B. Overton, City Manager C. B. Niemeyer, Councilmen: C. F . Bk,l ew,, W. 0. Poser, V1. R. Ruffles, Jr. and B. L. Shull. Counc i 1- man Berglin being absent. Motion by Councilman Ruffles seconded by Councilman Shull that the following resolution be adopted: Bids for the construction of street improvements provided for by ordinance number 254 and ordinances and resolutions amendatory and supplemental thereto, after due and proper advertisement therefor, were received and opened by this Council at its regular meeting of February 23, 1959, at the City Hall,, being the time and place provided therefor, and the bids were duly and properly entered on the minutes of the said meeting;: And it appearing therefrom that the bid of W. R. Mitchell was the lowest and best bid therefor: NOW THEgEFORE BE IT RESOLVED BY THE CITY C OUNCIL OF THE CITY OF FAIRHOPE: That the bid of W. R. Mitchell in the sum of ONE HUNDRED EIGHTY THREE THOUSAND TWO HUNDRED NINETY SEVEN and 52/100 (0183.297.52) DOLLARS, for the construction of improvements designated as Proposal A,. Alternate B, concrete pipe, be and the same is hereby accepted, and E. B. Overton, as mayor, and Marie Moore, as clerk, be and they are hereby authorized and directed to enter into and execute and deliver in the name of and on behalf of the City of Fairhope, necessary and proper contract vv i th the said'.'!. R. Mitchell; provided, however, it is understood and agreed between the City of Fairhope and the said W. R. Mitchell that the said contrrct shall not go into effect and be binding on the City of Fairhope unless and until the City of Fairhope shall obtain funds for the payment of such construction by the issuance of bonds on such basis as shall be satisfactory to it, and in the event such funds shall not be obtained on a basis satisfactory to the -City of F Tirhope, then such contract shall be null and void and of no force and eff-c t.
