B, Overton, City Manager C. B. Niemeyer, Councilmen: C. F. Belew, John Fleming, Johnnie McDaniel&, Wm. R. Ruffles, Jr. and Barney Shull. The minutes of the previous regular meeting were read and approved as corrected. Mr, H.R. Chamberlain met with the Council with the suggestion that the City consider City Registration. The petition for paving a portion of Grand Ave. was tabled until Spring at the request of the property owners in this area. Motion by Councilman Ruffles seconded by Councilman McDaniels that the following Resoluticn be adopteds Motion carried. BE IT RESOLVED BY THIS COUNCIL that after Nov. I, 1956 the Fairhope Water and Sewer Board shall be and is hereby required to pay to the City of Fairhope'the sum of 17.50 for each new sewer connection installed for and as reimbursement to the City for and as damage to and cost of repair of the City Streets. Motion by Councilman Fleming seconded by Councilman Shull that the City accept the resignation of Wm. R. Ruffles, Jr. from the Board: of Zoning Adjustment du& to his election to the City C ounci1. Motion carried. Motion by Councilman Belew seconded by G-ouncilman $hull that Mr. Harry A. Peter, Jr. be appointed to the Board of Zoning Adjustment. Moti,in carried. Motion by Councilman Ruffles seconded' by Counc i I man Bel ew, t hat the follow- ing Resolution be adopteds BE IT RESOLVED BY THIS COUNCIL that D,. C. Johnson be appointed as Chief of Police, effective Oct. 15, 1956, at a salary of #350.00 per month payable on the Ist and I'Sth of each month. Provided however, that the City Council reserves -the right at any time to decrease or increase such salary and to dismiss the said D. C.. Johnson as Chief of Police with or vai thout cause. Moticn carried. Motion by Councilman Belew seconded by Councilman Shull that there be a charge of #3.00 for all electric meters sent to be: tested and returned marked accurate within 30. If meter is found to be defective the City will bear cost and make reasonable adjustment. Motion carried. It was duly moved and seconded that the meeting adjourn. It has been a pleasure working with other members of the Board and serving the City in this capacity. I regret having to take this action, however, due to my election to the City Council, this action is necessary as it would not be in order for a Councilman to serve on this Board. M. Present at sold meetings Mayor E. B. Overton, duly elected; as Mayor, and Charles F. Below, John W. Fleming, Johnnie F. McDoniels, Wm. R. Ruffles, Jr., and Barney Shull, duly elected councilmen at the general election held September 17, 1956, being the third Monday in said month, each of whoa took and subscribed to the oath of office in words and figures as follows: I, , duly elected , of the City of Fairhope, do solemnly swear that I w-ill support the constitution of the United States, and the constitution of the State of Alabama, so long as 1 continue a citizen thereof; and that I will faithfully ant honestly dis- charge the duties of the office upon which I am about to enter, to the best of my ability. Notary Public, State of Alabama The said Mayor and City council having been duly elected and qualified, and all being present, the mayor called the meeting to order and upon roll colt noted the following members as presents E. B. Overton, Charles F. Betew, John W. Fleming, Johnnie F. McDaniels, Wm. R. Ruffles, Jr. and Barney Shultz Marie,Moore the former Clerk being present and acting as temporary clerk; whereupon E. Be Overton, as mayor presiding announced that the first order of business was the election of clerk and treasurer, and chief of police, and fixing the salaries of such officers: Upon nomination, dulf. made, there being no other nominajtion# Marie Moore was unanimously elected as clerk and treasurer; and upon motion bf Councilman Shull, secondied by Councilman Fleming, the following resolution fixing the salary of the clerk was unanimously aeb ptedl; Be It Resolved by this Council that the salary of the clerk, who shall, also act as treasurer, be and the same is hereby fixed at #300,00 per month, payable on the 1st and 15th of each calendar month, for the term of four years commencing with this date. Provided however, that the City Council reserves the right at any time during such term to decrease or increase salary and to dismiss the said Marie Moore as clerk and treasurer with cause. She shall give bond in the sum of #5,000.00 contitioned as required'by lava. Councilman Fleming reported to the Mayor and Council that former Chief of Pollee, Floyd Phillips, was not available for reappointment as Uhief of Police. Upon nomination, duly made, there being no other nomination, D. C. Johnson was unanimously electedi as Acting Chief of Police; and upon motion of Councilman Bellew seconded by Councilman Shull the following resolution fixing the salary of the Acting Chief of Police was adoptedt Be It Resolved by this Council that the salary of the Acting Chief of Police, beand