The City ;ouncil of the City of Fairhope metin regular session at the City
Hall, Monday, September 8, 1958 with the following members present:
Mayor E. B. Overton„ City Manager C. B. Niemeyer, Councilmen: C. F. Below,
M. 0. Bergl in, W. 0. Poser, �/. R. Ruffles, Jr. and 3. L. Shull.
Motion by Councilmen Ruffles seconded by Councilman Shull that Eloise T. Wilson
be appointed as acting clerk during the absence of Marie Moore, City Clerk.

Moticn by Councilman Ruffles seconded by Councilmen Poser that the minutesof
the previous meting be approved cs read. Motion carried.
Byrd L. Moore and T. H. Ingram of Moore Engineering Company were present to
explain the engineering features of the proposed street raving proeram. The
following verbal protests were entered..

The following ordinance was introduced by Councilman Ruffles and was
read to the meeting:
BE IT ORDAINED by the City Council of the City of Fairhope, Alabama
as fo l I ows:
Section 9 of Ordinance No. 251.E of said city which was adopted by the
city council, iof said city on July 14, 1958, as the same was heretofore
mended by an ordinance adopted by the city council of said city o'N July 31,
1.958, be and the same hereby is further amended so that the said section shall
read in its entirety as follows:
'Section 9. That the city council of the pity of Fairhope,
Alabama meet at 7:CO o'clock, P. M. on the 22nd day of September, 1958, at
the city hall, for the purpose of hearing, and at which time it will hear any
objections or remonstrances that may be made as to the street improvement,
the manner of making the same, or the character of materials to be used.'
Councilman Ruffles moved that the foregoing ordinance be adopted, which
motion was seconded by Councilman Shull, and upon the motion being put to vote
the following vote was recorded: Yeas: Mayor Overton and Councilmen Belew,
Berglin, Poser, Ruffles, and Shull; and the following voted Nay;: None. The
h�uyor thereupon declared that the motion for the adoption of the said
ordinance had been unanimously carried and the ordinance, duly adopted."
Motion by Councilman Ruffles seconded by Councilman Shull that the application
for building permit of R. D. Hanby be approved. Motion carried.
No action was taken on the application for building permit by Jos. D. Bemis
as his property is located outside of the City Limits..
Deed received for a 50 foot street right of way between Jan Drive and Gayfer
adjacent to Lot 34, Fairwood Subdivision No. 6 from Robert Nahrgang. Motion
by Councilman Shull seconded by Councilman Poser that Mr. Beebe be authorized
to withdraw the condemnation suit against Lot 18, Fairwood Subdivision.
Motion carried.
Letter from the Junior Chamber of Commerce regarding the lift station at the
Beach Skating Rink was turned over to Councilman Shull.
Nomination of Irving Kamper to fill the unexpired: term of Romeo E. Simpson
on the R ecrreation Board was made by C ouncilmcn BeIew, seconded by Councilman
Poser. Councilman Shull moved that the nominations be closed and Mr. Kamper
be elected unanimously. Motion carried. The Clerk was requested to notify
Mr. Kamper of his election and advise him that the Recreation Board meets
September 15.
A1r. Dyson reported that C. B. Cummins made an oral bid of around $150.00
for repairs on Municipal Clinic roof. Mr. Dyson was instructed to request
a; written bid from Mr. Cummins and authorize him to proceed with the work.
Motion by Councilman Poser, seconded by Councilman Bel.evw that the follow—
ing bills be approved for payment. Motion carried.

declared that the other provision which might be held invalid.
SECTION 19. This ordinance shall be known and designated
and shall be sufficient to refer to the same as the "Fairhope
Beer Tax Ordinance" of September 1, 1958.
SECTION 20. This ordinance shall 3o into effect and be
operative on and after September 1, 1958.
SECTION 21. Ordinance No. , Entitled "An ordinance
to regulare the sale, distribution and consumption of -malt and
brewed beverages, as defined in the Alabama Beverage Control Act,
in the City of Fairhope and within the police jurisdiction thereof;
to require a permit before engaging in business as a wholesaler,
distributor, jobber or retailer of such malt or brewed beverages;
to provide a license tax thereon and to enforce the provisions of
this ordinance and to provide for a penalty for its violation,"
adopted on the _ day of , 19 , as amended by Ordinance
