County of Ba l dw i n
The City Council of the City of Fairhope met in regular session at the
City Hall, Monday, July 8, 1957 with 1hefollowing members present: Mayor
E. B. Overton, City Manager C. B. Niemeyer, councilmen: Belew, Berglin,
McDaniel, Ruffles and Shull.
The minutes of the previous meeting were read. Motion by Councilman
McDaniel seconded by Councilman Belew that the minutes be approved. Motion
carried.
Councilman Ruffles introduced the following Resolution:
BE IT RESOLVED By the City Council of theCity of Fairhope, Alabama that
there be and is hereby created a Recreation Board of and for the City of Fairhope
with all the p'wers, authority and duties provided by Act of the Legislature
of Alabama reported acts 1945 pages 565, et seq. (Secti-)ns 274-2?9, Title 37,
Code 1940, Pocket parts.)
Councilman Ruffles moved the suspension of the rules that the resolution
could be put upon its immediate passage, which motion having been seconded by
Councilman McDaniel, was put upon its passage with the following result.
Voting for the same: Mayor Overton and Councilmen Berglin, Belew, McDaniel,
Ruffles and Shull, against, None. Whereupon Mayor Overton declared the vote
unanimous and the rules suspended.
Councilman Ruffles moved that the resolution be adopted and the same having
been seconded by Councilman McDaniel the resolution was put upon its passage
with the following resulting: Voting for the passage of the Resolution:
Mayor Overton and Councilmen: Belew, Berglin, McDaniel, Ruffles and Shull.
Against: None. Whereupon the Mayor declared the resolution duly adopted.
(Notion by C ounci,man Ruffles, seconded by Councilman McDaniel that the
following Resolution confirming the appointment of the Recreation Board be
adopted:
BE IT RESOLVED that the election heretofore, on the IIth day of March,
1957, of George K. Page, for a term of 2 years commencing on the Ilth day
of March, 1957, and E.P. Wakefield, for a term of 3 years commencing on the
Ilth day of March, 1957, and Walter 0. Poser, for a term of I year commencing
on the Ilth day of March, 195'1, and Ernest M. Bailey, for a term of 4 years
commencing on the Ilth day of March, 1957, and Romeo Simpson, for a term of
5 years commencing on the Ilth day of March, 1957, as members of the
Fairhope Recreation Board be and the same is ratified and confirmed and that they
be and ar4 hereby elected as members of the Fairhope Recreation Board, each for
the term set opposite his name above.
Upon being put to vote the following was recorded: Voting for the adoption of
Resolution: Mayor Overton, Councilmen: Berglin, McDaniel, Ruffles and Shull.
Voting Against: Nam. Councilman Belew not voting. Motion carried.
Councilman McDaniel offered the following Resolution:
BE IT RESOLVED that the pity of Fairhope, acting conjointly withthe
Recreation Board of the pity of Fairhope, in the matter of the erection of
an athletic stadium on high school lands in the City of Fairhope, make to
the County Board of Education of Baldwin County, Alabama, the following proposal:
To the County Board of Education of Baldwin -County, Alabama.
The City of Fairhope acting through and by E. B. Overton, its mayor,
being hereunto duly authorized by resolution of the pity Council adopted and
entered on the minutes of its meeting held in the City of Fairhope on the 8th
day of July, 1957, and through and by its duly constituted Recreation Boart,
and George K. Page, E.P. Wakefield, Walter 0. Poser, Roiaeo Simpson and Ernest M.
Bailey as its members, propose to the County Board of Education of Baldwin Counter
to construct, operate, maintain and use in cooperation with such County Board of
Education a stadium on the Fairhope High School grounds, according to the plans and
specification prepared by T. Howard Ellis, Architect, dated as of June 27, 1957,
for the use of the said school and the people of the City of Fairhope, on the follow-
ing basis, terms and conditions:
I. That the County Board of Education pay for any and all necessary
and proper arc:hitectua•I work done thereon; that such stadium, when.construct-
le�d, to be the property of th& County Board of Educati,-n, and'the County..
Board of Education maintain and keep such stadium in a proper and reasonable
state of repair.
2. That the City of Fairhope and its Recreation Board construct such
stadium without cost to the County Board of Education.
3. That such stadium be operated and used under the jurisdiction and
authority of the trustees of the Fairhope Public Schools and their success --
ors in office as such, and an equal number of members of the Fairhope Rec-
reation Board, to be designated and selected by the Fairhope Recreation
Board, and their successors in office as such; they to be known and design-
ated as the Fairhope Stadium Board. In the ev^nt the Fairh^pe Recreation
Board shall cease to exist or to function, the City Council shall elect
members to such Fairhope Sladium Board in number equal to the number of
school trustees.
4. That the public school system of the City shall have first and
prior right to the use of such stadium. The Fairhope Stadium Board may
permit other agencies, organizations, and civic activities to use such stadium,
when not in use by. the schools and at such times and under such conditions
as not to interfere -with or hamper the operation of the schools and school
activities, on such terms and ccnditinns as the said Fairhope Stadium Board
shall deem proper.
Councilman McDaniel moved the suspension of the rules that the resolution
could be put upon its im-^ediate passage, which motion being seconded by
Councilman Berglin, was put upon its passage with the following result.
Voting for the same Mayor Overton apd Councilmen: Belew, Berglin, McDaniel,
Ruffles and Shull, against: None, whereupon .Mayor Overton declared the vote
unanimous and the rules suspended.
Councilman %.cDaniel moved that the resolution be adopted, and the same
having been seconded by Councilman Berglin the resolution was put upon its
passage with the following resulting; voting for the passage of the resolution:
Mayor Overton.and Councilmen Berglin, McDaniel, Ruffles and Shull':, aaainst
Councilman Lelew. ':•thereupon the Mayor declared that a majority of the
Council having voted for the passage of same, the resolution was duly adopted.
Mrs. Della Stapleton gave a report to the Councill on the Civil Ye-Fenee
school held in Auburn,fAla. which she attended as a representative of the
City of Fairhope.
The Recreation Board presented'prices for completing the Game Field Stadium,
Fence and lights to be located on the Senior High School Grounds with the
request that the C ouncil approve same and approve disbursement of the funds
as required.
Motion by Councilman Ruffles seconded by Councilman Berglin that the Council
approve report of Recreation Board as submitted and approve disbursement
of funds as required. The Recreation Board to approve bills and submit to
the City Council for final approval. Motion carried. Councilman Belew;not
voting.

