County of Baldwin
The City Council of the,City of FairHope met in regular session at the
City Hall, ,Monday, November 9, 1959 with the following members present:
Mayor E. B. Overton, Councilmen: C. F. Below, W. O. Poser, W. R. Ruffles
and B. L. Shull. City Manager. C. B. Niemeyer andC ounc11man M. 0. Berglin
being absent.
1. bt i od by Councilman Be l ew seconded by Councilman Shull that the minutes
of" the previous meeting be approved as read. Motion carried.
Mr. Ryan, representing Fire Equipment Co., Richard Spader, Chief of the
Volunteer Fire Dept. and Members of the, volunteer Fire Department
requested the Council to purchase additi-,nal fire hose and equipment.
Motion by Councilman Belew seconded by Councilman Shull that the City
authorize purchase of- 1,000 ft. of 22' hose., 1,000 ft. I�' hose, 12 helmets
and 10 coats necessary for Fire Department to meet standard of Southeastern
Underwriters Code. The Fire Chief to ask for written bids and lowest bid
be accepted provided -quality meets specifications. Motion carried.
Motion by Councilman Belewr seconded by Councilman Poser that the following
bills be approved for payment: Motion carried.

tAt-. Swearingen of Beebe and Swearingen, Attorneys, presented final bills
for payment as he has accepted a position in New Orleans and the law
office would be closed. The Council requested that the bills be sub—
mitted in Estate of W. C. Beebe.
Motion by Councilman Belew seconded by Councilman Shull that John Duck
be appointed City Attorney effective immediately, to fill the unexpired
term of the late W. C. Beebe. Upon being put to vote the following vote
was recorded: V ot'ng For: Mayor E. B. Overton, Councilmen Belew and Shull.
Voting against: Councilmen Poser and Ruffles. Motion carried.
",potion by Councilman Poser seconded by Councilman Be I ewr that the meeting
adjourn. Motion carriied.

Mr. W.. F. Hawse has consulted ti-As office with re rence to your letter
of October 16, 1959, addressed to Mr. Hawie concerning Inspection of
electrical wiring In the Fdr hope cassino and alleged defects said to
have been found therein.
Voe have before us a copy of your Ordinance # 236 which was furnished to
Mr Hawie along with your letter. We note that your letter fails to set
out any ido rmation to Mr. Hawse as to what defects exist. U ithout this
Information he, of course, its unable to make the necessary repairs to
meet your requirements. Mr. Hawse has stated to us that you went with
him in person to the cassino and he requested that you then and there
furnish him with a memorandum of the defectd to be corrected, which you
refused to do.
Your City Ordinances, of course, are equally binding upon the officials
and employees of the city with respect to any requirements or duties
imposednupKm such official or employee by the ordinance as they are
upon any other persons or activities to which they address themselves.
VVe note that in Section 7 of ordinance #236 the following language "when-
ever existing wiring or apparatus is found to be defective through improper
Installation, or for any other reason that the installation does not .meet
the National lllectrical Code rec., ircments, the City electrical official
shall serve the owner with a memorandum the ects to be corrected.... ".

listing in detail the defects alleged to have been found is to be furnished
to the owner and that after the furnishing of such written memorandum the
owner shall have ten days in which to correct the defects so pointed out
