HomeMy WebLinkAbout11-12-1956 Regular MeetingSTATE OF ALABAMA, County of Baldwin The-CityCouncil of the -City of Fairhope met in regular session at the City Hall, Monday, November 12, 1956 with the following members presents Mayor E. B. Overton, City Manager C. B. Niemeyer, Counci Iment Charles F. Belew, John W. Fleming,Johnnie,F. McDa'niels_, ft. R.. Ruffles, Jr. and Barney Shull. The minutes of the previous regular meeting viere read and approved as read. Mr. Harri s., of Smi th, Dukes and Buckarl ewr, met wi ith the Counci I to di scuss and answer any questioars on the annual audit. Motion by C ounciIman Ruffles seconded by Councilman Shull that the City Manager be authorized to contact Burroughs Corporation and National Cash Register Company to reviews procedute of billing and bookkeeping and make recommendations as to how system could be improved. Motion carried. Motion by Councilman Ruffles seconded by Councilman Shulll that the Mayor appoint two Councilmen to work with the City Manager and check cancelled checks, receipt booket; invoices and other data and advise as to disposition of same. Motion carried. The Mayor appointed Councilman Ruffles and Councilman Shull to work with the City Manager. Mr. Stallard madie a report to the Council on the recreational facilities at the Fairhope High School and especially the Football Field and requested anti aid from the City that would be availlabIe. Mr. West presented a petition from the residents of Sea Cliff requesting that the Counci l restore the name Sea C I' i f f Or i ve to the off i c i a li records of the City instead of the name Bayou Drive. Motion by Councilman Ruffles seconded by Councilman Shull that Bayou Drive is hereby changed to Sea Cliff Drive. Motion carried. Motion by C ounciIman Shull seconded by Councilman Belew that Mr. Beebe, City Attorney, be authorized and directed to write to the Alabama Alcoholic Beverage Control Board asking if Fairhope, a resort community, who has ao qualified candidate for Liquor License and if Fairhope having a population of 3400 within the Corporate Limits according to the last Federal census, would the A. B. C. Board issue a Liquor License on this basis. The City now has one public Restaurant within the Corporate Limits with an A. B. C. License. Motion carried. Motion by C ounciIman BeIew seconded by C ounciIman Shull that Mr. Beebe, City Attorney, be authorized and directed to write the Alcoholic Beverage Control Board asking if a liquor license was issued to a public: Restaurant within the Corporate Limits of the City of Fairhope based on a census which gave the City a population of 4500 would the tax distribution of the. A. B. C. profits be based on the same census. Motion carried. Two bids were submitted on new, Police car. Motion by Councilman Ruffles seconded by Councilman McDan i el s that the City accept low bid oft:,Gaston Motor Company as submitted when funds are available. Motion carried. Councilman Fleming not voting. Motion by C ounciIman Fleming seconded by C ounciIman Ruffles that Mr. Beebe, City Attorney, be authorized and directed to draw up contract with Eugene Bosby for garbage pick up at $275.00 per week effective December I, 1956. Motion by Councilman Fleming seconded by Councilman Shull that the request of- M & S Service Station to hang %i gn be arpprove4 as submitted. Motion carried. A letter from the Retail Trade Committee in regards to daily trash pick up was read and discussed by the Council. Held for further study. A petition from the residents of North Summit Street protesting the location of the City Dog Pound was read and taken under consideration. t Councilman Belew introduced the following Ordinance which was seconded by Councilman Shull. .# .4 1 Amendatory Zoning Ordinance #231 Be It Ordained by the City Council of the City of Fairhope: Section 1. Be it remembered that hereto the pity Planning Commission of the City of Fairhope, did, on the lOth day of August 1956, acting on its.own initiative, after as public: hearing thereon, of which due and proper notice was given as required, approve and recommend to the Council, that boundaries of the zon6d,, districts of the City of Fairhope be rearranged and designated and established asshown on and by that certain zoning map dated October 1956 and marked exhibit A, filed herewith. Seca i on 2. That Section 13 of Zoning Ordinance #231 duly adopted on the 11th day of 9atober, 1954 be and the same is amended to read as follows: Section 13—District Boundaries. The boundaries of above districts are hereby established as shorn on the zoning map of the City dated October 1956, filed'hereewrith marked exhibit A and made. a part of this ordinance in lieu of the zoning map the boundaries of districts;are lot lines, the center lines of streets or alleys or such lines extended, railroad rights of way, or the corporate limit lines as they existed at thetime of enactment of this ordinance. Questions concerning the exact ! location of district boundary lines shall be decided by the Board of Adjust- ment, Motion carried. Motion by Councilman Belewrseconded by Councilman Shull that the following resolution be adopted; RESOLUTION WHEREAS, there is on deposit in the Surplus Fund of the Natural Gas System of the City sufficient fundsto redeem prior to maturity #34,000.00 principal amount of- Natural Gas Revenue 3 3/4% Bond's, and WHEREAS, it is necessary for bondholders to be notified not less than 30 days prior to the redemption date. NOW THEREFORE, BE IT RESOLVED: 1. That the City hereby elects to redleem from Surplus Revenues.on hand Bonds. Nos. 7l6/725:9r i ncl.us;iv-e, due I st allay of February, 1980 and Bonds Nos. 692/715• Inclusive, due Ist day of February, 1979, at par plus accrued interest plius a premium of one year's interest. 2. That the Taustee'be and is hereby instructed to pay such bonds when presentedi with funds out of the Surplus Fund of the Natural Gas System. 3. That Watkins, Morrovr & Company be authorized to negotiate with the bond- holders in an attempt to save the cost of publishing a notice of redemption but that if such notice must be published, that said %1atkins, Morrow.& Company be and is hereby authorizedito publish an appropriaite notice of redemption 1_� accordiance with the terms of the authorizing ord-i nance. Upon roll call, the resolution was unanimously adopted. Motion by Councilman Shull secondLadi by Councilman McDaniels that the Gas Department and the Electric Department each pay $30.00 per month for janitor service at the City Hall. Motionccarried. Motion by Councilman Be I ew sec:ondled by Councilman Shull that the request of Mr. Byrd L, Moore and Mr. Esmond Walthall. to close and abandon the unimproved area, designated as "Street" in the plat of V olanta as recorded in Miscellaneous Book #1, page 341 of Baldwin County Records be rejected.
