October 14, 1957 with the following members present: Mayor E. B. Overton, City Manager C. B. Niemeyer, Councilmen: C.F. Below, M. 0. Berglin, J. F. McDaniel, Wm. R. Ruffles, Jr. and B. L. Shull. Motion by Councilman McDaniel seconded by Councilman Berglin that the minutes of the previous meeting be approved as read. Motion carried. Motion by Councilman Berglin seconded by Councilman Shull that the following Resolution be adopted: Upon being put to vote the following vote was recorded, For: Mayor -Overton, Councilmen: Below, Berglin, MdDaniel, Ruffles & Shull. Against, None. Motion carried Unanimously. WHEREAS, the City of Fairhope, in consideration of the release by the Fairhope Yacht Club to the City of Fairhope its twenty year lease hereto- fore given to the Fairhope Yacht Club by the City of Fairhope of those lands easement over which was given to the Unit4ld States of America for a boat channel, by that certain instrument dated May 28, 1957 recorded in the office of the Judge of Probate of Baldwin County, Alabama in Deed Book 255 at page 211, and in further consideration of the sum of 15.00 to it in hand paid by the Fairhope Yacht Club has agreed and bound itself to convey to the Fairhope Yacht Club all that portion of Lot A of Seacliff Subdivision as per map thereof recorded in the office of the Judge of Probate of Baldwin County in Deed Book 7 NS, pages 90-1, lying South of the dredged canal at Fly Creek in the City of Fairhope; NOW THEREFORE BE IT RESOLVED that E. B. Overton, as Mayor, and Marie Moore, as clerk, be and they are hereby authorized and directed to execute and deliver to the Fairhope Yacht Club a good and' sufficient conveyance conveying to it all that portion of Lot A of Seacliff Subdivision, as per map thereof recorded in the office of the Judge of Probate of Baldwin County In Deed Book 7 NS, pages 90-1, lying South of the dredged cruel at Fly Creek in the City of Fairhope. Motion by Councilman McDaniel seconded by Councilman Below that the gas line at Point Clear be extended approximate one-half mile. Motion carried. Mr. Dyson requested the Council -to purchase a ditch pump. It was agreed that the Gas Department would pay � the cost. Motion by Councilman Below seconded by Councilman Rufflesthat the following Resolution be adopted. Motion carried unanimously. TATE OF ALABAMA j ALDWIN COUNTY ) BE IT RESOLVED by the City Council of the City of Fairhope, Baldw: ounty, Alabama as follows: WHEREAS, there is presented an instrument of declaration in writ - duly executed and acknowledged by T. J. Klumpp, Sr. and Marie oore as Mayor and City Clerk, of the City of Fairhope, respectiv ich instrument conveys to Paul A. Frederick and Esther Frederick e following described real property, to -wit: That portion of Railroad Avenue running southeastwardly from the south line of Rosa Avenue to the southwest corner of Lot 15, Block 22, being according to map of Volanta as per plat thereof recorded in the Probate Records of Baldwin County, Ala- bama, in Miscellaneous Book One, Page 3419 and being further described as being bounded on the north by the south line of said Rosa Avenue, on the northeeat by Block 22 as shown on said Map of Volanta , on the south by a westwardly continua- tion of the south line of said Block 22 to Block 23 on said Map of Volanta and on the southwest by said Block 23; being located in the City of Fairhope, Alabama; The consideration for this deed is an exchange of the above lands for more suit- able lands for street purposes and a relocation of the street: AND WHEREAS, the City Council of the City of Fairhope Alabama esires to assent to the vacation of L"Lts id -strip -of l-nd-heret Avenue; NOW, THEREFORE, the City of Fairhope, acting by and through its Tv City Council, does hereby assent to the vacation b`f said strip? of?. ' land as recorded in the plat thereof in the Office of the Judge Hof`4� Probate; AND, the said City Council of the City of Fairhope does hereby authorize and empower its City Clerk to prepare and deliver to Paul A. Frederick and Esther Frederick a certified copy of this resoluti in order that the same may be attached to and filed as a declarati of intent to vacation. I, Marie Moore, City Clerk, City of Fairhope, Alabama, do hereby certify that the above and foregoing resolution is a true and corre t copy of the resolution adopted and passed by the City Council of Fa r- hope, Alabama at the regular meeting held on the day of , 1957 in the City Hall of Fairhope, Alabama and which appears in the Kinute Book of the City Council of Fairhope, Alabama. Witness my hand and seal as City Clerk, City of Fairhope, Alabama this the day of , 1957• CITY CLERK Motion by Councilman Shull seconded by Councilman McDaniel that the bid of Klumpp Motor Co. on old Police Car be accepted, Credit memorandum of 0650.00 to be applied against purchase of new car at 11i90.00 over dealer cost. Motion carried. Motion by Councilman McDaniel seconders by Councilman Berglin that Mr. Richards Teamer be appointed to the Water and Sewer Board to June, 11958 to fill the unexpired term