The City Counc i I of theCi ty of Fairhope m6t in regular session at the City
Hall, Monday, Aug. 26, 1957 with the following members present: Mayor Overton,
City Manager Niemeyer, Councilmen; Belew, McDaniels, Ruffles and Shull.
Councilman Berglin being absent.

Motion byjRuffles seconded by Councilman Below that the minutes of the previous
meeting be approved as read. Motion carried.
Motion by Councilman McDaniel seconded by Councilman Belew that permission
be granted to Southern Bell Telephone Company to install outdoor telephones
as per sketch submitted. Motion carried.
Residents of Sea Cliff area met with the Council requesting the Council to
pave Soo Cliff Drive.
A. petition from property owners requesting that Grand Avenue be paved was
presented to the Council.
A representative from Fort Riel Armory met with'the Council requesting that
the City purchase 500 chairs in order to cut expenses and make the Armory
available at a smaller fee.
The Recreation Board reported to the Council that Mr. E. P. Wakefield. Mr.
Walter Poser and Mr. Romeo Simpson were appointed to the Stadium Board.
Motion by Councilman Shull seconded by Councilman Ruffles that the Council
accept Resolution of the Recreation Board pending action of City Council on
advancement of funds. Motion carried.
Motion by Councilman Below seconded by Councilman McDaniel that the Council
accept Exhibit "A" as submitted by E. M. Deupree. Motion carried.
Motion by Councilman Belem seconded by Councilman McDaniel that the statement
of E.M. Reupree be approved for payment. Motion carried.
Motion by Councilman McDaniel seconded by Councilman Shull that the Recreation
Board be authorized to pave approximately 6' by 240t at new stadium. Motion
carried.
Motion by Councilman Belew; seconded by Councilman Shull that a fee of $30.00
be set for use of old football field and $40,00 for new field. Motion carried.
Motion by Councilman Ruffles seconded by Councilman McDaniel that the follow—
ing resolution be adopted. Motion carried.
WHEREAS, the City of Fairhope, in consideration of the release by the Fairhope
Yacht Club to the pity of Fairhope its twenty year lease heretofore given to
the Fairhope Yacht Club by the Cit of Fairhope of those lands, easement over
which was mw given to the United tates Government for a boa{- channel, by
that certain instrument dated May 28, 1957 recorded in the office of the Judge
of Probate of Baldwin County, Alabama in Deed Book 253 at pages 307-11, and
in further consideration of the sum of $5.00 to it in hand paid by the Fairhope
Yacht Club has agreed and bound itself to convey to the Fairhope Yacht Club all
that portion of Lot A of Seacliff Subdivision lying South of the South line of
the right of way easement above recited;
NOW THEREFORE BE IT RESOLVED that E. B. Overton, as mayor, and Marie Moore,
as clerk, be and they are hereby authorized and directed to execute and
deliver to the Fairhope Yacht Club a good and sufficient conveyance conveying
to it all that portion of Lot A, 5f Seacliff Subdivision lying South of the South
line of the easement right of way given to the United States Government by
that certain instrument above set out.
Motion by Councilman McDaniel seconded by Councilman Belew that the City refund
tax to the Bank of Fairhope for years 1956 and 1957 only. Motion carried.
A report from the committee appointed to check the feasibility of a gasoline
tax was read and discussed. No action taken.
Motion by Councilman MCDanleIs seconded by Councilman Shull that the following
Resolution be adopted: Motion carried.
BE IT RESOLVED by the City council of the City of Fairhope that Eloise Wilson
be authorized to sign checks for the City Clerk on the various City accounts
dawn on the Bank of Fairhope during the absence of the Clerk. Motion carried.
Motion by Councilman Ruffles seconded by Councilman Belew that the next regular
meeting of the City Council on September 9, 1957 be postponed to Monday, Sept.
16, 1957 at 7:30 P.M. Motion carried.
Motion by Councilman Belew seconded by Councilman McDaniel that the meeting
adjourn. Motion carried.