the same is hereby fixed at ¢290.00 per month, payable on the 1st and 15th day of each calendar month. Provided however, that the City Council reserves the right at any time Nodecrease or increase such salary and' to dismiss the said D. C. Johnson as Acting Chief of Police with or without cause. a The Mayor then announced that the: next order of business was the election of a City Manager for the City of Fairhope and on motion by Councilman Ruffles seconded by Councilman Shull, C. Be Niemeyer was appointed as C,i ty Manager for a• term of min x months commencing this date. It use further resolved that the salary of the City Manager of the City of Fairhope be and the same is hereby fixed at the sum of #400.00 per month, payable on the'lst and I9th day of each month; but this City Council does reserve the right to increase or decrease such salary at any time during such term. On motion by Councilman Ruffles, seconded by Councilman Below the following resolution was unanimously adopteds Be It Resolved that W. C. Beebe, esquire, be and he is hereby employed as City Attorney on a monthlly basis to perform such services as has hereto- fore been required of him by the City Council and that he shall be paid $50.00, per month, on the Ist day of each month; but this council reserves the right to dismiss him at wit[, with or without cause, and to increase or decrease his salary at will. it was "reed by the Mayor and Council that the Mayor serve as City Recorder until the first regular meeting of the City Council in November at which time?the Council would appoint a City Recorder. Motion by Councillman ShuDI second6# by Councilman McDaniels-that the regular meetings of the City Council be held on the-2n4l and 4th Monday of each month at 7:30 P.M. Motion carried. Motion by Councilman McDaniells seconded by Councilman Shull that Charles Below be. appointed to serve on the C:ity Planning Board. Motion carried. Mayor E. B. Overton then appointed C. Be Niemeyer, City Manager to serve on the Planning Board:' for a term of si a. months. Motion by Councilman Shull seconded by Councilman McDaniels that CounciIlk* man Fleming be elected as Mayor Pro Tem. Motion carried. Motion by Councilman Ruffles seconded by Councilman Belewthat the Garbage contract with Eugene Bosby be extended one month. Motion carried. Motion by Councilman Belem seconded by Councilman Shull that the Eity continue with Street markirs and house numbering necessary for free mail delivery. Motion carried. Motion by Councilman Ruffles seconded by Councilman Below that the City continue the pa-licy of securing special council approval for renting any City equip- ment with the exception of the tine truck or in cases of emergency. Motion carried. Motion by Councilman McDaniels seconded by Councilman Fleming that the City continue policy of installir3 driveways, the property owners to buy culverts and the City install same. Motion carried. City Manager Niemeyer was instructed to prepare cost report for replacing pavement where sewer lines are installed. Motion by Councilman Below seconded by Councilman McDaniels that all requests to " the City Council for Street signs and street lights be submitted in waiting. Motion carried. Motion by Councilman Flembig secondedlby Councilman McDaniels that the City continue,to donate electric service for the football and softball recreation program. Motion carried. Motion by Councilman Ruffles seconded by Councilman Fleming that the applicae- tion of V. F. W. be submitted to the Adjustment Board for action. Motion carried. Motion by Counciiman Ruffles seconded by Councilman McDaniets that the workmens Compensation Policy be approved for payment. Motion carried. Mr. Byrd!lL.. Moore submitted a petition to close and abandon the unimproved area diesignated as "Street" to plat of Volanta. Tabled for further study. I* A petition from property owners on Grand Ave. nequesting that the street be paved was read and discussed. City Manager Niemeyer was instructed to secure cost for next regular meeting of the Council. A I'eetter from Mr. Bruce Evans pertelning to extending the City Limits South was read and discussed. Motion by Councilman Shull secondeed by Councilman McDaniets that the Mayor appoint a committee of three to check the feasibility of extending the Pity Limits. Mayor Overton appointed Councilmen Shull, Below and Ruffles. with Councilman Shull as Chairman. The Mayor appointed the following Councilmen as Commissioners of the various departments of the Cityi C:ouneiIman RuffIes — Ffinance Councilman Bellew .► Utilities Councilman McDaniets " Fire and Police Councilman Shull •- Parks and Streets Councilman Fleming — Sanitation and Recreatiion. Motion by Councilman MCNATels seconded by Councilman Below that the Mayor be authorized to write the Department of Public Safety stating that the City has long felt the need of a Highway Patrolman in the City and request that a Highway Patrolman be stationed here permanently.
