COUNTY OF BALDWIN
The City Council of the City of Fairhope met in regular session ail the
City Hall, Monday, May 12, 1958 with the following members presents
Mayor E. B. Overton, City Manager C. B. Niemeyer, Councilmen: C. F.
Belew, M. 0. Berg Iinp W. 0. Poser, W. R. Ruffles, Jr. and B. L. Shull.
Motion by Councilman Berglin seconded by Councilman Shull that the
minutes of previous meeting be approved as read. Motion carried.
A committee representing property owners of a portion of Pinecrest Lane
presented a petition for paving the unpaved section of Pincrest and
their consent to annexation of this property by the City.
Motion by Councilman Belew seconded by Councilman Shull that the street
committee work with Dr. Gaston and .the committee from Pinecrest Lane
to draw up legal description of ,property and present it to the C ouncili.
Motion carriied.
Motion by Councilman Poser seconded by Councilman Shull that the City
remove two dead trees from the Christian Church lot. Motion carried.
Mr. George Fuller, Jr. and Mr. David Fuller requested the C ouncil to
install natural gas at Spanish Fort Estates„ 2nd. Addition. The
Council agreed to install gas at the expense of Spanish Fort Estates,
refund of 4100.00 to be refunded on each house connected to and using
gas until cost of line has been refunded.
(Motion by Councilman Ruffles seconded by Councilman Shull that letter

of the Fairhope Single Tax Corporation be made a part of the minutes of
this meeting and that the City adopt a policy that major projects be
undertaken at the expense of the owners benefitted. Motion carried.)
Motion by Councilman Shull seconded by Councilman Belew that the City
accept drawing and specifications of the Fairhope Single Tax Corporation
for drainage project on Bancroft Street and that copies be placed on
file. Motion carried.
Motion by Councilman Shull seconded by Councilman Ruffles that Zoning
Ordinance #231 be ammended as follows: Motion carried.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE:
Section G. Be it remembered that hereto the City Planning Commission
of the City of Fairhope, did, on the 2nd day of May, 1958, acting on
its own initiative, after a public hearing thereon, of which due and
proper notice was given as required, approve and recommend to the
Council that boundaries of the zoned districts of the City of Fairhope
be rearrm ged and designated and established as shown on and by that
certain zoning map dated April 15, 1-938 and mailed exhibit B, filed
herewith.
Section 2. That Section 13 of Zoning Ordinance#231 duly adopted on
the Ilth day of October, 1954 be and the same is amended to read as.

Section 13 District Boundaries
All property north of Lot A and North of B. 1. Reynold's Business
extending North to City Limits lying West of Highway 98 to Mobile Bay
be rezon=-d from B-3 and R-2 to R-1 as per attached plat. Motion carried.
Motion by Councilman Ruffles seconded by Councilman Shull that the
following bills be approved for payment. Motion carried.

Gentlement
Pine Crest Lane extends from the City Limits for a distance of a pproximately 450 feet
in a southeasterly direction to Its termination at Church Street. This stretch is
presently unpaved and it slopes sharply downward from the Church Street and toward
the paved section withing the City Limits. Each time there is a heavy rain,large
quantities of the street surface material are washed down hill,creating a nuisance
to the residents within the City Limits.particularly at the corner of Pine Crest
and Litberty Street. Paving this short unpaved section would,therefore,not only
improve the street for the abutting property owners,but would likewise eliminate
a present nuisance to the Cityy and to the residents on the presently paved section,
and possible prevent a future situation similar to that now existing on Fig Street.
We ,the undersigned owners of all property abutting the presently unpaved section
of Pine Crest Lane,from the City Limits to Church Street,hereby consent to annexation
of our property by the City of Fairhope,and agree to accept a paving #7" a ssessment
not exceeding # 3.00 per front foot,payments to be spread -over a period of five years,
to cover the cost of grading,paving and gutters of the same type as the presently
paved section of Pine Crest Lane within the City Limits,on condition that the
City of Fairhope ubdertake the pavi g project immediately(without waiting completion
of formal annexation proceedings) and agrees to complete paving by September 1,19%
Failure of the City of Fairhope to Start pavin ugust 1,1958 shall void this
consent to annexation and acceptant ssessment.

Gentlemen:
At the regular meeting of our Executive Council May 1
bids on the Bancroft St. drainage project were received from Joe
Schneider & Son, Cargile Construction Co. and J. E. Woolley, with
Joe Schneider & Son making the low bid. The plans were prepared
by Eng. C. W. Arnold and as submitted to you earlier this year.
As stated in our letter to you March 5 the Colony is
willing to pay the full cost of such projects where its lands only
are involved, provided the City gives some assurance that like
projects benefitting other land owners will not be undertaken by
the City except at the expense of the owners benefitted. If the
Colony is so assured by the City, and authorization for this pro-
ject is given, the Colony will consider a contract with the low
bidder to proceed with the work. Our cost plus engineering fee
will be $11,164.39•
We are sure you will appreciate our position with refer-
ence to the question of whether such projects are financed by land
owners or the City. Approximately 60% of the City's property tax
revenue comes from the area where the Colony owns the land. Prob-
ably other City revenues are in the same or greater proportion.
Certainly the latter is the case with respect to business licenses.
If such projects are paid for out of general City revenue, where
other than Colony land is benefitted, the Colony and those occupy-
ing its lands would be contributing the major part of the cost.

Dear Sir:
Please be advised that this office represents
Mrs. Ann T. Miller and her husband, D. Ogden Miller,
200 North Waldran, Memphis, in their claim against the
City of Fairhope, Alabama, for personal injuries and
medical expenses respectively.
Our investigation reveals that on the evening
of October 24, 1957, Mrs. Miller, in the company of others,
was proceeding on foot across the school grounds of Fairhope
Senior High School to the Stadium for a scheduled football
game. In so doing, she stepped into a hole approximately
18 inches deep which had been carelessly and negligently
left unfilled, and without any warning device whatsoever,
and which was partially obscured by grass. She has
received medical treatment for the resulting injury to her
left leg, and continues treatments under a Memphis specialist
at this time. We are unable to advise you completely of
the full medical expenses to date, but will do so, in
itemized form, shortly.
It is our contention that the aforedescribed injury
was directly and proximately caused by the neglect,
carelessness and/or unskillfulness of an agent and/or employee
of the City of Fairhope while engaged in his duty and
employment. Accordingly, we wish to make notice of claim
for personal injuries under the requirements and in the time
set forth in applicable Alabama Code sections.
We are preparing, to be forwarded immediately,
a sworn statement of the pertinent facts, as required, for
Honorable E. B. Overton Page 2 April 22, 1958
filing with the Clerk, after which time we will be pleased
to discuss these claims further with your representative
at his convenience.