Dear Sir:
By your instruction the committee cokposed of Councilmen
Belew,Shull and McDaniel has been active and has functioned in
accord with your instructions. It is the understanding of this
committee that the purpose of the committee was to check into
the feasibility of imposing a gasoline tax on gasoline dealers
doing business within the city limits and the police jurisdiction
of the city.
The committee felt that in fairness to all concerned,and in
order to get as much information as possible,meetings should be
arranged with the gasoline distributors and dealers. Consequently,
on August 9 a meeting was held with 6 gasoline distributors who
do business in the city,and on August 16 a meeting was held with
7 gasoline dealers who do business within the city. It should be
noted here that all distributors and dealers doing business in
the city were notified of the meeting dates and were invited to
attend.
The committee also personally.made a survey of gasoline
prices in different cities of Baldwin County and talked to some
dealers in cities other that Fairhope in an attempt to evaluate
the effects of a gasoline tax on their business. The committee
was also furnished gasoline consumption records by the city manager
and revenue records from the League of Municipalities. Copies of these
records are attached for your consideration.

It would be impractical to incorporate'l`all the discussion
involved in this committee's action,but the pertinent facts are
listed below:
I.The consensus of opinion of the gasoline distributors
was that the sales volumne in the city would drop
approximately 50%.
2.While the wholesale price of gasoline is the sane to
the majority of the dealers,there are instances where
distributors charge different prices to different dealers.
3.It was the opinion of the distributors that the cost of
labor was the same throughout Baldwin County.
4.The distributors prefer a county wide tax rather than
local taxes. The revdnues from this tax would be distributed
to the municipalities on a population basis.
5-Some local dealers are of the opinion that a tax would
cause them to have t& out their operating staff by 50%.
6.There are some dealers in cities having a gasoline tax
that are selling gasoline for the same price as dealers
in cities having no tax.
7.The estimated revenue from a I cent gasoline tax would
be $I0,000.00 per year.
.fter carefully considering the above facts,the committee
respectfully submits the following recommendations:
I. A one cent (.010 gasoline should be imposed on gasoline
if the distributors will classify Fairhope as a"trade arean—
(an area in which the rice to the dealer is lower than the
average of the county
�. No tax should be imposed if the conetummer price is to be
raised,unless such tax is imposed by public referendum.
3. If a tax is imposed on gasoline,the revenue should be used
exclusively for street maintenance and construction,and a
competent engineer should be retained to supervise the
expenditure of such revenue.
This committee is well aware of the great need of funds for
street maintenance,and strongly urges that if this means of obtaining
revenue is not used,that other means be sought immediately.

Re: Standby_ service for your electrical distribution syatem.

At the request of your Mr; E. J. Kirk, I have made estimates for uti-
lizing the existing diesel driven generators for standby service. The
estimates are based on catolog information and are not to be construed
as bid price quotations; which may be higher or lower, depending on
prevailing economic conditions.
We are attaching elementary wiring diagrams showing three different
proposals which we will call Exhibit "All, "B", and 11C".
Exhibit "A" is for essential well pumps, fire pumps, siren, and police
radio only -arid will operate from either generator. Essentially this
consists of a bank of three 371 KVA transformers mounted over exist-
ing transformer vault, with the primary connected to the 4,160 volt
line and the secondary connected to the existing load circuit through
a double throw switch for normal service. The existing bank of three
25KVA transformers will remain connected to the generator switchboard
on the primary aide, and be connected through the double throw switch
to the load on the secondary side for standby service.

Exhibit "B". Rewind both generators for 4,160 volts, re -work switch-
board for new voltage, install 5Kv. double throw oil switch in rear
yard of city hall to select normal or standby service for transformer
banks. Full capacity of generators can be used.

former with fused oil switches and 5Kv. double throw oil switch to
