The City Council of theCity of Fairhope met in regular session at the
City Hall, Monday, April 14, 1:956 with the following members present:
Mayor E. B. Overton, City Manager C. B. Niemeyer, Councilmen: C. F.
Belew. M. 0. Berglin, W. R. Ruffles, Jr. andB. L. Shull.
Mayor Overton offered the following Resolution which was seconded by
Councilmen Berglin and adopted unanimously by the City Council:
WHEREAS, Jbhnnie F. McDaniel departed this life on the 9th day of
April, 1958; and
WHEREAS, Johnnie F. McDaniel was a member of the City Council of
the City of Fairhope from October 11956 to the date of his death; and
WHEREAS. 4ohnnie F. McDaniel, served this Council, untiringly,
efficiently, effectively, unselfishly and honorably, sparing not his
time or talent;
NOW THEREFORE, BE IT RESOLVED that this City Council and its members
individually deeply regret his untimely death and the resultant loss of
his service to the public;
BE IT FURTHER RESOLVED, that a copy of this resolution be published
in the Fairhope Courier and The Southerner, that a copy be filed in the
minutes of the City Council and a copy be sent to hits bereaved family.
Motion by Councilman Belew seconded by Councilman Berglin that the minutes.
be approved assread. Motion carried.
Motion by Councilman Ruffles that the City appoint a committee to work
with the Coliony on Fig Street Project. No action taken.
Motion by Councilman Berglin seconded by Councilman Belew that Mr.
Cowen be granted permission to plant shrubbery on City park property
adjoining his property on the East, all shrubbery to become City property.
Motion carried.
Councilman Shull nominated Tommy Cotten for appointment to the Recreation
Board to fill the unexpired term of Mr. George Page who recently resigned-.
There being no other nominations Councilman Belew moved that the nominations
be closed, motion seconded by Councilman Ruffles. Upon being put to vote
the following vote was recorded: Voting Yest Mayor Overton, Councilmen:
Belew:, Berglin, Ruffles and Shull. Voting No, None. The Mayor thereupon
declared Tommy Cotten unanimously elected to the Recreation Board.
Motion by Councilman Ruffles seconded by Councilman Shull that Mr. H. W.
Sullivan be appointed over—all Director to take full charge of theGolden
Jubiliee C t4ebration and that he be allowed up to $50.00 for miscellaneous
expense. Motion carried.
Motion by Councilman Berglin seconded by Councilman Belew that the final
bile of Mr. C. B. Cummins for City Jail be approved for payment. Motion
carried.
Motion by Councilman Kuffles seconded by Councilman Berglin that the
following bills be approved for payment? Motion carried.

Dear Mayor Overton:
We want to thank you for sending us a copy of your letter
to the Board of County Commissioners. We note your comment about
paving outside the City limits. Our understanding is that neither
the City or the Colony is paying for the paving of Fig St. The
$16,033,20 is primarily for drainage facilities needed, in large
part, to carry off surface water drainage originating inside the
City limits. It does not include any charge for paving.
We note in the 1907 Political Coda of Alabama, Section
1359 of Article 26, setting forth the powers of municipalities to
construct and maintain public improvements and betterments lists
the power " to lay out, establish, and define storm water and san-
itary districts, or either, and to provide for the drainage there-
of, and to build or construct or rebuild or reconstruct outlets
for such sewer or sewer systems, either within or without the cor-
porate limits."
The section further provides that the City may "cause
the cost and expense of all or any part of the aforesaid work;, and
improvements to be assessed against the property abutting on said
street, 9 A * * * * * * * *, drained by said sewer or sewers to
the extent of the increased value of such property by reason of the
special benefits derived from such improvements," However, we ap-
preciate that such proced1hre is hardly practical in this case. It
would appear to us though, that there is no question of the City's
authority to make the necessary expenditure.
With respect to the inability so far, to secure any offer
of participation from the property owner on the south side of Fig
St, west of Liberty, we do not feel the work should be held up on
that account. That property drains to the south and west. While
the drainage structures will protect it from erosion to some ex-
tent, it cannot be drained thereby. As we see it the City is get-
ting these drainage facilities for considerably less than cost and
it is not being asked to pay any part of the paving cost. We un-
derstand some land owners outside the city, receiving direct bene-
fit have offered to share the City's cost and we hope action will
be taken now while there is prospect of getting State and County
aid.
