between the CTity of Fairhope and the Spanish Fort Estates, Inc., the lost

It is understood and agreed by both parties to the above referred
contract that this letter shall be and'is hereby made a part of the contract.
IN WITNESS whereof, the parties hereto have cause4 this agreement to be
executed in their respective names and under their respective corporate -seals
by their respective officers, all of said officers, being thereunto du l y

I have examined contract drawn by Mr. Armbrecht between
the Spanish Fort Estates and the City of Fairhope relating to gas
at Spanish Fort, which Mr. Fuller will hand you.
The contract is in order and I think will meet with your
approval.
I would call your attention to the last part of Paragraph
Two, which requires the City at its cost and expense to repair any
damage done to the streets, alleys and strips of land laying and
maintaining or repairing or replacing said gas mains and connect-
ions. My understanding is that you will lay the mains outside of
tFie paved strip. I discussed with you last night the matter of
the necessity for cutting the pavement in making connections to
users on the opposite side of the street. I believe you stated that
in making such connection that you would not cut such pavement but
tunnel underneath. However, if my recollection is not correct and
you cut the streets, and it is your policy to repair the streets in
Fairhope then you repair the streets at Spanish V`ort, and if it is
not your policy in Fairhope to pay the cost for cutting the street,
this provision should be eleminated.
I -would also call your attention to the first sentence in
paragraph three, which requires the mains and connections "shall be
laid, and constructed in such manner as shall meet with the approval
of the Fort". I assume that the proceedure and manner of laying
has been discussed between Spanish Fort interests and Mr. George
Dyson and that these matters have been settled and agreed on. If
this is true then this paragraph should stay in. If they have not
agreed on it, this paragraph should be eleminated or this matter
shaould be understood and agreed on before the contract is signed.
I would also call your attention to the last provision in
paragraph three limiting the rermbursement to a total cost of $4,000.00.
I think under your operation you use the worid'bonnection" to be the
line between the house and the main. In this contract Spanish Fort

is using the word "connection", so Mr. Fuller advises, to mean the
connection of this main to be laid with your permanent transmission
line you have now and not to include the connection of the customers
with the main you propose to lay.
I would suggest that Mr. Fuller give you a letter of explanation
showing his interpretation of the meaning of the word "connections"
as used in this contract. This would eleminate the objection to the
last portion of paragraph three and would clearify that portion of
paragraph two that I mentioned above. This letter should also state
that the cost of connection the main to be laid with your trans-
mission line includes any repair to streets or roads as a part of
the cost of the main.
I understand that Mr. George Dyson is confident that the
proposed main will cost less than 4,000.00. If this is true there
will be no objection to the limitation of $4,000.00 in the contract.

Dear Brad:
With reference to Mr. William Beebe's letter to the
Town of Fairhope, dated September 11, 1956.
Spanish Fort Estates interprets the meaning of the
word "connections" to mean, the connection of the main -
to -be -laid to your permanent transmission line you now
have. It does not refer to the connection between the
main you propose to lay and the customer.
The cost of connecting the main -to -be -laid, with your
transmission line includes any repairs to streets or roads
and is to be considered a part of the total cost of laying
the main.
