B. Overton, C i ty Manager C . B. N i emeyer, C ounc i I men: C . F. Belew, M. 0. Berglin, W. 0. Poser, W. R. Ruffles and B. L. Shull. Motion by Councilman Berglin seconded by Councilman Belew that the minutes of the previous regular meeting and special meeting be approved as read. Motion carried. Motion by Councilman Poser seconded by Councilman Belew that the Council; authorize additional expenditure of $71t.35 making a total of $5711.35 for bulkhead: at Fly Creek. Motion carried. Motion by Councilman Berglin seconded by Councilman Poser that the City run gas line in center of Block 4, Hedge Villa Sub -division as request- ed provided a 15 foot right-of-way is deeded to the City„ the owner to bear cost df line. Motion carried. Motion by Councilman Belew seconded by Councilman Shull that the building permit of McAdoo Parmar be approved as submitted. Motion carried. Motion by Councilman Berglin seconded by Councilman Shull that the. permit of J. W. Burton be approved as submitted. Motion carried. Councilman Ruffles introduced the following Ordinance: ORDINANCE NO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, A--ABAKA: SECTION ONE: Whereas, the harbor at Fly Creek within the corporate limits and police jurisdiction of the City of Fairhope has been improved by the United States Government at the instance of the City of Fairhope, and the City of Fairhope owns lands butting on such harbor, and as a condition for the improvement of such harbor the United states Government requires a municipal authority to provide and maintain without cost to the United States Government, mooring facilities and utilities, including a public landing, suitable supply facilities, open to all on equal terms, provide parking area and an all-weather access road to the public harbor facilities, maintain the existing timber jetty, and establish a competent and properly constituted public body empowered to regulate the use, growth, and free development of the harbor facilities with the understanding that the harbor facilities will be open to all on equal terms; I40W THEREFORE, the City of Fairhope being thereunto duly authorized and empowered under the laws of the State of Alabama, does hereby take and assume full jurisdiction, power and authority over the harbor at Fly Creek and will operate and maintain such harbor and will provide and maintain, without cost to the United States, necessary mooring facilities and utilities, including a public landing with suitable supply facilities open to all on equal terms; provide a parking area and an all-weather access road to the public harbor facilities; maintain the existing timber jetty; and will regulate the use, growth, and free development of the harbor facilities with the purpose and to the end that said facilities will be open to all on equal terms. Councilman Shull moved the suspension of the rules that the Ordinance.? could be put upon its immediate passage, which motion having been second— ed by Councilman Rufflesp was put upon its: passage with the following result: Voting for the same, Mayor Overton and Councilmen: Belew, Berglin, Poser, Ruffles and Shull, Against, None. Whereupon Mayor Overton declared the vote unanimous and the rules suspended. Councilman Shubl moved that the Ordinance be adopted and the same having been seconded by Council man Poser the Ordinance was put upon its final passage with the following results: Voting for: Mayor -Overton, C ouncilmenL Belew, Berglin, Poser, Ruffles and Shull. Voting against, None. The Mayor then announced that the motion for adoption of said Ordinance was unanimously carried. Councilman Ruffles introduced the following Ordinance which motion was seconded by Councilman Berglin. r ORDINANCE NUI�,BER S Z BE IT ORDAI.ED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE, ALABAI•iA: SECTIO11 OIdE:, There is hereby created and established a T•:unicipal Harbor Board to consist of three members to be selected by the City Council for such terms as the City Council shall designate at the time of their selection, and who shall have such duties, powers, and authority under such restrictions and limitations, as are provided in this ordinance or as may be here- after provided in any subsequent ordinance or resolutions of the City Council. SECTION T1,0: The Uminicpal Harbor Board herein provided for shall be and is hereby given and charged with the maintenance, management, and operation of the Fly Creek Harbor as the agents and representatives of the City of Fairhope, and shall have and exercise, subject to the approval of the City Council, any and all powers and authority necessary and proper to the management, operation and maintenance of such harbor; and specifically they are charged with and directed to, as rapidly as possible, provide and maintain, without cost to the United States, necessary mooring facilities and utilities, including a public landing with suitable supply facilities open to all on equal terms; provide a parking area and an all-weather access road to the public harbor facilities; maintain the existing timber jetty; they are empowered to regulate the use, growth, and free development of the harbor facilities with the purpose and to the end that said facilities shall be open to all on equal terms. SECTIOI: THREE: The municipal harbor board and the members thereof, in addition to the power herein given and required of them, shall also have and exercise, do and perform any and all other things that shall hereafter be required of them by ordinance, resolution, or other valid action of the City Council and shall at all times be subject to action of the City Council. The service of them or either of them or their successors may be terminated by the City Council with or without cause at any time. SFCTIOIv FOUR: There are hereby selected as the first members of the Municipal Harbor Board created by this ordinance for the term set opposite their respective names,the following persons: /f?'a� for the term of for the term of for the term of SECTION VE: The members of the Harbor Board ereby created shall serve without compensation, but subject to the approval of the City Council may draw their reasonable expenses incurred in the performance of the duties required by this ordinance, and From time to time shall draw such compensation for services as shall be provided or allowed by ordinance, resolution or other appropriate action of the City Council. SECTION SIX: This ordinance shall be known and may be cited as the Fairhope Municipal Harbor Board Ordinance. i J f• r� s� r, r r r Motion by Councilman Ruffles seconded by Councilman Poser that rules be suspended and unanimous consent be given for immediate consideration of and action on said Ordinance and upon being put to vote the following vote was recorded= Voting for: Mayor Overton, Councilmen: Belew, Berglin, Poser, Ruffles and Shull; Against, None. The Mayor thereupon declared that the motion for unanimous consent for immediate consideration of and action on said Ordinance had been unanimously carried. Councilman Shull thereupon moved that the Ordinance be finallly adopted which motion was seconded by Counciiman Belew and upon being put to vote the following vote was recorded: Voting for, Mayor Overton, C ounciImen: Belew:, Berglin, Poser, Ruffles. and Shull. Against: None. The Mayor thereupon declared the Ordinance unanimously adopted. Motion by Councilman Berglin seconded by Councilman Ruffles that the City appropriate $196.89 to the Volunteer Fire Department. Motion carried.
