that it be ordered that
all survey notes and plans be turned over to the City
and a bill be rendered for these services.

is being held in abeyance until further notice to
proceed.
