of Bay I0.iette, Alabama, hereinafter called the Contractor, and the
CITY OF FAIRHOYL and the-r!� RSCREATION BOARD OF THE CITY OF
FAIRHOPE, Baldwin County, Alabama, hereinafter called the Owmer,
WI` 141—ooZIH, that the Contractor and the Owner for the consideration
hereinafter named agree as follows:
Article 1. �SSc,2Ee of Mork: The Contractor shall furnish all of the
material— s and perform all work of the installation of
concrete tiers with necessar�r footin s ready for in-
stal anon of prestressed concrete slab, seats by others
as shown on the Dr 72 gs and described in the Spec ,ica-
tions thereon entitled:
STADIU•I FOR FAIRHOrE HIGH SCHOOL
prepared by T. Howard Ellis acting as an in these Contract
Documents entitled the Architect; and shall do everything
-required by this Agreement, the Specifications, and the
Drawrings,
In addition to concrete tiers the Contractor shall install
400 pieces of precast filler block furnished by others
after the prestressed slabs have been installed by others.
Article 2. Tiire of Completion: The trork ,to be perf rmed under this
Contract shall a co-nwnced _

Article 3, Insurance. Workments compensation, fiA6 insurance, tornado
insurance, and other insurance as may be required by Federal,
State, and local laws on building projects will be procured
by the Contractor and maintained by him for the duration
of the Contract. Insurance liability will be made payable
to the Owner and Contractor as their interest may appear.
Article 4. Contract Price: The Owner agrees to pay the Contractor
for performance of the Contract the sum of THRt!�r, THOUSIUM
FIVE HUNDRED NIILI;7:E4 & No/100 (1$33,519.00) Dollars in
current funds.
Article 5. Acce tance and Payment: eayrent shall be due js
completion of the work, provided the
work be then fully completed and the Contract fully
performed.
Within 10 days after receipt of written notice that the
work is ready for final inspection and acceptance, the
Architect and the Owner shall make such inspection, and when
the work is found acceptable under the Contract and the
Contract fully performed, the Architect shall issue a final
certificate in inviting, within 5 days, stating that the
work provided for in this Contract has been completed and
is accepted by his under the terms and conditions thereof,
and the entire balance found to be due the Contractor as
noted in the Architect's final certificate, is due and
payable.
Before issuance of final certificate the Contractor shall
submit evidence satisfactory to the Architect that all
payrolls, material bills, and other indebtedness connected
with the work have been paid.
Article 6. The Contract Documents: The Contractor and Owner agree
t at the docunenMs enumerated hereinafter, together with
this Agreement, form the Contract, and they are as fully
a part of the Contract as though hereto attached or herein
repeated:
1. Proposal
2. Contract (Agreement Between Contractor and Owner).
3. Drawings (3 sheets).
The Contractor and the Owner for themselves, their suc-
cessors, executors, administrators, and assigns, hereby
agree to the full performance of the covenants herein
contained.
IN IVITITL66 WHIREOF they have executed this agreement the
day and the year first written above in three (3) counter-
parts, each of which shall, z-rithout proof or account for
the other counterparts, be deemed and original contract.

AGREEMENT BETWEEN C ONTRAC TOR AND OWNER
THIS AGREEMENT made the 15th day of� July, in the year Ntneteen
Hundred and Fifty -Seven, by and between FLORIDA CHAIN LiNK FENCE
COMPANY, of Pensacola, Florida, hereinafter called the Contractor,,
and the Ctty of Fairhope and the RECREATION BOARD OF THE CITY OF
FAIRHOPE, Baldwin County, Alabama, hereinafter called the Owner.
WITNESSETH, that the contractor and the owner far the consideration
hereinafter named agree as follows:
Article I. Scope of Work:. The Contractor shall furnish all of
the materials andperform all of the installation of:
18a lineal feet of 72" high fence= using #11 gauge
chain link fabric, 2!" ter•.minai and ate posts, 1-5/8"
line posts spaced 9 feet apart. 1-3/8" topraii.

21.40 lineal feet of 148" high fence on Stadium constructed
by others.
2 Side rails with 481' high fences extending from top to
bottom -on each end of Stadium constructed by others.

Falrhope, Alabama, as directed by the Owner.
Article 2. Time of Completion: The werk to be performed under this y
contract shall be commenced immediately and shall be
substantially completed without undue delay.
Article 3, l nsuran°et Workmen's compensat l on, fire Insurance, -tornado

by the contractor and maintained by him for the duration of

performance of the Contract the sum of THREE THOUSAND ONE
HU�D�EIGHTY*ONE & 40L100 ($3,181.40) Dollars in
current funds.
Article 5. Acceptance and Payments Payment shall be due upon
completion of the work, provided tht work be then
fully completed and the Contract fully performed.
Within 10 days after receipt of written notices that the
work is ready for final inspection and acceptance, the Owner
shall make such inspection* and when the work is found acceptable
under the Contract and the Contract fuI I performed, fie Owner
shall make final payment.

stadium for public rest rooms and dress'ng rooms for the school,. Voting Yes;

A ^esolution from the Baldwin County Board of Education ap^roving the pro-
posal of the City and the ^ccreat i on Board for construction of a star' i um on
public school grounds was read and ordered filer'.
,%ir. Johnson, represent'ng Purroughs Corp., met with the Council. !vloti-n by
Councilman Belew seconded by Councilman Shull that Councilman Ruffles be
authorized to purchcse a Burrouchs billing machine if it meets the City's
needs.' 1%Otion carried.

permit of Claude Jansen be approved 244 feet from Pine Street. Motion carried.
