County of Baldwin
The City Council of the City of Fairhope met in regular
session at the City Hall, Monday, June 13, 1955 with the
following members present: Mayor E. B. Overton, Councilmen
M. 0. Berglin, R. H. Brown, R. C. Macon and J. D. Mason,
Councilman L. E. Blatchford being absent.
The minutes of the previous regular meeting were read and
approved as read.
Motion by Councilman Berglin seconded by Councilman Brown
that the followinh bills be approved for payment: Motion
carried.

Members of the Jr. Chamber of Commerce met with the Council
in regards to proposed playground. Motion by Councilman
Mason seconded by Councilman Berglin that the City prepare
bed and base for proposed playground area at the new High
School grounds. The Jr. Chamber of Commerce proposes to
furnish asphalt and in the event asphalt is provided the City
will spread same. Motion carried.
A letter from Hon. George Grant with reference to appropriations
for dredging Fly Creek was read to the Council.
Councilman Macon introduced the following Ordinance to be known
as Solicitation of Funds erdinance, which motion was seconded
by Councilman Berglin. The same being an Ordinance of permanent
operation was carried over for further consideration and passage
at the next regular meeting of the Council on June 27, 1955.
Motion carried.

Solicitation of Funds
Sec. 1. Permit required; exceptions.
It shall be unlawful for any person to solicity money,
donations of money, property or financial assistance of any kind,
or to sell or offer to sell any article, publication, ticket or
subscription, on the statement or representation that such sale or
solicitation is for charitable, educational, xx;g religious or
philanthropic purposes, either in person or by telephone or in
any manner intthe city, unless such person shall hold a valid
permit as hereinafter provided for.
This section shall not apply to solicitation at the regular
exercises or services of any church, religious society7 lodge
benevolent order or fraternity, or any branch thereof, when
such solicitation is made at a regular appointed meeting, or regular
place of worship, or exercies of such church, religious society,
lodge, benevolent order or fraternity.
Sec. 2. Religious, educational or charitable institutions.
It shall be"unlawful for any person representing or claim-
ing to represent any church, school, eleemosynary, Charitable,
social service or public institution of any kind to solicit
subscrifitions from the general public or to sell tickets or to
canvass for advertising space on any program, booklet, pamphlet
or other printed matter for the benefit or ,for the alleged
benefit of any such institution without first obtaining a written
permit from the commissioner of public safety.
Sectionri3. Application for Permit.
Any person desiring to solicit funds for any cause what-
ever as provided in Section 1 shall file with the commissioner
of public safety of the city, and the Mayor and the City Manager
i_s designated as commissioner of public safety for the purposes
of this ordinance, an application, duly sworn to someone
duly authorized and having knowledge of the facts containing
the following information:
(a) Name of the person or the organization applying for
permission to solicit; names of the officers of such organi-
zation', if any.
(b) The purpose for which a solicitation permit is requested.
(c) The time for which the permit is requested, and the
methods to be used in carrying -on the solicitation.
(d) The amount of any wages, fees, commissions or emolu-
ments to be expended in connection with such solicitation
and the names of all individuals authorized to receive money.
(e) Full statement of the character and extent of the
charitable, religious or philanthropic work beind done by the
applicant within the City.
(f) Such.other information as the commissioner of public
safety may require.
Section 4. Grapting of permits; duration; 'contents; appeals.
The commissioner of public safety shall have the power to
grant permits if the information filed under the last preceding
sections is found to be accurate, and the purpose iB found to
be worthy and bona fide.
No permit shall be issued for a longer period than thirty
days including Sundays and local holidays, but any permit may-
be renewed by the commissioner of public safety.
Whenever a permit is denied to any applicant by the
commissioner of public safety, such applicant shall have the
right to appeal to the commission of the city within five days
from such denial.
SECTION 5. Misrepresentation of facts.
It shall be unlawful for any person on his own behalf, or
as the representative of another, to swear falsely.to any facts
contained in the application provided for in this chapter or
to file or cause to be'filed any false affidavits.
Section 6. Revocation of permit.
The commissioner of public safety shall have the power.to
revoke any permit if it appears to him that the holder of the
permit has violated any provisions of this chapter or has mis-
represented or made untrue statements in connection with the
solicitation.
A permit shall also be revoked by the commissioner of
public safety if it appears that the permit is used directly
or indirectly as an endorsement of the solicitation.
Whenever a permit is revoked by the commissioner of public
safety, the person aggrieved may appeal to the city commission
from such revocation within five days thereafter.
Section 7. Solicitations by telephone.
It shall be unlawful for any person, society or associa-
tion (including religious, fraternal, patriotic or charitable
organizations) to use the telephone as a means of soliciting
another to make a.donation, or to subscribe to or for advertis-
ing, or to give or pay money or other thins of value for, or
in return for, any ticket, flag, tag, badge, flower, token or.
symbol, or to use the telephone as ameans of arranging an
engagement for such solicitation for any purpose unless a per-
mit to do so be first obtained from the commissioner of public
safety.
Section 8. Any person convicted of violating any provis-
ion of this ordinance shall be fined not less than $1.00 nor
more than $100.00 for each conviction.M

