County of Baldwin
The City Council met in regular session on Monday, February 81
1954 with the following members present: City Manager C. B.
Niemeyer, Councilmen: 11. 0. Berglin, L. E. Blatchford, R. C.
Macon, J. D. Mason and E. B. Overton. Mayor Klumpp being absent.
Motion by Councilman Macon seconded by Councilman Blatchford
that Councilman Mason act as Mayor in the absence of Mayor Klumpp.
Motion carried.
The minutes of the previous regular meeting were read and approved
as read.
Motion by Councilman Macon seconded by Councilman Berglin that the
following bills be approved for payment:

Mr. Henry Bishop met with the Council in regards
to site for
Armory.
Mr. Isadore Reynolds met with the Council with request that the
Council approve certain streets on S. Section Street. After a
general discussion it was suggested that Mr. Reynolds Present this
to the City Planning Board for their approval before presenting
it to the City Council.
A Committee from the Volunteer Fire Department headed by Mr. C. H.
Woodward, Fire Chief, Met with the Council in regards to fee for
fire calls outside City Limits, Councilman Berglin to meet with
the fire department to work out a fee. An Ordinance pertaining
to above ground storage tanks for imflammable liquids was dis-
cussed, action to be taken at a later date.
Motion by Councilman Overton seconded by Councilman Berglin that
insurance on Volunteer Fire Department be increased to the maximum
which pays $40.00 weekly benefits, $2500.00 Medical Benefits and
$5,000 Deat%Benefits. Motion carried.
Councilman Macon introduced the following Ordinance which was read
to the Council.
ORDINANCE #224
WHEREAS, the construction of commercial and industrial build-
ings and garage apartments in residential areas is not in accordance
with the best development of the City of Fairhope, and
WHEREAS, the construction of multi -family dwelling creates
problemsn which need special consideration, and
WHEREAS, the CITY PLA1NING COMMISSION OF Fairhope is
making a study of the City of Fairhope and matters concerning
the most beneficial development of Fairhope and is now preparing
a master plan, including a new comprehensive zoning ordinance for
the City of Fairhope, and
WHEREAS, numerous applications for commercial and industrial
building, garage apartments, and multi -family dwellings, and semi-
plublic structures are bing received kk by the City and efforts
made to construct such buildings prior to the adoption of the
various elements of the master plant, and
WHEREAS, many of the applications are contrary to the proposed
master plan, and
WHEREAS, it is the d6eire of the City Council of Fairhope
to control the building of commercial and industrial building,
garage apartments and multi -family dwellings, in accordance with
the proposed plan:
NOW) THEREFORE, Be it Ordained by the City Council of the
City of Fairhope, Alabama, as follows:
SECTION 1. No building permits shall be issued by the City of
Fairhope or any employee thereof for the construction in whole or
in part of any industrial building, garage apartment, duplex
apartment, or other multi -family dwelling or any commercial build-
ing in any part of the City other than within the fire zone, unless
such application for such permit has been submitted to the City
Planning Commission of Fairhope, Alabama for recommendation to the
City Council of the City of Fairhope, Alabama.
SECTION 2. All ordinances or parts of ordinances or sections
of gny code of the City of Fairhope, Alabama in conflict with this
Ordinance are hereby repealed.
SECTION 3. This ordinance shall take effect as provided by
law.

Councilman Overton moved that the rules be suspended and unanimous
consent be given for immediate consideration of and action on
said Ordinance which motion was seconded by Councilman Blatchford
and upon the motion being put to vote the following vote was
recorded: Voting Yes, Councilmen L. E. Blatchford, M. 0. Berglin,
R. C. Macon, E. B. Overton and Acting Mayor Mason. Moyor Klumpp
being absent. Voting Nay, None. The Acting Mayor thereupon
declared that the motion for unanimous consent for imm diate
consideration of and action on said Ordinance had been unanimously
carried. Councilman Overton thereupon moved that said Ordinance
be finally adopted, whidh motion was seconded by Councilman
Blatchford and upon said motion being put to vote the following
vote was recorded: Yeas, Acting Mayor Mason, Councilmen M. 0.
Berglin, L. E. Blatchford, R. C. Macon and E. B. Overton, Mayor
Klumpp being absent. Hays, None. The Acting Mayor then announced
that the motion for adoption of said Ordinance had been unanimously
carried and signed the same in approval thereof.
Done this the 8th day of February, 1954.

It was duly moved and seconded that the meeting adjourn in unadjourn-
ed session to meet on Tuesday, February 9, 1954 at 4:00 P.M. at
City Hall. Motion carried. 4
