Kirk 400.00 This being date set for final adoption of Ordinance # 227 said Ordinance having been read to the Council, Councilman Balich- ford moved its adoption which motin being seconded by Councilman overton was put upon its final passage with the following results: Voting for the same, Mayor Klumpp, Councilman Berglin, Blatch- ford, Macon, Masonand Overton. Voting against, None. The Mayor thereupon declared the Ordinance finally adopted and signed the same in approval thereof. ORDINANCE #227 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPP, ALABAMA as follows: SECTION 1. That from and after the adoption of this Ordinance no commercial, manufacturing or industrial building or building used in connection thereftth-'-shill be erected on the East side of Bancroft Street nearer than fourteen(14) feet from the property line on said street as the same is of the date this Ordinance is adopted. SECTION 2. No permit shall be issued for the erection of any building on Bast side of said street unless and until proper plans and specifications have been presented to the Council showing the location of the building to be erected; provided, however that the Council may b:=a two-thirds vote, in instances deemed proper by the Council'i fiaiver the requirements of this Ordinance. SECTION 3. It shall be unlawful for any person, firm, corporation or association to erect any building on Bast side of said street without first obtaining a permit therefor and upon conviction shall be fined not less than $1.00 nor more than $100.00 and sentenced for not more than 90 days. No-4- I NSURANC E COVAN I ES, OTHER THAW IRE AND 'LIAR I NE s Each insurance company other than fire, marine kind fraternal, shall pay an annual license of $10 plus 41 on each 4100 and major fraction thereof, of gross premiums, less returned premiums on policies issued during the preceding year to citizens of the Town of Fairhope, provided that in case such company shall not have conducted business for the full period of said preceding year, it shall pay $10 plus one per cent o IF that amount which bears the same relationship to the gross amount of premiums, less return premiums on policies issued during said preceding year as 365 bears to the number of days during which business was conducted in such preceding year. Companies commencing business after the first of the current licensee tax year shall pay $10 plus $1 on each 4100 and major fraction thereof of gross pre- miums, less return premiums, on policies issued during the said aarrent year to citizens of the said Town of Fairhope. Such new companies shall pay a flat minimum of $10 at the time of commencement of busirr-ss upon which there shall be an adjust- ment at the end of the year upon the basis herein provided for new companies, provided that in no event shall the license of any such new company be less than $10. license under thr-v. o-hedule and the next succeeding schedule shall be deemed delinquent the first day of March of each year. There shall be no pro -ration of the #10 deposit required of new companies entering into business in the city during the year. No. 5 - 1 NSURAWE C OMPAN IE S,F I RE AND MAR I PEE: Each fire insurance company 32,50 on each $100 of gross premiums, less return premiums, received on policies issued during the preceding year on property located in the Town of Fairhope. provided, that in case such company shall not have conducted business in the Town of Fairhope during the entire period of the preceding year, it shall pay 2f per cent of that amount which bears the same relationship to the gross amount of premiums, less return premiums, received on policies issued during the said preceding year on property located in said Town as 365 bears to the number of days during which such company conducted business in said Town. Companies commencing business after the first of the current license tax year shall pay $2.50 on each 3100 of gross premiums, less return premiums, received onpolicloo issued during the said current year on property located in the Town of Fairnope. Suco new -companies shall pay a flat minimum license of 315 at the time of the commence- ment of business upon which there shall be an adjustment at the end of the year upon the basis herein provided for such new companies, provided that in no event shall the license of any such new company be less than $15, There is to be no pro-ratIon of V,-* 315 deposit required of new companies entering into business in the Town during the year, ' Adopted and approved April 8th, 1940. SECTIoN.4. Any person who shall erect any building in violation with this ordinance shall remove the same upon notice by the mayor requiring such removal. Adopted this the loth day of May, 1954. Motion by Councilman Mason seconded by Councilman Blatchford that the bill submitted by mr. St. John be approved for payment. Motion carried. Lotion by Councilman Overton seconded by Councilman Berglin that Mr. Roy moyers be reappointed to serve as an aetite member of the Water and Sewer Board for a term of six years beginning June 26, 1954, motion carried. Motion by Councilman Mason seconded by Councilman Overton that the mayor be authorized to write the Fairhope Single Tax Corporation requesting that they take under consideration -6hak4w installation of underground storm sewers on !North Bancroft Street and East on to the Gulley. Motion carried. Motion by Councilman Mason seconded by Councilman Macon that the meeting adjourn in unadjourned session to meet on Friday, May 149 1954 at 7:30 PA. Motion carried.
