HomeMy WebLinkAbout12-13-1954 Regular MeetingSTATE OF ALABAMA County of Baldwin The City Council of the City 'of Fairhope met in -,regular session at th`e City Hall, Monday December 13,1954 with the following members present: Mayor i. B. Overton, City Manager C. B. Niemeyer, Councilmen: M. 0. Berglin, L. E. Blatchford, R. H. Brown, R. C. Macon and J. D. Mason. The minutes of the previous regularmeeting were read and approved as read. Mr. H. S. St. John gave a report of the work that has been completed on new sub -station, street lights and distribution system and the balance of work to be completed. Motion by Councilman Mason seconded by Councilman Berglin that the bill of Mr. St. John be approved for payment. Motion aarried. Motion by Councilman Berglin seconded by Councilman Macon that the following bills be approved for payment: Motioncarried. You must have the PROPER LICENSE before making any sales. Your license must be CONSPICUOUSLY DISPLAYED under a transparent substance upon the licensed premises. 2e Your license can be transferred ONE TIME ONLY from one location to another within the same municipality BUT NOT from one person to another person. 3e You must pay CASH for all beer purchased and all purchases must be from duly licensed wholesalers. You must pay a CASH DEPOSIT on all cases left by your wholesaler. 4. You must not OFFER or GIVE ANYTHING OF VALUE to induce the purchase of alcoholic beve ar gese 5, )All employees serving or dispensing alcoholic beverages MUST BE 21 YEARS OF AGE OR OVER, 6, You must keep ALL INVOICES of alcoholic beverages purchased for a period of THREE YEARS. Agents of the Board have the authority to check these invoicese 7e It is a violation of the law to have ANY ADVERTISING ThATTER on the licensed premises, or make ANY DISPLAY of alcoholic beverages. 8e You must not give CURB SERVICE. This means that beer must not be served to people seated in their automobiles and consumed there. 9. You must not sell any alcoholic beverages to persons under 21 YEARS OF AGE or to any INSANE PERSON or to any person VISIBLY INTOXICATED or to any HABITUAL DRUNKARD. 10. You must not sell or give any alcoholic beverages to anyone on ELECTION DAYS until after the polls have closed. 11, Alcoholic beverages may be listed on a separate sheet but such sheet MUST NOT BE ATTACHED to food menu. 12, There must not be any EXCHANGING, BARTERING, TRADING, GIVING OR SELLING of alcoholic beverages between the hours of 2:00 A.M. and 8:00 A.M. of each day* The same regulation is applicable between the hours of 12:00 midnight on any Saturday and 8:00 A.M. the following Monday. 13. Liquor licensees must COLLECT all empty liquor and wine bottles left on the licensed premises and all such empty bottles must be DESTROYED by the licensee EITHER IMMEDIATELY or REGULARLY. 14e Sales made by liquor licensees must be made to the customer in UNBROKEN PACKAGES or CONTAINERS and the consumer must be SEATED at a table. Mixed drinks are PERMISSIB but in each instance the waiter must DELIVER to the consumer the PARTICULAR BRAND desired in such mixed drink and there open or allow the consumer to open same. 15e You must operate your place in a QUIET, CLEAN AND ORDERLY YAYN.ER. You will be held responsible for ANY FIGHTS OR MISCONDUCT occurring in your place. If all of the above instructions are carried out by the licensee, he will have the full cooperation of the ABC Board. If there is any question you would like to ask, contact our Agent in that territory or write this office, as no excuse will be accepted for violation of these instructions. Stenzel to retail package beer in the Stenzel Building on South Section Street be approved. Motion carried. Motion by Councilman Berglin 'seconded by Councilman Mason that the building permit of R. A. Malone to build house on corner of Azalea and Dogwood be rejected. Motion carried. On motion of Councilman Blatchford seconded by Councilman Macon the claim filed on the 23rd day of November, 1954, by Juanita F. Brown and M. L. Brown with the City of Fairhope claiming damages was disapproved, rejected and disallowed by resolution as follows: BE IT RESOLVED that the claim of Juanita F. Brown and M. L. Brown heretofore filed with the City of Fairhope on the 23rd day of November, 1954'14the sum of $2,000.00 claiming damages against the City of Fairhope, be and the same is hereby disapproved, rejected and disallowed. Motion carried. Motion by Councilman Mason seconded by Councilman Berglin that Mr. H. S. St.John be authorized to draw up plans with the idea of installing old White Way Lights at the new High Schbol and the remaining lightsin Knoll Park. Motion carried. Motion by Councilman Macon seconded by Councilman Berglin that Ordinance #176 be amended to comply with the State A. B. C. regulations pertaining; to closing hours. Motion mrried. Mr. Isadore Reynolds appeared before the Council requesting assistance on the oneninz of South Section Street. It was duly moved and seconded that the meeting adjourn. Motion carried.