of Mr. L. A. Berglin, Sr. Upon being put to vote the follow- ing vote was recorded: Voting For: Mayor Overton, Councilmen: Belew, Berglin, McDaniel, Ruffles and Shull. Againste Nose. Motion carried unanimously. Motion by Councilman McDaniel seconded by Councilman Ruffles that the business license of Davison § rocery be transferred to Mr. T. J. Davidson for the balance of this year. Motion carried. Motion by Councilman Berglin seconded by C ounciIman McDaniel that the City accept $50.00 bid of Fairhope Clay Products for Air Compressor. Motion carried. Motion by Councilman Shull seconded by Councilman Mcdanieli that the following bills be approved for payment. Motion carried. Overton, Mayor r City of Fairhope Fairhope, Alabama Subject: Report of City Annexation Committee Dear Sir: On instruction, as appointed by the Mayor, the Committee for the City territorial extension has given careful and certain considera- tions to their assignment. This report represents results as con- cluded from factual reports, joint and individual discussion, and on the scene investigations. However, the conclusions as stated in the following report are only those of the Committee members as combined for this report by the chairman..^,r The Committee ha.s approached this question of City expansion with an attitude of careful analysis, and wishes to reflect this view to the Council. In clarification, this means that the Committee feels if when, what, or where any extension is enacted there is the considera- tion of financial encumbrances resulting from improper street in- stallations. The existing street additions were installed without due authorization, supervision or approval of the City of Fairhope. With due consideration the Committee has divided the expansion program into three areas, each significant with individual problems presented as follows: I - South Addition: The section of land located just to the south of the present southern boundary line is greatly populated and is increasing practically daily. The populace in this general area have expressed a desire to become a part of the municipality. The exact bounds of this addition; the existing city limits on the north side running from the Bay west to east to Section St., from Section St. the line runs south to the northern edge of the Tatumville Gully. Thence the line shall run on a meandering line to the west following the northern edge of the Tatumville Gully until it runs into the present city limits at a point approximately 10000 ft. east of the Bay. Within this area Fairhope would pick up approximately one quarter section of land. Approximately one-third of the area is improved, Hon. M. B. Overton, Mayor Sept. 16, 1957 Page Two and of this improved area one-half is Colony land. The approximate amount of revenue that would be realized from the entire area by means of property tax based on partial figures would be §1,800.00 per year. Within this area there are approximately six miles of roads. 5.5 miles is umimproved, or straight clay sandy loam road. There is approximately J mile of partially improved road that has a slag asphalt base topping. In this area there are still approximately one-fourth miles of uncut roads. All of the street installations are below authorized and approved specifications. The approximate cost for the maintenance of all the roads in this area if they meet specification requirements would equal the approximate tax return. It is the recommendation of the Committee with respect to this South Addition ti:at mechanics be set up for a referendum vote to allow the people in this area to choose whether they would like to be included in the city limits or not. However, the Committee also recommends that these people in voting this change be clearly lead to understand that before the addition can be made that the roads must meet specifications. II - North Addition: The second section of land considered to be added to the limits of Fairhope lies just to the north•of the present northern boundary line. This area is not too largely populated, nor have the majority of the populus expressed the desire to be included in the city limits. The Committee's only reason for including this area would clear up the question of maintenance on Sea Cliff Drive. This area would Include approxi- mately 1/12 mile of unimproved road and 1/4 mile of State Highway. Approximate tax return would be somewhere in the vicinity of ;�200 00. The Committee refers the addition of this section to the Council for their consideration at some later date. III - Eastern Addition: The eastern addition was discussed by the Committee for possible addition in the near future. This section is the next section of Fairhope to be largely developed as a residential area. At present it is undeveloped. There has recently , however, been a subdivision added that has great possibility of rapid developent. The Committee recommends that at the next regular session of the Alabama Legislature this area be included by means of legillation. Respectfully yours, Barney L. Shull, Chairman William R.