Mot 1on by Councilman Shull seconded by Councilman Belew that the following
Resolution be adopted:
WHEREAS, there is on deposit in the Surplus Fund of the Natural Gas System
of the City sufficient funds to redeem prior to maturity $30,000.00 principal
amount of Natural Gas Revenue 3 311V. Bonds, and
WHEREAS, it is necessary for bondholders to be notified not less than 30 days
prior to the redempti^n date.
NO'N THEREFORE, BE IT RESOLVED:
16 That the City hereby elects to

3. That Watkins, Morrow and Company be authorized to negotiate with the
bond -holders in an at#empt to gave the cost of publishing a notice of
redemption but that if such notice must be published, that said Watkins,
Morrow and Company be and is hereby authorized to publish an appropriate
notice of redemption in accordance with the terms of the authori-ring
ordinance.
Motion carried.
Motion by Councilman Shull seconded by Councilman Ruffles that the follow-
ing bills be approved for payment: Motion carried.

Gentlemen:
On the r day of Stephens was
convicted in the Re ear's Co rt of the City of airhope,
on -,*he complaint of jk'V Collins, and given a fine
of dollars and a sentence of ays.The conviction was under City ordinance N4�1"
,
covering Criminal Nuisances.
The evidence showed that the nuisance complained of was
the noise created by a General Electric Air Conditioner. The
evidence did not show any unusual noise from the Air Conditioner.
On the 8th day of June I pardoned Mr. Stephens on the foll-
owing grounds:
1. The ordinance does not provide for a hard labor sentence
in addition to a fine.
2. I cannot conceive that the operation of an Air Conditioner,
making no unusual noise, would constitute a criminal nuisance
under this ordinance.
