HomeMy WebLinkAbout09-22-1958 Regular MeetingSTATE OF ALABAMA County of Baldwin The City Council of the City of F a i-rhope met in regular session at the City Hall„ hlonday,,Septembe.r 22, 1958 with the following members present: Mayor E: B. Overton, city Manager C. B. Niemeyer, Councilmen: C. F. "lelew, M. 0. Berglin, W. 0. Poser, W. R. Ruffles and 0. L. Shtllll. The minutes of the previous regular meeting were read and corrected and on motion by Councilman Belew were approved as corrected. Motion carried. Councilman Shull introduced the following resolution which was read to the meeting: WHEREAS, this being the day and time set for hearing and considering protest in the matter of Street improvements under Ordinance Number 254, adopted on the 14th day of July, 195B, and the City Council having called such matter for consideration and protests having been filed with this council, this council is of the opinion that further consideration should be given to such matter;. NOW THEREFORE, BE IT RESOLVED that Councilmen 'NiIIiam Ruffles and B. L. Shull and C. B. Niemeyer, City Manager, be and they are hereby appointed a committee to consider the question of making the improvements under the, said ordinance and to report their recommendation to this council at its next regular meeting to be held October 13, 1958, and the further consider— ation of this matter is continued to the said next regular meeting. Councilman Shull moved that the foregoing resolution together with the preamble thereto be adopted, which motion was seconded by Councilman Belew, and upon vote being taken thereon the following vote•was .recorded: Yeas: Mayor Overton and Councilmen Belew, Berglin, Poser, Ruffles, and Shull; Nays: None. The /.tiayor therupon announced that the motion for the adoption of the foregoing resolution had been unanimously carried and the said resolution was duly adopted. i Councilman Ruffles requested that a•committee be appointed to check the possibility of handling drainage in an overall program. The Mayor appointed Councilmen Ruffles and Shull and City Manager Niemeyer as committee. Dr. (-. A. Gaston of the Fairhope Single Tax Corporation and Mr. Claude Arnold, Engineer, presented.plans and Specifications fer resurfacing Fair — hope Avenue from Church Street to Section Street and installing 7" curb. Motion by Councilman Shull seconded by Councilman Belew, that the Colony be authorized to proceed with the %cork as per plans and specifications. motion carried. Motion by Councilman Poser seconded by Councilman Shull that Zoning Ordinance §231 be ammended as follows: Property lying on the South Side of Morphy Avenue immediately east of the Methodist Church property and extending to School Street be rezoned from R-2 to B-2. Motion carried. A letter from Mr. A. E. Schermer refusing reRppointment to the Adjustment' Board was read and appointment to this Board was held for next regular meeting of the City Council. A letter from Mr. C. C. Baldwin was read and held for further study. Motion by Councilman Ruffles seconded by Councilman Shull that the City donate electricity to the Teen Canteen. Motion carried. Request to change name of Miller Street to Mimosa,Hill was read and on motion by Councilman Poser seconded by Councilman Ruffles the request was, rejected. Motion carried. Motion by Councilman Poser seconded by Councilman Belewthat the City order Sam Browne Belts for the Auxiliary Police. Motion carried. The date of issue of the Water, Sewer & Gas Revenue Warrants is to be changed to December 1, 1958. 2. The amount of the issue is to be increased from $150,000 to $200,000 and the Warrants are to mature $15,000 on December 1 in each of the years 1959/1970, inclusive, and $20,000 in 1971. 3. The interest rate on the Warrants is to be 4 1/2%. The aforesaid contract is to remain in force in all other respects. CITY OF FAIRHOPE, AIABAMA BY V Mayor ATTEST: ty Clerk AGREEMENT between the CITY OF FAIRHOPE, a municipal corporation organized under the laws of the State of Alabama (hereinafter called the "City") and WATKINS, MORROW & COMPANY (hereinafter called the "Bankerll) R E C I T A L S WHEREAS, the City wishes to authorize and issue approximately $100,000 General Obligation Public Improvement Bonds for paving purposes, and WHEREAS, the Banker has had many years experience in handling such matters. NOW, THEREFORE, THIS AGREEMTNT WITNESSETH: The Banker accepts employment as set forth herein and agrees to use his best efforts in connection therewith. The Banker agrees: 1. To furnish to the City, without cost, all ordinances, resolutions, etc., which may be necessary to legally authorize said bonds. 2. To furnish, without cost to the City, bond blanks and the approving legal opinion of recognized bond attorneys. 3. To pay the cost of legally advertising the bonds for sale. 4. To prepare pertinent information for prospective bidders. The City agrees: 1. To adopt all ordinances, resolutions, etc., which are required by the attorneys for the legal issuance of the bonds. 2. To pay to the Banker, simultaneously with the delivery and payment for the bonds, a fee equal to 2 1/2% of the principal amount of bonds issued. In the event no bonds are sold, the City will owe the Banker nothing for his expenses and services. IN TNESS I IEREOF, the parties hereto have set their hands and seal this L1.2A:�tkday of , 1958.
