County of Baldwin
The City Council of the City of Fairhope met in regular session at the
City Hall, Monday, August II, 1958 with the following members present::
Mayor E. B. Overton, City Manager C . B. Niemeyer, Councilmen: C. F.
Belew, M. 0. Berglin, W'. 0. Poser, Wml R. Ruffles, Jr. and B. L. Shull.
Motion by Councilman Shull seconded by Councilman Berglin that the
minutes of special meeting be approved as read. Motion carried.
Motion by Councilman Belew seconded by Councilman Shull that the ap plica-
tion for building permit of A. E. Schermer be approved as submitted
subject to letter from Mr. Schermer agreeing to remove ramp all over 19
feet in width on Bancroft Street at the request of the City Council..
Motion carried.
Motion by Councilman Shull seconded by Councilman Ruffles that the
application for building permit of L. S. Masters be approved as submitted.
Motion carried.
Motion by Councilman Poser seconded by Councilman Berglin that the
application for building permit of T.J. Davidson, Jr. be approved as
submitted. Motion carried.
Motion by C ouncilhnan Berglin seconded by Councilman Belew that the
application of A.M. Gates for building permit be approved as submitted.
Motion carried.
It was agreed by the Council that the•sale of beer at the Fairhope
C as ino be -confined to downstairs Restaurant only and that four parking
spaces on the East side of Casino be made available for customer parking.
Motion by Councilman Berglin seconded by Councilman Poser that the follow-
ing bills be approved for payment. Motion carried.

We hereby agree to purchase from you at par plus accrued interest and you agree to sell to
us approximately $150,000 Water, Sewer and Gas Revenue Warrants of the City. Such warrants
are to be dated January 1, 1959, are to pay interest semi—annually on January 1 and July 1,
are to bear interest at the rate of 4� (four) per annuls, are to be payable at a bank or
trust company to be designated by us and are to mature as follows:
Approximately $15,000 on January 1 in each of the years 1960/1969,
inclusive.
Such warrants are to be payable solely from a sufficient amount of the available surplus
earnings from the Natural Gas System of the City and the Water Works and Sewer Systems
operated by the Water Works & Sewer Board of the City.
t:e agree to furnish without cost to the City the approving legal opinion of Messrs. White,
Bradley, Arant, All & Rose, or other recognized bond attorneys; to furnish all resolutions,
contracts, indentures of trust, ordinances, etc., which may be required in the legal issu—
ance and sale to us of the warrants. We also agree to furnish suitable warrant blanks.
In consideration of our agreement to purchase, our time and expenses, you are to pay to us
the soon of 2 1/2% of the principal amount of warrants issued. Such expense allowance shall
be paid to us simultaneously with delivery and payment for the warrants.
You are to pay for any local legal expense. In the event that no warrants are issued, we
are to receive no allowance for expenses whatsoever. Such offer to purchase is subject
only to the unqualified approving legal opinion of the recognized bond attorneys herein —
above described.
