County of Baldwin
The City Council of the City of Fairhope met in regular sessi on
at the City'Hall August 23, 1954 with the following members
present: Mayor A. B. Overton, City Manager C. B. Niemeyer, Council-
men M. 0. Berglin, L. E. Blatchford, R. H. Brown, R. C. Macon and-
J. D. Mason.
The minutes of the previous regular meeting were read and approved
as read.
Motion by Councilman Mason seconded by Councilman Berglin that
the request of Mrs. Roberta McCue to place sign on Fels Avenue
be approved as submitted. Motion carried.
Mr. E. B. Gwin representing the Chamber of Commerce met with the
Council to discuss Christmas decorations for the City. No action
taken.

Motion by Councilman Blatchford seconded by Councilman Macon that
The City request the Fairhope Single Tax Corporation to proceed
with paving and drainage on Bancroft Street from Fairhope Avenue
south to Morphy, width to be 80 feet and work to be according
to plans of engineer. The City at the present time will not
widen Bancroft Street from Fairhope Avenue north to'Magnolia.
Motion ' carried.
Motion by Councilman Berglin seconded by Councilman Blatchford
that statement from Alabama League of Municipalities for dues be
approved for payment. Motion carried.
Councilman Macon offered an Ordinance to be known as Planning
Zone Ordinance and Map, which motion was seconded by Councilman
Blatchford. The same being an Ordinance of permanent operation
was carried over for further consideration and passage at the next
regular meeting of the Councilman September 13, 19549 Motion carried.
The Council discussed paving on North Church Street, the City
Manager to meet with property owners in area to be paved.
Mr. Tom -Parks of the Park-0-__meter Company met with the Council to
demonstrate parking meters. Motion by Councilman Berglin seconded
by Councilman Brown that representatives from several Parking
Meter Companies be invited to meet with the Council before a decision
is made regarding parking meters. Motion carried.
It was duly moved and seconded that the meeting adjourn. Motion
carried.

BE IT RESOLVED by the City Council of the City of
Fairhope, advertisment of the sale of the same having
been made and bids having been received therefor and
Byrd L. Moore's bid being the highest and best bid, the
Mayor and Clerk be and they are hereby authorized and
directed to execute to Byrd L. Moore a warranty deed and
to deliver the same to him upon his paying to them for
the City of Fairhope the sum of $1025.00 the following
described lands::
From the -intersection of the Northwest boundary line of
Block 23, Volanta, and the East boundary of Pensacola
Avenue in Volanta, which point is the Northwest corner
of Block 23, Volanta, according to map thereof recorded
in Misc. Book 1, page 34.1, Probate records of Baldwin
County Alabama, as a point of beginning: run thence
North 640 44' East 286.0 feet; thence run South 72° 351
East, 81.1 feet to a point on the West side of Alabama
Highway-$9; thence run South 17° 25' West along said
highway, 493.20 feet; thence run North 70° 13' West
17.4 feet to a point on the east side of Pensacola Avenue;
thence run North 25° West, along Pensacola Avenue 404..65
feet to -the point of beginning; Being a part of Block 23,
Volanta, and lying in the de Ferriet Grant, Section 37,
Township 6 South, Range 2 East, Baldwin County, Alabama,
and containing 2.0 acres, more or less;

Attached hereto you will find copy of Act No. 102 which
prohibits the giving away, selling, serving or drinking of alcoholic
and malt or brewed beverages in public places on Sunday.
This law not only assesses a penalty against the person
consuming alcoholic beverages in a public place on Sunday, but also
provides a penalty for the person, firm, or corporation who allows
the consumption of alcoholic beverages in their establishments on
Sunday.
You are hereby notified that should you be found guilty of
violating this new law, then it will be necessary for you to appear
before the Board and show cause why your license should not be re-
voked,

AN ACT
Prohibiting the giving away, selling, serving or drinking of alcoholic.and malt or brewed
beverages in public places on Sunday. and.making any violation of this Act. a misdemeanor.
Be It:Enacted.bx the Legislature of Alabama:
Section I. Any person who gives away, sells, serves, or drinks any.alcoholic or malt or
brewed beverage in any cafe, lunchroom, restaurant, hotel dining room, or other public place on
Sunday is guilty of a misdemeanor, and upon.conviction shall be fined not less than.ten nor more
than one hundred dollars and may also be imprisoned in the county jail, or sentenced to hard labor
for the county.for not more than three months.
Section 2. The proprietor, keeper, or operator of any cafe, lunchroom, restaurant, hotel
dining room, or other public place who knowingly permits, -any person to give away, sell, serve, or
drink any alcoholic or malt or brewed beverage on.the premises of such cafe, lunchroom, restau-
rant,.hotel dining room, or other public place on Sunday is guilty of a misdemeanor and upon con-
viction shall be fined not less than ten nor more than one hundred.dollars, and may also be im-
prisooed in the county jail or sentenced to hard labor for the county for not more than three
mon th s.
Section 3. All laws or parts of laws in conflict herewith.are repealed.
Section 4. This Act shall take effect upon its passage and approval by.the,Governor or its
otherwise becoming law.
