07-02-1959 Special Meeting
The undersigned Mayor and Councilmen of the City of Fairhope waive notice of the calling and holding of a special meeting of the City Council of the City of Fairhope to be held at the City Hall in the City of Fairhope at 7:30 P.M., July 2, 1959, for the purpose of considering the matter of the report of the State Fire Marshall that the Casino in the City of Fairhope is a public nusiance, and for the taking of such necessary and proper action thereon, and agree and consent that said meeting shall be held at said time for such purpose; and we further agree and consent that there may be considered at such special meeting other matters relating to the affairs of the City of Fairhope as shall come before the Council. The City Council of the City of Fairhope, Alabama, met in special session at the City Hall in the City of Fairhope on the 2nd day of July, 1959, at 7:30 otclock P.M. The meet- ing was called to order by E. B. Overton, Mayor, who presided and on roll call the following were found to be present: E. B. Overton, Mayor, Councilmen Charles F. Belew , Marvin n. R'Prglin , Walter 0. Poser , R»ff1PG, Jr. , and BarneyL. Shull , absent: 2�L-,c,v Each member of the Council signed waiver of notice of, and consent to the holding of such special meeting as follows: The undersigned Mayor and Councilmen of the City of Fairhope waive notice of the calling and holding of a special meeting of the City Council of the City of Fairhope to be held at the City Hall in the City of Fairhope at 7:30 P.M., July 2, 1959, for the purpose of considering the matter of the report of the State Fire Marshall that the Casino in the City of Fairhope is a public nusiance, and for the taking of such necessary and proper action thereon, and agree and consent that said meeting shall be held at said time for such purpose; and we further agree and consent that there may be considered at such special meeting other matters relating to the affairs of the City of Fairhope as shall come before the Council. Shull Councilman The mayor stated that a quorum was present and declared the meeting open for the transaction of business. The minutes of the preceding meeting were read and approved. On motion of Councilman_��/" , seconded by Councilman �,,�� the follow- ing resolution was unanamiously adopted: s 1 WHEREAS, the State Fire Marshall has made in- spection of the Casino in the City of Fairhope and having found that it is dangerous to the public for the same to be kept open for the use of the public; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, that all license, permits and authority to keep the said Casino open to the public be and the same are hereby revoked and annulled and that the said Casino be and is hereby condemned as a public nusiance and ordered to be closed instanta. IT IS FURTHER RESOLVED that the mayor be and he is authorized and directed to cause the Casino to be closed forthwith, and to use all legal and proper forces and instruments to close the same,to be closed forthwith and to prevent the same from being open to the public, unless and until the same is put in proper state of repair suitable for and approved for reopening by the State Fire Marshall. Pit No. 2 was found to be Granular Soil Base Course Material, Class 1, Type A. No test reports as to the quality o-f material from the Daphne pit were furnished the Engineers, although the material would definitely fall in the Class 19 Tyyppe A or S clas ification. Dupe to the difference in overhaul, bids were asked for on pits Noo i and No. 2. Until the present time no protests were retistered concernin this action. Since Type i� material is superior to Type 2 our engineers decided to use material from Pit No. 2. Our c ntractor is now at work in Pit No. 2 engaged in clearing and :rubbing ar-d strippin . If for any reason we should be required to move from this pit the contractor would be entitled to at least �400.00 and possibly more for the change. The cost of our project would also be increased Cue to additional overhaul from a more distant pit.
