County of Baldwin
The City Council of the City of Feirhope met in regular session at the
City Hall, Monday, July 28, 1958 with the following members present:
Mayor E. B. Overton, `-ity Manager C. B. Niemeyer, Councilmen: C. F. BeIevi
M. 0. Berglin, W. 0. Poser,"i. R. Ruff l#-s and B. L. Shull.
The minutes of the previous regular meeting were read and on motion by
Councilman Berglin seconded by Councilman Belew were approved as read.
Mr. Roy Moyers, representing the "later and Sewer Boprd and Mr. George Dyson,.
Superintendent of the Water and Sewer Department, met with the Council in
regards to financing sewer extensions within the Ci+y. The C oLnciI instructed
the City Manager to contact ?lntkins-Moorow and Co. concerning the above•.
Potion by Councilman Berglin seconded by Councilman Shull that the application
for buildino permit of Baldwin County Savings and Loan be approved. Motion
carried.

Dump Trucks at u cost of i'?3,237.46 each. Notion carried.

AS FOLLOWS:
SECTION 1. That as and for the grade of the streets, avenues, alleys,
highways and other public places to be improved under "Street Improvement
Ordinance of the 04th day of July, 1958, numbered 254.", there be and is
hereby fixed and established the grade as heretofore fixed and established
for this respective streets, avenues, alleys, highways and other public
places to be improved.
Duly adopted by the City C ounc i I of the City of F., i rhope, A laba^la,
at a meeting thereof regularly held on the 28th day of July, 1958.

Councilman Poser moved that unanimous c-m sent be given for the immediate
consideration of the foregoing Ordinance No. 255, which motion was
seconded by Councilman Shull, and upon the motion being put to vote
the following vote was recorded: Yeas: Mayor Overton and Councilmen
Belew, Berglin, Focer, Ruffles and Shull; and the following voted nay:
None. The mayor thereupon declared that the motion for the granting
of unanimous consent for the immediate consideration of the said Ordinance
had been unanimously adopted.
Councilman Poser moved that the foregoing ordinance be adopted, which
motion was seconded by Councilman Shull, and upon the motion being put
to vote the following vote was recorded:' Yeas: Mayor Overton and Council-
men: Belew, Berglin, Poser, Ruffles and Shull: and the following voted
Nay: None. The Mayor thereupon declared that the motion for the adopt-
ion of the said ordinance had been unanimously carried and the ordinanz
duly adopted.
Motion by Councilman Berglin seconded by Councilman Belew that the meet-
ing adjourn. Motion carried.

THE CITY OF FA �RHWE, ALAGAVA, or its duly authorized representative,
party of the first part, (hereinafter called the City), and BYRD L.
MORE AND CO*'rAN''Y, party of the second part, (hereinafter called the
Engineer).
W I T H E S S E T H$
tIX::REAS, the City is desirous of constructing and improving
public facilities ac follows$ Grade, drain, pave and construct curb
and gutters on streets, alleys and miscellaneous areas as designated
by the City, and
%VHEREAS, it has been agreed between parties hereto that the
City retain the Laid Byrd L. Moore and company in the capacity of
Engineer for the purpose of making surveys and invertigations,
preparing plans, arecificat'ons and estimates of cost and furnishing
engineering supervision for said designated projects] also such
consulting cervices as may be desired by the City;
110:1, THEREFORE, in consideration of the pre -raises, the
mutual covenants herein contained and the sum of One Dollar (31.00)
by each of the parties to the other in hand paid, the receipt whereof
If hereby acknowledged, the parties hereto agree as folloris$
Article 1, The Engineer agrees to provide engineering
services cnd consultation for said designated projects as follows$
A. make such preliminary investigations, studies, estimates
of cost, reports, and recom-nondntions for the project or projects
involved as necessary.
B. Mako field surveys and prepare detailed plans and
specifications for construction together with estimates of quantities
and costs; as soon as completed, furnish the City five (5) coFies of
all plans, detail drawings, spocificrtions end estimates of quantities
and costs covering the project or projects involved.
C. Prepare proposal forms, notice to bidders, end aesist
the City in securing bids. Make recommendations to the City, based
on an analysis of bids, concerning the award of contract„ and
recommend concerning tho relative merits of matoriais.
0. Furnish consultation advice and supervision of construc-
tion . including line and grade surveys. Prepare and recommend
approval of e.stirates of material furnished and work cone by the
contractor for the contractor's monthly and final payments. Prepare
assessment rolls and record drawings for the City if any are roquired.
Make final inspection and report at the co-pletion of the project or
projects.
Article II& It is hereby mutually agreed between the parties
horefo that the City will pay to the Engineer.for'seirvicoe rendered
in accordance with Article 10 above an amount oc,unl to ten percent
(10,.) of the actual cost of construction, and payment shall be made
as follows$
Upon completion of surveys, plans and specification as
stipulated under paragraphs A and B of Article I, an a -mount equal to
fifty percent of the base fee as determined by the Engineer's estimate
of cost, will be paid to the Engineer. The bnlrnce of the base fee
witl be paid to the Engineer at the completion of construction of the
project or projectol interim payments on the bose feel will be made
as agreed to by the City and Engineer
Article III Arbitration Cleuse
This contract is limited to and shall expire upon the
completion of the improvements of the streets covered by that certain
street improvement ordinance adopted July 14, 1958.
