HomeMy WebLinkAbout02-22-1954 Regular MeetingSTATE OF ALABAMA County of Baldwin The City Council of the City of Fairhope met in regular session at the City Hall, Monday, February 22, 1954 with the following members present: Mayor T. J. Klumpp, City Manager C. Be Niemeyer, Councilmen M. 0. Berglin, L. E. Blatchford, R. C. Macon, J. D. Mason and E. Be Overton. The minutes of the previous regular meeting were read and approved as read. Councilman Berglin introduced the following Ordinance which was read to the Council: ORDINANCE # 225 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FAIRHOPE: SECTION 1. That whenever the Municipal Fire Department shall be called to a fire outside the corporate limits of the City of Fairhope, but within the police jurisdiction thereof, the person calling the fire department shall pay to the City of Fairhope for the use of the fire department the sum of $15.00 for each fire, and whenever called to a fire outside the corporate limits and police jurisdiction of the City of Fairhope, the person calling the fire department shall nay to the City of Fairhope for the use of the fire department the sum of $15.00 for eabh fire, plus the sum of $1.00 for each mile in excess of one mile beyond the police jurisdiction and $10.00 per hour from time of departure until return to the Fire Station. Councilman Berglin moved that the rules be suspended and unanimous consent be given for immediate consideration of and action on said Ordinance which motion was seconded by Council- man Mason and upon the motion being put to vote the following vote was recorded: Voting Yes, Mayor Klumpp, Councilmen M. 0. Berglin, L. E. Blatchford, R. C. Macon, J. D. Mason and E. Be Overton. Voting Nay; None. The Mayor thereupon declared that the motion for unanimous consent for immediate consideration of and action on said Ordinance had been unanimously carried. Councilman Mason thereupon moved that said Ordinance be finally adopted, which motion was seconded by Councilman Blatchford and upon said motion being put to vote the following vote was recorded; Yeas, mayor Klumpp, Councilmen M. 0. Berglin, L. E. Blatchford, R. C. Macon, J. D. Mason and E. Be Overton. Nays, None. The Mayor then announced that the motion for adoption of said Ordinance had been unanimously carried and signed the same in approval thereof. Done this the 22nd day of February, 1954. E `07L.A& Attest: City Clak Motion by Councilman Mason seconded by Councilman Blatchford that the City purchase land for Armory as per memorandum of agreement between Robert R. Nahrgang and Marjorie Nahrgang and the City of Fairhope dated February 179 1954. Motion carried. STATE ',LABAMA BALDWI__ oOUNTY THIS ICMORANDUM OF AGREaENT made and entered into on this the 17th day of February, 1954, by and between_ Robert R. Nahrgang and Marjorie Nahrgang, his wife, FIRST PARTY, and the City of Fairhope, SECOND PARTY, TKITNESSETH: FIRST: First party contracts and agrees to sell and the second party to buy, under the terms and conditions and at the consideration set out herein, the following described real property situated in the City of Fairhope, Baldwin County, Alabama, to -wit: All those lands, and interest in land owned by the first party South of the South line and the extension of the South line of Block 1 of Fair - wood subdivision number 1, and West of Fairwood Boulevard, as now located, following its meanders to the North line of first party's proposed sub- division of lands West of Fairwood Boulevard and East of Fairwood Gulley; SECOND: The second party will pay to the first party as consideration for the said lands the suns of 5,000.00, and in addition thereto it contracts and agrees to acquire whatever interest the State of Alabama has in and to lands East of the said Fairwood Boulevard and East of Fairwood Gulley, and to convey the same, or cause the same to be conveyed, to Robert R. Nahrgang free and clear from any claim on the part of the State of Alabama. THIRD: A true and correct survey of Fairwood Boulevard shall be recorded at the expense of the City of Fairhope. The first party will convey the aforesaid property to the second party when it has acquired the said above named two tracts from the State of Alabama, and conveys the same, or causes the same to be conveyed to the first party, and upon payment of the sum of $5,000.00 as provided in section two hereof. IN WITNESS VJHEREOF, the City of Fairhope has caused these presents to be executed by T. J. Klumpp, its mayor, and. Robert R. Nahrgang and Marjorie Nahrgang have hereunto set their hands and \� seals this the day and year first above written. C� Motion by Councilman Macon seconded by Councilman Mason that the City purchase new Police car as per bid submitted by.Gaston Motor Co. Motion carried. Motion by Councilman Overton seconded by Councilman Berglin that the building permit of Mr. C. W. Cleveland be approved subject to building being of fireproof construction and back 35 feet from the center of Section Street. Motion carried. Motion by Councilman Blatchford seconded by Councilman Berglin that the City accept sealed bids on the following described property: "All that part of Block 23 of "Volanta" lying West of Alabama State Highway No. 89, more particularly described as follows: From the Northeast corner of Lot 16 of Block 17 of Volanta, Alabama, as shown by map thereof re- corded in Miscellaneous Book No. 1, at page 341, Probate Records, Baldwin County, Alabama, run S 70 deg. B, 90.3 feet for a point of beginning: Thence run S 25 deg E 431.18 ft.; thence run N 17 deg. 25 minutes E,567.25 feet; thence rung S 64 deg. 44 minutes W, 396.45 feet to the point of beginning. Containing 2.07 acres, more or less. The City to reserve feet on . co gg§4 for right-of-way. The City will open bids at their regular meetin @X March 22, 1954. The City reserves the right to reject any or all bids. Motion carried. Motion by Councilman Mason seconded by Councilman Blatchford that the City purchase a new one ton truck'as per bid submitted by Gaston Motor Company and a Street Light Maintenance Body from Alabama Truck Equipment Company of Birmingham, Alabama. Motion carried. It was duly moved and seconded that the meeting adjourn. Motion carried. Approved Mayor Attest: City Clerk
