City Hall, Monday, July 13, 1959 with the following members presents
Mayor E. B. O'verton, City Manager C. B. Niemeyer, Councilmen: C. F. Below
M. 0. Berglin, W. R. Ruffles, Jr. and B. L. Shull. Councilman W. 0. Poser
being absent.
The minutes of the special meeting of July 2, 1959 were read and approved.
Motion by Councilman Shull seconded by Councilman Below that one parking
place be reserved for loading andunloading passengers at the Dixie Hotel
on Fairhope Avenue. Motion carried.
Mr. M. J. Mastin met with the Council pertaining to drainage easement om
h i s property on Sea Cliff Drive.
Motion by Councilman Ruffles seconded by Councilman Shull that the request
of Holland's Drugstore to enlarge warehouse be approved as submitted.
Motion carried.
Motion by Councilman Berglin seconded by Councilman Shull that the bill
of Dixie Laboratories, Inc. in the amount of $1,270.22 for testing and
inspection of materials for Street Paving Program be approved for payment.
Motion carried.
Motion by Councilman Berglin seconded by Councilman Shull that the bill of
Byrd L. Moore and.Co, in the amount of #3,013.36 in connection with Street
Improvements under Ordinance M4 be approved for payment. Motion carried.
Mr. Byrd Moore presented bi l l in the amount of $10744.67 for surveys, plans,
specification and estimates for proposed grading, draining, paving and curb
and gutters: on Magnolia, Bancroft and Johnson Streets. No action taken.
Jack Kirk, Electrical Superintendent, gave a report to the Council on the
generators in the plant. The Mayor appointed Councilman Below, tG§gr§e Dysob,
C. B. N i emeyer & .Jac-k Kirk to get cost of complete , repa i r of generators in
the plant and cost of two new unite for stand by service.
George Dyson requested a new pick-up truck for the gas department, the City
Manager to get cost for next regular meeting of the Council.
Motion by Councilman Shull seconded by Councilman Below that the following
Ordinance be adopted. Motion carried.
Ordinance # 261
AN Ordinance Amending Ordinance #236, OFFICE OF ELECTRICAL OFFICIAL CREATED:
RULES PROVIDED FOR INSTALLATION AND INSPECTION OF ELECTRICAL WIRING AND
OTHER ELECTRICAL APPLIANCE, FOR FIXING PENALTY FOR VIOLATION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAMA as follows:
SECTION i. That Section 5 of Ordinances #236 be and the same is amended to
read as follows:
SECTION 5. Permit. No alteration shall be made in wiring for tight,
heat or power or any additional load be added, other than load for which the
system was designed, to any existing wiring nor shall any building be wired
for electric light, motors, or heating devices without a written permit from
the electrical official. There shall be no charge for permit or first in-
spection provided work or installation is approved on first inspection. If
not approved on first inspection there shall be a charge of 42.50 for each
subsequent inspection until work has been approved.
In the event that an electrical permit is not obtained prior to the time
that the work is actually commenced, in any case where an electrical permit is
required by the provisions of this ordinance then the aforesaid fees for the
electrical inspection shall be charged the permit; provided however that the
provisions of this sub -division shall not apply when the work must be done
immediately because of an emergency, in which event the owner or contractor
shall telephone the office of the electrical official and report the emergency
and the extent of the work to be done and then obtain the electrical permit
within the next twenty-four hours, or if the office of the electrical official
is not open for business then the owner or contractor shalll obtain the elect-
rical sfcfci-miak permit within the next forty eight hours immediately follow-
ing the beginning of the work.
Each air conditioning unit regardless of type shall require an electrical
permit and the frame or cabinet shall be effectively grounded.
Air conditioning units rated over one (l) ton capacity shall operate on
208 volts ors higher.
Motion by Councilman Sergi in seconded by Councilman Selew that the following
bills be approved for payment. Motion Carr-ied.

Dear Ed:
In order to help clear up a matter that should have been taken care
of quite some time back, we the undersigned, state the following to be facts
to the best of our knowledge.
In March of 1954, an agreement was reached by the City Government at
that time to have Byrd Moore Engineers to make the necessary survey and plans
for the widening, paving, storm sewers,plus curb and gutters, on Bancroft St.
including Magnolia, Johnson and Belangee Sts. from Bancroft to Section.
If this agreement was not put in the form of a motion, voted on and
made a part of the minutes of that meeting, it should have been, and we, the
undersigned are deeply sorry for the inconvenience and delay in payment to the
Engineers, for in all fairness to both the City and Mr. Moore he is entitled to
his fee for this service.

Gentlemen:
In connection with the management and operation
of the Dixie Hotel at 312 Fairhope Avenue, I hereby
request one parking space in front of the hotel for the
use of gueats visiting the hotel.
On many occasions, we have experienced a condition
where all of the parking spaces on Fairhope Avenue have
been taken and it is most difficult for patrons and other
persons seeking accomodations at the hotel, to load or un-
load luggage, or otherwise transact their business•
Your approval of this request will be greatly appre-
ciated.

RESOLUTION
WHEREAS, the State Fire Marshall has made inspection of the Casino
in the City of Fairhope and hawing found that it is dangerous to the
public for the same to be kept open for the use of the public;
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
FAIRHOPE, that all license, permits and authority to keep the said
Casino open to the: public be and the same are hereby revoked and annull-
ed and that the said Casino be and is hereby condemned as a public
nusiance and ordered to be closed instants.
IT IS FURTHER RESOLVED that the mayor be and he is authorised and,
directed to cause the Casino to be closed forthwith, and to use all
Legal and proper forces and instruments to close the same, to be closed
forthwith and to prevent the same from being open to the public, unless
and until the same is put in proper state of repair suitable for and
approved for reopening by the State Fire Marshall.
I, Marie Moore, Clerk of the City of Fairhope, Alabama, hereby certify
that the above Resolution is a•true and correct copy of a Resolution
adopted by the Fairhope City C ounciI at a special meeting at the City
Hall in the City of Fairhope on the 2nd day of July, 1959.

This order is in compliance with Title 55, Coder of Alabama 19400
Section 39, etc.
Up= complaint by citizens of this State relative to the hazards of
the above named busInesss, Mr. H. A. Stuart, 'Deputy Fire Marshal to-
gether with Mr. Rr A. Payne, Special Agent, National board of Fire
Underwriters and members of the I'airhope Police, and Fire Department
have Inspected this building as provided by law under Title 55, Code
of Alabama 1940, Section 39. The testimony presented to this Office
indicates that the above ousiness is conducted in such a manner an
to constitute a f ree hazard, which endang*rS life and property. The
wills and fecundation are in such a condition, due to termites and
rotten condi.tion,a.s to wake the building dangerous by wind damages.
It was also found that the wooden fire escapes, installed several
years ago, at our insistence, are in dilapidated and rotten condition
so as to be dangerous and unfit for use, It was noted that several
instances the door hqA been nailed from the inside, making exits
Impossible. Housekeeping in this building was found to be in a
deplorable condition, adding greatly to the fire hazards. This Office
is hereby advising. ends directing;you, upon receipt of this I*tter,
not to use this building for dancing, parties, etc. In the present
condition it is not even safe to use the lower flooruntil certain
hazards have been corrected and ree»inspected by Mr. Stuart of Say
Mines►tto, Alabama.
By and under authority vested in me as Piro Marshal of the State of
Ala am;a$ Title 55, Code of Alabama 1940 and as amended you are hereby
ordered and ditected to carry out this order imsaedi.ateely so that further