the following Ordinance be adopted:
ORDINANCE NO. 2 -�—
AN ORDINANCE AMENDING SECTION 52 OF THE BUILDING CODE OF THE
CITY OF FAIRHOFE, ALA.
Be it Ordained by the City Council of Fairhope, Alabama, that
Section 52 of the Code of Ordinances of the City of Fairhope
as heretofore amended be and the same is hereby amended to read
as follows:
lst. The City Clerk shall perform the duties of Building
Inspector for the City of Fairhope, and he shall have authority
to issue building permits and collect the fees for the same, and
shall look after the enforcement of all building ordinances
and regulations of the City.
2nd. No person shall erect or cause to be erected or
move, any house, building or other structure, or addition or
improvement thereto, or any remodeling of the same without first
obtaining a permit therefore from the building inspector of the
City. When the cost of such house, building or other structure
or addition or improvement thereto, or any remodeling of the

same is -less thak $25.00 no fee shall be charged; when the cost
is over $25.00 and under $100.00 a fee of $1.00 shall be charged
and when the cost is over $100.00 a fee of $2.00 shall be charged.
3rd. All work and construction authorized to be done under
a permit, shall be completed within twelve months from the date
permit is issued, and not thereafter. If such authorized work
and construction shall not have been completed within such
twelve month period, work and construction thereon shall cease
unless and until a special permit therefor shall be granted in
like manner and for like fee as the original permit issued
under paragraph 2 hereof.
4th. Any person violating this ordinance shall be fined
not exceeding Twenty Five Dollars.
The said Ordinance having been read in full Councilran Macon
moved the suspension of the rules that the Ordinance might be
put upon its immediate passage, which motion having been second-
ed by Councilman Berglin, was put upon its passage with the
following results, voting for the same: Mayor E. B. Overton,
Councilmen: Berglin, Brown, Macon and Mason, Councilman Blatch-
ford being absent. Voting against, None; whereupon the Mayor
announced the motion carried and the rules suspended. Council-
man Mason moved that the said Ordinance be put upon its
immediate passage, which motion haveing been seconded by
Brown w as put upon its passage with the following results, voting
for the same,: Mayor E. B. Overton, Councilmen Berglin, Brown,
Macon and Mason, Councilman Blatchford being absent; Against,
none; whereupon the Mayor declared the motion carried.
Councilman Berglin moved that the Ordinance be adopted, which
motion having been seconded by Councilman Brown was put upon
its passage by the Mayor with the following results: Voting
for the same: Mayor E. B.Overton, Councilmen Berglin, Brown,
Macon and Mason, Councilman Blatchford being absent; against,
none; whereupon the Mayor declared the Ordinance adopted and
signed the same.
Motion by Councilman Macon seconded by Councilman Berglin that
the City approve subdivision of Blocks 45 & 46, Magnolia Beach
Addition to the City of Fairhope, as submitted. Motion carried.
Motion by Councilman Macon seconded by Councilman Mason that the
City approve Plat #7 of Fairwood Subdivision as submitted.
Motion carried.
Motion by Councilman Macon seconded by Councilman Brown that
the City purchase used street sweeper subject to approval of
the Council upon arrival of same. Notion carried.
The Council discuesed an Ordinance pertaining to electrical
inspection which was held for further study.
It was duly moved and sgconded that the meeting adjourn.
